12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter A, Chapter 191, Health and Safety |
---|
14 | 14 | | Code, is amended by adding Section 191.012 to read as follows: |

15 | 15 | | Sec. 191.012. DEATH INFORMATION PROVIDED TO CERTAIN |
---|
16 | 16 | | HOSPITALS. (a) The department shall implement an efficient and |
---|
17 | 17 | | effective procedure to provide death information to a hospital |
---|
18 | 18 | | licensed under Chapter 241 to assist with the hospital's |
---|
19 | 19 | | participation in the Medicaid managed care program operated under |
---|
20 | 20 | | Chapter 540, Government Code. |
---|
21 | 21 | | (b) The procedure implemented under Subsection (a) at a |
---|
22 | 22 | | minimum must provide the following information for each deceased |
---|
23 | 23 | | person for whom a death certificate is filed with a local registrar |
---|
24 | 24 | | in this state: |
---|
25 | 25 | | (1) the county of residence of the deceased; |
---|
26 | 26 | | (2) the date of birth of the deceased; and |
---|
27 | 27 | | (3) the full name of the deceased. |
---|
28 | 28 | | SECTION 2. If before implementing any provision of this Act |
---|
29 | 29 | | a state agency determines a waiver or authorization from a federal |
---|
30 | 30 | | agency is necessary for implementation of that provision, the |
---|
31 | 31 | | agency affected by the provision shall request the waiver or |
---|
32 | 32 | | authorization and may delay implementing that provision until the |
---|
33 | 33 | | waiver or authorization is granted. |
---|
34 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
