69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the operation of certain metropolitan transit
912 authorities.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 162.356(b), Tax Code, is amended to read
1215 as follows:
1316 (b) The exemption provided by Subsection (a)(11) does not
1417 apply to compressed natural gas or liquefied natural gas delivered
1518 into the fuel supply tank of a motor vehicle from a refueling
1619 facility accessible to motor vehicles other than:
1720 (1) motor vehicles [those] described by Subsection
1821 (a)(11)(A); or
1922 (2) motor vehicles exempt from the tax imposed by this
2023 subchapter under another provision of Subsection (a), if the:
2124 (A) refueling facility is operated by a
2225 metropolitan rapid transit authority operating under Chapter 451,
2326 Transportation Code, in which the principal municipality has a
2427 population of less than 320,000; and
2528 (B) use of the refueling facility by those
2629 vehicles is limited to emergencies and other exigent circumstances
2730 as provided by an interlocal agreement under Chapter 791,
2831 Government Code.
2932 SECTION 2. Section 451.061(d-1), Transportation Code, is
3033 amended to read as follows:
3134 (d-1) The establishment of or a change to fares, tolls,
3235 charges, rents, and other compensation by an authority [confirmed
3336 before July 1, 1985,] in which the principal municipality has a
3437 population of less than 1.3 million[,] takes effect immediately on
3538 approval by a majority vote of the board, except that the
3639 establishment of or a change to a single-ride base fare takes effect
3740 on the 60th day after the date the board approves the fare or change
3841 to the fare, unless the policy board of the metropolitan planning
3942 organization that serves the area of the authority disapproves the
4043 fare or change to the fare by a majority vote.
4144 SECTION 3. Section 451.506, Transportation Code, is amended
4245 by adding Subsection (b-1) to read as follows:
4346 (b-1) This subsection applies only to an individual serving
4447 on the board of an authority in which the principal municipality has
4548 a population of less than 320,000. For purposes of Subsection (b),
4649 in determining the length of service on the board of an individual
4750 to whom this subsection applies the following periods of service
4851 are excluded:
4952 (1) a period of service that results from the
5053 individual's appointment to fill an unexpired term that occurs
5154 before the individual's first appointment to a full term on the
5255 board; or
5356 (2) a period of service on the board that is
5457 attributable to a term shortened by the individual's appointment as
5558 the board's presiding officer under Section 451.502(e).
5659 SECTION 4. This Act takes effect immediately if it receives
5760 a vote of two-thirds of all the members elected to each house, as
5861 provided by Section 39, Article III, Texas Constitution. If this
5962 Act does not receive the vote necessary for immediate effect, this
6063 Act takes effect September 1, 2025.
