69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to a hearing on the refusal to issue or the revocation or
912 suspension of a vehicle title.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 501.052, Transportation Code, is amended
1215 by amending Subsections (a) and (f) and adding Subsection (g) to
1316 read as follows:
1417 (a) Except as provided by Subsection (f), an [An]
1518 interested person aggrieved by a refusal, rescission,
1619 cancellation, suspension, or revocation under Section 501.051 may
1720 apply for a hearing to the county assessor-collector for the county
1821 in which the person is a resident. On the day an assessor-collector
1922 receives the application, the assessor-collector shall notify the
2023 department of the date of the hearing.
2124 (f) A person may not apply for a hearing under this section
2225 if the department's decision under Section 501.051 is related to:
2326 (1) a title for a salvage motor vehicle or a
2427 nonrepairable motor vehicle, as defined by Section 501.091; or
2528 (2) a title for a vehicle:
2629 (A) that is the subject of any pending litigation
2730 or court proceedings;
2831 (B) for which a court has awarded ownership or
2932 possession to another person; or
3033 (C) that is held as evidence in a criminal
3134 investigation.
3235 (g) A county assessor-collector who receives an application
3336 for a hearing submitted in violation of Subsection (f):
3437 (1) shall deny the application; and
3538 (2) is not required to send notice under Subsection
3639 (a) or hold a hearing under Subsection (b).
3740 SECTION 2. This Act takes effect September 1, 2025.
