77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to death records maintained by the vital statistics unit
1010 of the Department of State Health Services and provided to certain
1111 hospitals.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1414 Code, is amended by adding Section 191.012 to read as follows:
1515 Sec. 191.012. DEATH INFORMATION PROVIDED TO CERTAIN
1616 HOSPITALS. (a) The department shall implement an efficient and
1717 effective procedure to provide death information to a hospital
1818 licensed under Chapter 241 to assist with the hospital's
1919 participation in the Medicaid managed care program operated under
2020 Chapter 540, Government Code.
2121 (b) The procedure implemented under Subsection (a) at a
2222 minimum must provide the following information for each deceased
2323 person for whom a death certificate is filed with a local registrar
2424 in this state:
2525 (1) the county of residence of the deceased;
2626 (2) the date of birth of the deceased; and
2727 (3) the full name of the deceased.
2828 SECTION 2. If before implementing any provision of this Act
2929 a state agency determines a waiver or authorization from a federal
3030 agency is necessary for implementation of that provision, the
3131 agency affected by the provision shall request the waiver or
3232 authorization and may delay implementing that provision until the
3333 waiver or authorization is granted.
3434 SECTION 3. This Act takes effect September 1, 2025.
