7	10		AN ACT
8	11		relating to the operation of certain metropolitan transit
9	12		authorities.
10	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	14		SECTION 1. Section 162.356(b), Tax Code, is amended to read
12	15		as follows:
13	16		(b) The exemption provided by Subsection (a)(11) does not
14	17		apply to compressed natural gas or liquefied natural gas delivered
15	18		into the fuel supply tank of a motor vehicle from a refueling
16	19		facility accessible to motor vehicles other than:
17	20		(1) motor vehicles [those] described by Subsection
18	21		(a)(11)(A); or
19	22		(2) motor vehicles exempt from the tax imposed by this
20	23		subchapter under another provision of Subsection (a), if the:
21	24		(A) refueling facility is operated by a
22	25		metropolitan rapid transit authority operating under Chapter 451,
23	26		Transportation Code, in which the principal municipality has a
24	27		population of less than 320,000; and
25	28		(B) use of the refueling facility by those
26	29		vehicles is limited to emergencies and other exigent circumstances
27	30		as provided by an interlocal agreement under Chapter 791,
28	31		Government Code.
29	32		SECTION 2. Section 451.061(d-1), Transportation Code, is
30	33		amended to read as follows:
31	34		(d-1) The establishment of or a change to fares, tolls,
32	35		charges, rents, and other compensation by an authority [confirmed
33	36		before July 1, 1985,] in which the principal municipality has a
34	37		population of less than 1.3 million[,] takes effect immediately on
35	38		approval by a majority vote of the board, except that the
36	39		establishment of or a change to a single-ride base fare takes effect
37	40		on the 60th day after the date the board approves the fare or change
38	41		to the fare, unless the policy board of the metropolitan planning
39	42		organization that serves the area of the authority disapproves the
40	43		fare or change to the fare by a majority vote.
41	44		SECTION 3. Section 451.506, Transportation Code, is amended
42	45		by adding Subsection (b-1) to read as follows:
43	46		(b-1) This subsection applies only to an individual serving
44	47		on the board of an authority in which the principal municipality has
45	48		a population of less than 320,000. For purposes of Subsection (b),
46	49		in determining the length of service on the board of an individual
47	50		to whom this subsection applies the following periods of service
48	51		are excluded:
49	52		(1) a period of service that results from the
50	53		individual's appointment to fill an unexpired term that occurs
51	54		before the individual's first appointment to a full term on the
52	55		board; or
53	56		(2) a period of service on the board that is
54	57		attributable to a term shortened by the individual's appointment as
55	58		the board's presiding officer under Section 451.502(e).
56	59		SECTION 4. This Act takes effect immediately if it receives
57	60		a vote of two-thirds of all the members elected to each house, as
58	61		provided by Section 39, Article III, Texas Constitution. If this
59	62		Act does not receive the vote necessary for immediate effect, this
60	63		Act takes effect September 1, 2025.
