10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter E, Chapter 131, Agriculture Code, is | |
12 | 12 | amended by adding Section 131.085 to read as follows: | |
13 | 13 | Sec. 131.085. USE OF CERTAIN TEXAS LABELS. (a) A person | |
14 | 14 | may not label, sell, or keep, offer, or expose for sale a product | |
15 | 15 | identified on its label as "Texas honey," "product of Texas," | |
16 | 16 | "Texas blend," or "local honey" unless: | |
17 | 17 | (1) the product consists of honey produced entirely | |
18 | 18 | from apiaries located in Texas; and | |
19 | 19 | (2) at least 75 percent of the source nectar of the | |
20 | 20 | honey comes from plants located in Texas. | |
21 | 21 | (b) The Department of State Health Services shall suspend | |
22 | 22 | for not less than 90 days a food manufacturer's license if the | |
23 | 23 | license holder violates this section. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2025. |
