89R5306 JDK-F By: Hall S.B. No. 1475 A BILL TO BE ENTITLED AN ACT relating to annual continuing education requirements for county election officers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Section 31.127, Election Code, is amended to read as follows: Sec. 31.127. TRAINING AND CONTINUING EDUCATION. SECTION 2. Section 31.127, Election Code, is amended by adding Subsections (c), (d), and (e) to read as follows: (c) A county election officer shall complete 10 hours of instruction on the performance of the election officer's duties before the first anniversary of the date the county election officer assumes those duties. (d) After the first anniversary of the date a county election officer assumes the duties of office, the county election officer must complete 10 hours of continuing education courses each calendar year. (e) If a county election officer completes continuing education courses in an amount that exceeds the number of hours required under Subsection (d), the county election officer may carry over not more than five hours of excess completed continuing education courses from one calendar year to the following calendar year. SECTION 3. Section 51.605, Government Code, is amended by adding Subsection (f) to read as follows: (f) As part of the 20 hours of initial instruction and of continuing education courses prescribed under this section, a county clerk may complete not more than 10 hours of instruction required under Section 31.127, Election Code, on the duties of an election officer. SECTION 4. Section 6.231, Tax Code, is amended by adding Subsection (b-1) to read as follows: (b-1) As part of the 20 hours of annual continuing education prescribed under this section, a county assessor-collector may complete not more than 10 hours of instruction required under Section 31.127, Election Code, on the duties of an election officer. SECTION 5. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
