611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to testimony or the production of evidence before a house
914 of the legislature or a legislative committee.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 301.025, Government Code, is amended to
1217 read as follows:
1318 Sec. 301.025. REQUIRING WITNESS [REFUSAL] TO TESTIFY OR
1419 PRODUCE EVIDENCE; IMMUNITY; COUNSEL. (a) A witness called by
1520 either house of the legislature or by a legislative committee may
1621 [does] not [have a privilege to] refuse to testify to a fact or
1722 produce a document or other evidence for any reason, except as
1823 provided by Subsection (b) [on the ground that the testimony or
1924 document may tend to disgrace the person or otherwise make the
2025 person infamous].
2126 (b) Subject to Subsection (c), a witness called by either
2227 house of the legislature or by a legislative committee may refuse to
2328 testify to a fact or produce a document or other evidence on the
2429 ground that the testimony or evidence may incriminate the person.
2530 (c) A house of the [The] legislature or a legislative
2631 committee may require a person to testify or produce a document or
2732 other evidence concerning a matter under inquiry before that
2833 [either] house or [a legislative] committee even if the person
2934 claims that the testimony or evidence [document] may incriminate
3035 the person [him].
3136 (d) [(c)] If a person testifies or produces a document or
3237 other evidence as required under Subsection (c) while claiming that
3338 the testimony or evidence [document] may incriminate the person
3439 [him], the testimony or evidence that the person was compelled to
3540 produce, or any information directly or indirectly derived from
3641 that testimony or evidence, may not be used against the person in
3742 any criminal prosecution, other than a prosecution for any offense
3843 involving perjury, making a false statement, or providing false
3944 information [person may not be indicted or prosecuted for any
4045 transaction, matter, or thing about which the person truthfully
4146 testified or produced evidence].
4247 (e) [(d)] A witness has a right to counsel when testifying
4348 before either house of the legislature or a legislative committee.
4449 SECTION 2. This Act takes effect immediately if it receives
4550 a vote of two-thirds of all the members elected to each house, as
4651 provided by Section 39, Article III, Texas Constitution. If this
4752 Act does not receive the vote necessary for immediate effect, this
4853 Act takes effect September 1, 2025.
