77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the required approval of certain hospital visits as a
1010 condition of release on parole or to mandatory supervision for
1111 certain releasees and to the hospital's liability for damages
1212 resulting from those visits.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. This Act may be cited as the Pokuaa-Flowers Act.
1515 SECTION 2. Subchapter F, Chapter 508, Government Code, is
1616 amended by adding Section 508.193 to read as follows:
1717 Sec. 508.193. REQUIRED APPROVAL OF CERTAIN HOSPITAL VISITS.
1818 (a) A parole panel that requires a releasee serving a sentence for
1919 an offense listed in Article 42A.054(a), Code of Criminal
2020 Procedure, or for which the judgment contains an affirmative
2121 finding under Article 42A.054(c) or (d), Code of Criminal
2222 Procedure, to submit to electronic monitoring as a condition of
2323 release on parole or to mandatory supervision shall, as an
2424 additional condition of release, prohibit the releasee from
2525 visiting a general hospital, as defined by Section 241.003, Health
2626 and Safety Code, for a purpose other than to receive medical
2727 treatment, as defined by Section 313.002, Health and Safety Code,
2828 including emergency medical care, unless the parole officer
2929 supervising the releasee approves the releasee's request to visit
3030 the hospital prior to the visit.
3131 (b) A releasee's request to visit a general hospital must
3232 specify the date and time of the intended visit and the reason for
3333 the visit.
3434 (c) A parole officer who approves a visit under Subsection
3535 (a) shall promptly notify the chief law enforcement officer for the
3636 general hospital, or a local law enforcement agency if the general
3737 hospital does not employ any peace officers, of the date and time of
3838 the releasee's intended visit.
3939 (d) Notwithstanding any other law, a general hospital is not
4040 liable to a patient or another person for damages resulting from a
4141 visit by a releasee described by Subsection (a).
4242 SECTION 3. Section 508.193, Government Code, as added by
4343 this Act, applies only to a person who is released on parole or to
4444 mandatory supervision on or after the effective date of this Act. A
4545 person who is released on parole or to mandatory supervision before
4646 the effective date of this Act is governed by the law in effect at
4747 the time of release, and the former law is continued in effect for
4848 that purpose.
4949 SECTION 4. This Act takes effect September 1, 2025.
