| 10 | 10 | | association to regulate the raising or keeping of chickens. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 229, Local Government |
|---|
| 13 | 13 | | Code, is amended by adding Section 229.902 to read as follows: |
|---|
| 14 | 14 | | Sec. 229.902. SIX CHICKENS ALLOWED ON SINGLE-FAMILY |
|---|
| 15 | 15 | | RESIDENTIAL LOT. (a) Notwithstanding any other law and except as |
|---|
| 16 | 16 | | provided by Subsection (b), a municipality may not adopt or enforce |
|---|
| 17 | 17 | | an ordinance that prohibits the raising or keeping of six or fewer |
|---|
| 18 | 18 | | chickens on a single-family residential lot. |
|---|
| 19 | 19 | | (b) A municipality may impose reasonable regulations on the |
|---|
| 20 | 20 | | raising or keeping of poultry on a single-family residential lot |
|---|
| 21 | 21 | | that do not have the effect of prohibiting the raising or keeping of |
|---|
| 22 | 22 | | six or fewer chickens, including: |
|---|
| 23 | 23 | | (1) a limit on the number of chickens that may be |
|---|
| 24 | 24 | | raised or kept in excess of six; |
|---|
| 25 | 25 | | (2) a prohibition on breeding poultry; |
|---|
| 26 | 26 | | (3) a prohibition on raising or keeping roosters; or |
|---|
| 27 | 27 | | (4) the minimum distance between a chicken coop and a |
|---|
| 28 | 28 | | residential structure. |
|---|
| 29 | 29 | | (c) An ordinance adopted by a municipality that violates |
|---|
| 30 | 30 | | Subsection (a) is void. |
|---|
| 31 | 31 | | SECTION 2. Chapter 202, Property Code, is amended by adding |
|---|
| 32 | 32 | | Section 202.025 to read as follows: |
|---|
| 33 | 33 | | Sec. 202.025. SIX CHICKENS ALLOWED ON SINGLE-FAMILY |
|---|
| 34 | 34 | | RESIDENTIAL LOT. (a) Notwithstanding Section 202.002(a), this |
|---|
| 35 | 35 | | section applies only to a restrictive covenant created on or after |
|---|
| 36 | 36 | | September 1, 2025. |
|---|
| 37 | 37 | | (b) Notwithstanding any other law and except as provided by |
|---|
| 38 | 38 | | Subsection (c), a property owners' association may not adopt or |
|---|
| 39 | 39 | | enforce a restrictive covenant that prohibits the raising or |
|---|
| 40 | 40 | | keeping of six or fewer chickens on a single-family residential |
|---|
| 41 | 41 | | lot. |
|---|
| 42 | 42 | | (c) A property owners' association may adopt and enforce a |
|---|
| 43 | 43 | | restrictive covenant imposing reasonable requirements on the |
|---|
| 44 | 44 | | raising or keeping of poultry on a single-family residential lot |
|---|
| 45 | 45 | | that do not have the effect of prohibiting the raising or keeping of |
|---|
| 46 | 46 | | six or fewer chickens, including: |
|---|
| 47 | 47 | | (1) a limit on the number of chickens that may be |
|---|
| 48 | 48 | | raised or kept in excess of six; |
|---|
| 49 | 49 | | (2) a prohibition on breeding poultry; |
|---|
| 50 | 50 | | (3) a prohibition on raising or keeping roosters; or |
|---|
| 51 | 51 | | (4) the minimum distance between a chicken coop and |
|---|
| 52 | 52 | | another lot. |
|---|
| 53 | 53 | | (d) A provision that violates Subsection (b) is void. |
|---|
| 54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2025. |
|---|
