77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to notice provided to certain state and local officials
1010 regarding an appeal of a municipal order filed by a transmission and
1111 distribution utility in a ratemaking proceeding.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 33, Utilities Code, is
1414 amended by adding Section 33.0535 to read as follows:
1515 Sec. 33.0535. NOTICE OF APPEAL BY TRANSMISSION AND
1616 DISTRIBUTION UTILITY. On receiving a petition under Section 33.053
1717 filed by a transmission and distribution utility, the commission
1818 shall provide notice of the appeal to:
1919 (1) each member of the legislature whose district
2020 includes territory in the municipality that is the subject of the
2121 appeal; and
2222 (2) the governing bodies of the municipality that is
2323 the subject of the appeal and the county in which that municipality
2424 is located.
2525 SECTION 2. The change in law made by this Act applies only
2626 to an appeal of a rate proceeding that is filed on or after the
2727 effective date of this Act. An appeal of a rate proceeding that is
2828 filed before the effective date of this Act is governed by the law
2929 in effect immediately before the effective date of this Act, and
3030 that law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2025.
