108 AN ACT
119 relating to accepting an early voting ballot voted by mail;
1210 creating a criminal offense.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Subchapter C, Chapter 87, Election Code, is
1513 amended by adding Section 87.0412 to read as follows:
1614 Sec. 87.0412. SUSPENSION OF ACCEPTING VOTER REQUIREMENTS
1715 PROHIBITED. (a) A county clerk, elections administrator, early
1816 voting clerk, or early voting ballot board may not suspend the
1917 requirements under Section 87.041(b).
2018 (b) A county clerk, elections administrator, or early
2119 voting clerk who violates this section commits an offense. An
2220 offense under this section is a Class A misdemeanor.
2321 SECTION 2. The change in law made by this Act applies only
2422 to an offense committed on or after the effective date of this Act.
2523 An offense committed before the effective date of this Act is
2624 governed by the law in effect on the date the offense was committed,
2725 and the former law is continued in effect for that purpose. For
2826 purposes of this section, an offense was committed before the
2927 effective date of this Act if any element of the offense occurred
3028 before that date.
3129 SECTION 3. This Act takes effect September 1, 2025.
