77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a municipality or a property owners'
1010 association to regulate the raising or keeping of chickens.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 229, Local Government
1313 Code, is amended by adding Section 229.902 to read as follows:
1414 Sec. 229.902. SIX CHICKENS ALLOWED ON SINGLE-FAMILY
1515 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
1616 provided by Subsection (b), a municipality may not adopt or enforce
1717 an ordinance that prohibits the raising or keeping of six or fewer
1818 chickens on a single-family residential lot.
1919 (b) A municipality may impose reasonable regulations on the
2020 raising or keeping of poultry on a single-family residential lot
2121 that do not have the effect of prohibiting the raising or keeping of
2222 six or fewer chickens, including:
2323 (1) a limit on the number of chickens that may be
2424 raised or kept in excess of six;
2525 (2) a prohibition on breeding poultry;
2626 (3) a prohibition on raising or keeping roosters; or
2727 (4) the minimum distance between a chicken coop and a
2828 residential structure.
2929 (c) An ordinance adopted by a municipality that violates
3030 Subsection (a) is void.
3131 SECTION 2. Chapter 202, Property Code, is amended by adding
3232 Section 202.025 to read as follows:
3333 Sec. 202.025. SIX CHICKENS ALLOWED ON SINGLE-FAMILY
3434 RESIDENTIAL LOT. (a) Notwithstanding Section 202.002(a), this
3535 section applies only to a restrictive covenant created on or after
3636 September 1, 2025.
3737 (b) Notwithstanding any other law and except as provided by
3838 Subsection (c), a property owners' association may not adopt or
3939 enforce a restrictive covenant that prohibits the raising or
4040 keeping of six or fewer chickens on a single-family residential
4141 lot.
4242 (c) A property owners' association may adopt and enforce a
4343 restrictive covenant imposing reasonable requirements on the
4444 raising or keeping of poultry on a single-family residential lot
4545 that do not have the effect of prohibiting the raising or keeping of
4646 six or fewer chickens, including:
4747 (1) a limit on the number of chickens that may be
4848 raised or kept in excess of six;
4949 (2) a prohibition on breeding poultry;
5050 (3) a prohibition on raising or keeping roosters; or
5151 (4) the minimum distance between a chicken coop and
5252 another lot.
5353 (d) A provision that violates Subsection (b) is void.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2025.
