10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 16 | | SECTION 1. Subtitle D, Title 4, Government Code, is amended |
---|
12 | 17 | | by adding Chapter 452 to read as follows: |
---|
13 | 18 | | CHAPTER 452. TEXAS BICENTENNIAL COMMISSION |
---|
14 | 19 | | Sec. 452.001. DEFINITION. In this chapter, "commission" |
---|
15 | 20 | | means the Texas Bicentennial Commission. |
---|
16 | 21 | | Sec. 452.002. COMMISSION. (a) The Texas Bicentennial |
---|
17 | 22 | | Commission is composed of the following 23 members appointed as |
---|
18 | 23 | | follows: |
---|
19 | 24 | | (1) nine members of the public appointed by the |
---|
20 | 25 | | governor with the advice and consent of the senate; |
---|
21 | 26 | | (2) three senators appointed by the lieutenant |
---|
22 | 27 | | governor; |
---|
23 | 28 | | (3) three members of the house of representatives |
---|
24 | 29 | | appointed by the speaker of the house of representatives; and |
---|
25 | 30 | | (4) the following ex officio members: |
---|
26 | 31 | | (A) the executive head of the Texas Economic |
---|
27 | 32 | | Development and Tourism Office within the office of the governor; |
---|
28 | 33 | | (B) the executive director of the Texas |
---|
29 | 34 | | Historical Commission; |
---|
30 | 35 | | (C) the executive director of the Texas |
---|
31 | 36 | | Commission on the Arts; |
---|
32 | 37 | | (D) the director of the Texas Film Commission; |
---|
33 | 38 | | (E) the commissioner of education; |
---|
34 | 39 | | (F) the commissioner of higher education; |
---|
35 | 40 | | (G) the director of the travel information |
---|
36 | 41 | | division of the Texas Department of Transportation; and |
---|
37 | 42 | | (H) the director of the Institute of Texan |
---|
38 | 43 | | Cultures at The University of Texas at San Antonio. |
---|
39 | 44 | | (b) The public members appointed by the governor must |
---|
40 | 45 | | reflect the diverse geographic regions and population groups of |
---|
41 | 46 | | this state. |
---|
42 | 47 | | (c) Each member of the commission is a voting member. The |
---|
43 | 48 | | duties performed by an ex officio member of the commission |
---|
44 | 49 | | constitute additional duties of the underlying position that |
---|
45 | 50 | | qualifies the member for service on the commission. |
---|
46 | 51 | | (d) A member of the commission who is a senator or |
---|
47 | 52 | | representative vacates the member's position if the member ceases |
---|
48 | 53 | | to hold the underlying position that qualifies the member for |
---|
49 | 54 | | service on the commission. |
---|
50 | 55 | | (e) A public member shall serve until a successor is |
---|
51 | 56 | | appointed and qualified. |
---|
52 | 57 | | (f) A vacancy in the membership of the commission shall be |
---|
53 | 58 | | filled for the unexpired term in the manner provided for the |
---|
54 | 59 | | original appointment. |
---|
55 | 60 | | Sec. 452.003. TERMS. Appointed members of the commission |
---|
56 | 61 | | serve staggered six-year terms with the terms of three members |
---|
57 | 62 | | appointed by the governor, one member appointed by the lieutenant |
---|
58 | 63 | | governor, and one member appointed by the speaker of the house of |
---|
59 | 64 | | representatives expiring on January 31 of each odd-numbered year. |
---|
60 | 65 | | Sec. 452.004. PRESIDING OFFICER. (a) The governor shall |
---|
61 | 66 | | appoint one member of the commission to serve as presiding officer. |
---|
62 | 67 | | The presiding officer serves at the will of the governor. |
---|
63 | 68 | | (b) If the presiding officer is absent from a meeting or is |
---|
64 | 69 | | disabled, the members of the commission present at the meeting |
---|
65 | 70 | | shall elect a temporary presiding officer by majority vote. |
---|
66 | 71 | | Sec. 452.005. MEETINGS; QUORUM. (a) The commission shall |
---|
67 | 72 | | meet at least quarterly and at other times at the call of the |
---|
68 | 73 | | presiding officer or as provided by commission rule. |
---|
69 | 74 | | (b) Chapter 551 applies to the commission. |
---|
70 | 75 | | (c) Thirteen members of the commission constitute a quorum. |
---|
71 | 76 | | Sec. 452.006. COMPENSATION; REIMBURSEMENT. (a) A member |
---|
72 | 77 | | of the commission is not entitled to compensation for service on the |
---|
73 | 78 | | commission but is entitled to reimbursement for actual and |
---|
74 | 79 | | necessary expenses incurred in performing commission duties, |
---|
75 | 80 | | subject to any applicable limitation on reimbursement provided by |
---|
76 | 81 | | the General Appropriations Act. |
---|
77 | 82 | | (b) A member appointed by the governor shall be reimbursed |
---|
78 | 83 | | from the commission's funds. A member appointed by the lieutenant |
---|
79 | 84 | | governor or speaker of the house of representatives shall be |
---|
80 | 85 | | reimbursed from the appropriate fund of the member's chamber of the |
---|
81 | 86 | | legislature. An ex officio member shall be reimbursed from the |
---|
82 | 87 | | funds of the entity from which the member serves. |
---|
83 | 88 | | Sec. 452.007. EXECUTIVE DIRECTOR; STAFF. (a) The |
---|
84 | 89 | | commission may employ an executive director to serve as the |
---|
85 | 90 | | executive head of the commission and perform its administrative |
---|
86 | 91 | | functions. |
---|
87 | 92 | | (b) The executive director may employ staff necessary to |
---|
88 | 93 | | administer the commission. |
---|
89 | 94 | | Sec. 452.008. POWERS AND DUTIES OF COMMISSION. The |
---|
90 | 95 | | commission shall: |
---|
91 | 96 | | (1) encourage individuals, private organizations, and |
---|
92 | 97 | | local governmental bodies to organize activities celebrating the |
---|
93 | 98 | | bicentennial of this state's independence; |
---|
94 | 99 | | (2) assist individuals, private organizations, and |
---|
95 | 100 | | local governmental bodies that organize bicentennial activities to |
---|
96 | 101 | | coordinate the activities; |
---|
97 | 102 | | (3) gather and disseminate information to the public |
---|
98 | 103 | | about bicentennial activities conducted in the state; |
---|
99 | 104 | | (4) develop standards for bicentennial activities |
---|
100 | 105 | | organized by individuals, private organizations, and local |
---|
101 | 106 | | governmental bodies and sanction activities that comply with the |
---|
102 | 107 | | standards; |
---|
103 | 108 | | (5) invite national and international dignitaries to |
---|
104 | 109 | | attend and participate in bicentennial activities conducted in this |
---|
105 | 110 | | state; |
---|
106 | 111 | | (6) encourage persons living outside the state to |
---|
107 | 112 | | attend bicentennial activities occurring in the state; |
---|
108 | 113 | | (7) develop a logo to be used by the commission and |
---|
109 | 114 | | permit other persons to use the logo if the commission considers the |
---|
110 | 115 | | use appropriate; and |
---|
111 | 116 | | (8) sanction products the commission may sell, |
---|
112 | 117 | | including a commemorative calendar or flag, commemorating the |
---|
113 | 118 | | state's bicentennial. |
---|
114 | 119 | | Sec. 452.009. REPORT. Not later than September 1, 2037, the |
---|
115 | 120 | | commission shall file a report with the governor and the |
---|
116 | 121 | | legislature containing information about the effects of the |
---|
117 | 122 | | bicentennial activities conducted in this state on the state's |
---|
118 | 123 | | economy. |
---|
119 | 124 | | Sec. 452.010. DONATIONS; GRANTS. The commission may |
---|
120 | 125 | | solicit and accept, on behalf of the state, gifts, grants, and |
---|
121 | 126 | | donations from any source to be used by the commission to perform |
---|
122 | 127 | | its duties. |
---|
123 | 128 | | Sec. 452.011. RULES. The commission may adopt rules |
---|
124 | 129 | | necessary to perform its functions. |
---|
125 | 130 | | Sec. 452.012. EXPIRATION. The commission is abolished and |
---|
126 | 131 | | this chapter expires September 1, 2037. |
---|
127 | 132 | | SECTION 2. (a) Not later than December 1, 2025, the |
---|
128 | 133 | | governor, lieutenant governor, and speaker of the house of |
---|
129 | 134 | | representatives shall appoint the initial members to the Texas |
---|
130 | 135 | | Bicentennial Commission in accordance with Section 452.002, |
---|
131 | 136 | | Government Code, as added by this Act. |
---|
132 | 137 | | (b) Notwithstanding Section 452.003, Government Code, as |
---|
133 | 138 | | added by this Act, in making the initial appointments to the Texas |
---|
134 | 139 | | Bicentennial Commission under Subsection (a) of this section: |
---|
135 | 140 | | (1) the governor shall designate three members for |
---|
136 | 141 | | terms expiring January 31, 2027, three members for terms expiring |
---|
137 | 142 | | January 31, 2029, and three members for terms expiring January 31, |
---|
138 | 143 | | 2031; |
---|
139 | 144 | | (2) the lieutenant governor shall designate one member |
---|
140 | 145 | | for a term expiring January 31, 2027, one member for a term expiring |
---|
141 | 146 | | January 31, 2029, and one member for a term expiring January 31, |
---|
142 | 147 | | 2031; and |
---|
143 | 148 | | (3) the speaker of the house of representatives shall |
---|
144 | 149 | | designate one member for a term expiring January 31, 2027, one |
---|
145 | 150 | | member for a term expiring January 31, 2029, and one member for a |
---|
146 | 151 | | term expiring January 31, 2031. |
---|
147 | 152 | | SECTION 3. This Act takes effect September 1, 2025. |
