| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subchapter C, Chapter 33, Utilities Code, is | |
| 14 | 14 | amended by adding Section 33.0535 to read as follows: | |
| 15 | 15 | Sec. 33.0535. NOTICE OF APPEAL BY TRANSMISSION AND | |
| 16 | 16 | DISTRIBUTION UTILITY. On receiving a petition under Section 33.053 | |
| 17 | 17 | filed by a transmission and distribution utility, the commission | |
| 18 | 18 | shall provide notice of the appeal to: | |
| 19 | 19 | (1) each member of the legislature whose district | |
| 20 | 20 | includes territory in the municipality that is the subject of the | |
| 21 | 21 | appeal; and | |
| 22 | 22 | (2) the governing bodies of the municipality that is | |
| 23 | 23 | the subject of the appeal and the county in which that municipality | |
| 24 | 24 | is located. | |
| 25 | 25 | SECTION 2. The change in law made by this Act applies only | |
| 26 | 26 | to an appeal of a rate proceeding that is filed on or after the | |
| 27 | 27 | effective date of this Act. An appeal of a rate proceeding that is | |
| 28 | 28 | filed before the effective date of this Act is governed by the law | |
| 29 | 29 | in effect immediately before the effective date of this Act, and | |
| 30 | 30 | that law is continued in effect for that purpose. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
