77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the discontinuation, reduction, or impairment of water
1010 service during drought conditions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 13.250(b) and (d), Water Code, are
1313 amended to read as follows:
1414 (b) Unless the utility commission issues a certificate that
1515 neither the present nor future convenience and necessity will be
1616 adversely affected, the holder of a certificate or a person who
1717 possesses facilities used to provide utility service shall not
1818 discontinue, reduce, or impair service to a certified service area
1919 or part of a certified service area except [for]:
2020 (1) for nonpayment of charges for services provided by
2121 the certificate holder or a person who possesses facilities used to
2222 provide utility service;
2323 (2) for nonpayment of charges for sewer service
2424 provided by another retail public utility under an agreement
2525 between the retail public utility and the certificate holder or a
2626 person who possesses facilities used to provide utility service or
2727 under a utility commission-ordered arrangement between the two
2828 service providers;
2929 (3) for nonuse; [or]
3030 (4) as necessary to maintain adequate water supplies
3131 during drought conditions; or
3232 (5) for other similar reasons in the usual course of
3333 business.
3434 (d) Except as provided by this subsection, a retail public
3535 utility that has not been granted a certificate of public
3636 convenience and necessity may not discontinue, reduce, or impair
3737 retail water or sewer service to any ratepayer without approval of
3838 the regulatory authority. Except as provided by this subsection, a
3939 utility or water supply corporation that is allowed to operate
4040 without a certificate of public convenience and necessity under
4141 Section 13.242(c) may not discontinue, reduce, or impair retail
4242 water or sewer service to any ratepayer without the approval of the
4343 regulatory authority. Subject to rules of the regulatory
4444 authority, a retail public utility, utility, or water supply
4545 corporation described in this subsection may discontinue, reduce,
4646 or impair retail water or sewer service [for]:
4747 (1) for nonpayment of charges;
4848 (2) for nonuse; [or]
4949 (3) as necessary to maintain adequate water supplies
5050 during drought conditions; or
5151 (4) for other similar reasons in the usual course of
5252 business.
5353 SECTION 2. This Act takes effect September 1, 2025.
