611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to a commission to coordinate celebrations of the
914 bicentennial anniversary of Texas' independence.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Subtitle D, Title 4, Government Code, is amended
1217 by adding Chapter 452 to read as follows:
1318 CHAPTER 452. TEXAS BICENTENNIAL COMMISSION
1419 Sec. 452.001. DEFINITION. In this chapter, "commission"
1520 means the Texas Bicentennial Commission.
1621 Sec. 452.002. COMMISSION. (a) The Texas Bicentennial
1722 Commission is composed of the following 23 members appointed as
1823 follows:
1924 (1) nine members of the public appointed by the
2025 governor with the advice and consent of the senate;
2126 (2) three senators appointed by the lieutenant
2227 governor;
2328 (3) three members of the house of representatives
2429 appointed by the speaker of the house of representatives; and
2530 (4) the following ex officio members:
2631 (A) the executive head of the Texas Economic
2732 Development and Tourism Office within the office of the governor;
2833 (B) the executive director of the Texas
2934 Historical Commission;
3035 (C) the executive director of the Texas
3136 Commission on the Arts;
3237 (D) the director of the Texas Film Commission;
3338 (E) the commissioner of education;
3439 (F) the commissioner of higher education;
3540 (G) the director of the travel information
3641 division of the Texas Department of Transportation; and
3742 (H) the director of the Institute of Texan
3843 Cultures at The University of Texas at San Antonio.
3944 (b) The public members appointed by the governor must
4045 reflect the diverse geographic regions and population groups of
4146 this state.
4247 (c) Each member of the commission is a voting member. The
4348 duties performed by an ex officio member of the commission
4449 constitute additional duties of the underlying position that
4550 qualifies the member for service on the commission.
4651 (d) A member of the commission who is a senator or
4752 representative vacates the member's position if the member ceases
4853 to hold the underlying position that qualifies the member for
4954 service on the commission.
5055 (e) A public member shall serve until a successor is
5156 appointed and qualified.
5257 (f) A vacancy in the membership of the commission shall be
5358 filled for the unexpired term in the manner provided for the
5459 original appointment.
5560 Sec. 452.003. TERMS. Appointed members of the commission
5661 serve staggered six-year terms with the terms of three members
5762 appointed by the governor, one member appointed by the lieutenant
5863 governor, and one member appointed by the speaker of the house of
5964 representatives expiring on January 31 of each odd-numbered year.
6065 Sec. 452.004. PRESIDING OFFICER. (a) The governor shall
6166 appoint one member of the commission to serve as presiding officer.
6267 The presiding officer serves at the will of the governor.
6368 (b) If the presiding officer is absent from a meeting or is
6469 disabled, the members of the commission present at the meeting
6570 shall elect a temporary presiding officer by majority vote.
6671 Sec. 452.005. MEETINGS; QUORUM. (a) The commission shall
6772 meet at least quarterly and at other times at the call of the
6873 presiding officer or as provided by commission rule.
6974 (b) Chapter 551 applies to the commission.
7075 (c) Thirteen members of the commission constitute a quorum.
7176 Sec. 452.006. COMPENSATION; REIMBURSEMENT. (a) A member
7277 of the commission is not entitled to compensation for service on the
7378 commission but is entitled to reimbursement for actual and
7479 necessary expenses incurred in performing commission duties,
7580 subject to any applicable limitation on reimbursement provided by
7681 the General Appropriations Act.
7782 (b) A member appointed by the governor shall be reimbursed
7883 from the commission's funds. A member appointed by the lieutenant
7984 governor or speaker of the house of representatives shall be
8085 reimbursed from the appropriate fund of the member's chamber of the
8186 legislature. An ex officio member shall be reimbursed from the
8287 funds of the entity from which the member serves.
8388 Sec. 452.007. EXECUTIVE DIRECTOR; STAFF. (a) The
8489 commission may employ an executive director to serve as the
8590 executive head of the commission and perform its administrative
8691 functions.
8792 (b) The executive director may employ staff necessary to
8893 administer the commission.
8994 Sec. 452.008. POWERS AND DUTIES OF COMMISSION. The
9095 commission shall:
9196 (1) encourage individuals, private organizations, and
9297 local governmental bodies to organize activities celebrating the
9398 bicentennial of this state's independence;
9499 (2) assist individuals, private organizations, and
95100 local governmental bodies that organize bicentennial activities to
96101 coordinate the activities;
97102 (3) gather and disseminate information to the public
98103 about bicentennial activities conducted in the state;
99104 (4) develop standards for bicentennial activities
100105 organized by individuals, private organizations, and local
101106 governmental bodies and sanction activities that comply with the
102107 standards;
103108 (5) invite national and international dignitaries to
104109 attend and participate in bicentennial activities conducted in this
105110 state;
106111 (6) encourage persons living outside the state to
107112 attend bicentennial activities occurring in the state;
108113 (7) develop a logo to be used by the commission and
109114 permit other persons to use the logo if the commission considers the
110115 use appropriate; and
111116 (8) sanction products the commission may sell,
112117 including a commemorative calendar or flag, commemorating the
113118 state's bicentennial.
114119 Sec. 452.009. REPORT. Not later than September 1, 2037, the
115120 commission shall file a report with the governor and the
116121 legislature containing information about the effects of the
117122 bicentennial activities conducted in this state on the state's
118123 economy.
119124 Sec. 452.010. DONATIONS; GRANTS. The commission may
120125 solicit and accept, on behalf of the state, gifts, grants, and
121126 donations from any source to be used by the commission to perform
122127 its duties.
123128 Sec. 452.011. RULES. The commission may adopt rules
124129 necessary to perform its functions.
125130 Sec. 452.012. EXPIRATION. The commission is abolished and
126131 this chapter expires September 1, 2037.
127132 SECTION 2. (a) Not later than December 1, 2025, the
128133 governor, lieutenant governor, and speaker of the house of
129134 representatives shall appoint the initial members to the Texas
130135 Bicentennial Commission in accordance with Section 452.002,
131136 Government Code, as added by this Act.
132137 (b) Notwithstanding Section 452.003, Government Code, as
133138 added by this Act, in making the initial appointments to the Texas
134139 Bicentennial Commission under Subsection (a) of this section:
135140 (1) the governor shall designate three members for
136141 terms expiring January 31, 2027, three members for terms expiring
137142 January 31, 2029, and three members for terms expiring January 31,
138143 2031;
139144 (2) the lieutenant governor shall designate one member
140145 for a term expiring January 31, 2027, one member for a term expiring
141146 January 31, 2029, and one member for a term expiring January 31,
142147 2031; and
143148 (3) the speaker of the house of representatives shall
144149 designate one member for a term expiring January 31, 2027, one
145150 member for a term expiring January 31, 2029, and one member for a
146151 term expiring January 31, 2031.
147152 SECTION 3. This Act takes effect September 1, 2025.
