11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 411, Government Code, is amended by |
---|
13 | 13 | | adding Subchapter B-2 to read as follows: |
---|
14 | 14 | | SUBCHAPTER B-2. TEXAS DIVISION OF HOMELAND SECURITY |
---|
15 | 15 | | Sec. 411.0281. DEFINITION. In this subchapter, "division" |
---|
16 | 16 | | means the Texas Division of Homeland Security created under this |
---|
17 | 17 | | subchapter. |
---|
18 | 18 | | Sec. 411.0282. CREATION OF DIVISION; CHIEF. (a) The Texas |
---|
19 | 19 | | Division of Homeland Security is created as a division of the |
---|
20 | 20 | | department. |
---|
21 | 21 | | (b) Notwithstanding Section 411.015, the division may not |
---|
22 | 22 | | be abolished. |
---|
23 | 23 | | (c) The director shall appoint a chief to be the division's |
---|
24 | 24 | | chief administrative officer. |
---|
25 | 25 | | Sec. 411.0283. BORDER OPERATIONS. The division may conduct |
---|
26 | 26 | | border security operations along the Texas-Mexico border, |
---|
27 | 27 | | including: |
---|
28 | 28 | | (1) law enforcement operations; |
---|
29 | 29 | | (2) intelligence gathering, analysis, and |
---|
30 | 30 | | dissemination; |
---|
31 | 31 | | (3) coordination and command of state agencies in |
---|
32 | 32 | | border security operations led by the division; |
---|
33 | 33 | | (4) surveillance and detection of criminal activity, |
---|
34 | 34 | | including illegal entry of individuals from foreign nations and the |
---|
35 | 35 | | smuggling of individuals and controlled substances, using cameras, |
---|
36 | 36 | | unmanned aircraft, and other technologies; |
---|
37 | 37 | | (5) interdiction of individuals committing criminal |
---|
38 | 38 | | activity described by Subdivision (4); |
---|
39 | 39 | | (6) coordination of local, state, and federal agencies |
---|
40 | 40 | | conducting border security operations, including tactical |
---|
41 | 41 | | operations such as special response teams, brush teams, and special |
---|
42 | 42 | | weapons and tactics teams; and |
---|
43 | 43 | | (7) training and education programs for the |
---|
44 | 44 | | professional development of employees and agency partners carrying |
---|
45 | 45 | | out border security operations. |

46 | 46 | | SECTION 2. This Act takes effect September 1, 2025. |
