10 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 14 | | SECTION 1. Section 501.052, Transportation Code, is amended |
---|
12 | 15 | | by amending Subsections (a) and (f) and adding Subsection (g) to |
---|
13 | 16 | | read as follows: |
---|
14 | 17 | | (a) Except as provided by Subsection (f), an [An] |
---|
15 | 18 | | interested person aggrieved by a refusal, rescission, |
---|
16 | 19 | | cancellation, suspension, or revocation under Section 501.051 may |
---|
17 | 20 | | apply for a hearing to the county assessor-collector for the county |
---|
18 | 21 | | in which the person is a resident. On the day an assessor-collector |
---|
19 | 22 | | receives the application, the assessor-collector shall notify the |
---|
20 | 23 | | department of the date of the hearing. |
---|
21 | 24 | | (f) A person may not apply for a hearing under this section |
---|
22 | 25 | | if the department's decision under Section 501.051 is related to: |
---|
23 | 26 | | (1) a title for a salvage motor vehicle or a |
---|
24 | 27 | | nonrepairable motor vehicle, as defined by Section 501.091; or |
---|
25 | 28 | | (2) a title for a vehicle: |
---|
26 | 29 | | (A) that is the subject of any pending litigation |
---|
27 | 30 | | or court proceedings; |
---|
28 | 31 | | (B) for which a court has awarded ownership or |
---|
29 | 32 | | possession to another person; or |
---|
30 | 33 | | (C) that is held as evidence in a criminal |
---|
31 | 34 | | investigation. |
---|
32 | 35 | | (g) A county assessor-collector who receives an application |
---|
33 | 36 | | for a hearing submitted in violation of Subsection (f): |
---|
34 | 37 | | (1) shall deny the application; and |
---|
35 | 38 | | (2) is not required to send notice under Subsection |
---|
36 | 39 | | (a) or hold a hearing under Subsection (b). |
---|
37 | 40 | | SECTION 2. This Act takes effect September 1, 2025. |
