77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to required reporting of certain discretionary
1010 prosecutorial decisions of prosecuting attorneys.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 41, Government Code, is
1313 amended by adding Section 41.0065 to read as follows:
1414 Sec. 41.0065. REPORT TO ATTORNEY GENERAL REGARDING REFUSAL
1515 TO PROSECUTE. (a) In this section:
1616 (1) "Peace officer" means an individual described by
1717 Article 2A.001, Code of Criminal Procedure.
1818 (2) "Prosecuting attorney" has the meaning assigned by
1919 Section 41.101.
2020 (b) If, after being presented with an affidavit sworn to by
2121 a peace officer alleging that probable cause exists to believe a
2222 person committed a criminal offense under Title 5 or 6, Penal Code,
2323 or under Chapter 29, Penal Code, a prosecuting attorney refuses to
2424 prosecute the alleged criminal offense, the prosecuting attorney
2525 must submit a report to the attorney general that includes:
2626 (1) any information the prosecuting attorney has
2727 regarding the alleged criminal offense;
2828 (2) a detailed explanation of the prosecuting
2929 attorney's decision not to prosecute the alleged offense, including
3030 any perceived evidentiary deficiencies in the case; and
3131 (3) the alleged offender's criminal history.
3232 (c) Subject to Subsection (d), at least once a month the
3333 office of the attorney general shall post on the office's publicly
3434 accessible Internet website information regarding each prosecuting
3535 attorney's decision not to prosecute an offense described by
3636 Subsection (b). The post must include:
3737 (1) the county in which the alleged offense occurred;
3838 and
3939 (2) the type of offense alleged to have been
4040 committed.
4141 (d) Information included on the attorney general's Internet
4242 website under Subsection (c) may not include any personally
4343 identifying information of an alleged offender or victim.
4444 SECTION 2. This Act takes effect September 1, 2025.
