| 9 | 9 | | relating to enhancing the criminal penalties for burglary of a |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 30.02, Penal Code, is amended by |
|---|
| 13 | 13 | | amending Subsections (c) and (c-2) and adding Subsection (e) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (c) Except as provided in Subsection (c-1), (c-2), [or] (d), |
|---|
| 16 | 16 | | or (e), an offense under this section is a: |
|---|
| 17 | 17 | | (1) state jail felony if committed in a building other |
|---|
| 18 | 18 | | than a habitation or a place of worship; or |
|---|
| 19 | 19 | | (2) felony of the second degree if committed in a |
|---|
| 20 | 20 | | habitation or a place of worship. |
|---|
| 21 | 21 | | (c-2) An offense under this section is a felony of the third |
|---|
| 22 | 22 | | degree if: |
|---|
| 23 | 23 | | (1) the premises are a building other than a |
|---|
| 24 | 24 | | habitation or a place of worship; and |
|---|
| 25 | 25 | | (2) it is shown on the trial of the offense that the |
|---|
| 26 | 26 | | actor committed the offense in the course of committing an offense |
|---|
| 27 | 27 | | under Section 20.05(a)(2). |
|---|
| 28 | 28 | | (e) An offense under this section is a felony of the first |
|---|
| 29 | 29 | | degree if: |
|---|
| 30 | 30 | | (1) the premises are a place of worship; and |
|---|
| 31 | 31 | | (2) any party to the offense entered the place of |
|---|
| 32 | 32 | | worship with intent to commit a felony other than felony theft or |
|---|
| 33 | 33 | | committed or attempted to commit a felony other than felony theft. |
|---|
| 34 | 34 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 35 | 35 | | to an offense committed on or after the effective date of this Act. |
|---|
| 36 | 36 | | An offense committed before the effective date of this Act is |
|---|
| 37 | 37 | | governed by the law in effect on the date the offense was committed, |
|---|
| 38 | 38 | | and the former law is continued in effect for that purpose. For |
|---|
| 39 | 39 | | purposes of this section, an offense was committed before the |
|---|
| 40 | 40 | | effective date of this Act if any element of the offense occurred |
|---|
| 41 | 41 | | before that date. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2025. |
