79 A BILL TO BE ENTITLED
810 AN ACT
911 relating to the establishment of the office of medical examiner in
1012 certain counties.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 1, Article 49.25, Code of Criminal
1315 Procedure, is amended to read as follows:
1416 Sec. 1. OFFICE REQUIRED IN CERTAIN COUNTIES AND AUTHORIZED
1517 IN OTHER COUNTIES. Subject to the provisions of this article, the
1618 commissioners court of any county with [having] a population of
1719 more than one [2.5] million shall establish and maintain the office
1820 of medical examiner, and the commissioners court of any county with
1921 a population of less than one million may establish and provide for
2022 the maintenance of the office of medical examiner. Population
2123 shall be according to the last preceding federal census.
2224 SECTION 2. Section 1-a(a), Article 49.25, Code of Criminal
2325 Procedure, is amended to read as follows:
2426 (a) The commissioners courts of two or more counties,
2527 regardless of population size, may enter into an agreement to
2628 create a medical examiners district and to jointly operate and
2729 maintain the office of medical examiner of the district. The
2830 district must include the entire area of all counties involved. The
2931 counties within the district must, when taken together, form a
3032 continuous area.
3133 SECTION 3. This Act takes effect September 1, 2025.
