77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to transporting an unsecured load; creating a criminal
1010 offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 725, Transportation Code,
1313 is amended to read as follows:
1414 CHAPTER 725. TRANSPORTATION OF UNSECURED LOAD [LOOSE MATERIALS]
1515 SECTION 2. Section 725.001(1), Transportation Code, is
1616 amended to read as follows:
1717 (1) "Load" means any object placed on a vehicle for
1818 transportation [a load of loose material].
1919 SECTION 3. Section 725.002, Transportation Code, is amended
2020 to read as follows:
2121 Sec. 725.002. APPLICABILITY. (a) Except as provided by
2222 this section, this [This] chapter applies to any motor vehicle,
2323 trailer, or semitrailer operated on a public highway.
2424 (b) This chapter does not apply to:
2525 (1) [except] a vehicle or construction or mining
2626 equipment that is:
2727 (A) [(1)] moving between construction barricades
2828 on a public works project; or
2929 (B) [(2)] crossing a public highway;
3030 (2) an agricultural product in its natural state that
3131 is loaded or contained on a vehicle manufactured specifically to
3232 transport the product; or
3333 (3) a commercial motor vehicle as defined by Section
3434 644.001 in intrastate or interstate commerce that is regulated by
3535 49 C.F.R. Sections 392.9 and 393.100-136, unless a peace officer
3636 not certified under Section 644.101:
3737 (A) witnesses the load is unsecured and poses an
3838 imminent hazard to other users of a highway; or
3939 (B) is conducting an investigation as the result
4040 of the load falling from a vehicle.
4141 SECTION 4. Section 725.003, Transportation Code, is amended
4242 by amending Subsection (a) and adding Subsection (b-1) to read as
4343 follows:
4444 (a) A person or the person's agent or employee may not
4545 transport a load [loose material] in violation of this chapter.
4646 (b-1) A person commits an offense if the person operates a
4747 vehicle and a load:
4848 (1) falls from the vehicle onto the roadway; or
4949 (2) is positioned on the vehicle in a manner to create
5050 an imminent hazard while the vehicle is in operation on a public
5151 street or highway.
5252 SECTION 5. The heading to Subchapter B, Chapter 725,
5353 Transportation Code, is amended to read as follows:
5454 SUBCHAPTER B. REQUIREMENTS FOR TRANSPORTING LOAD [LOOSE MATERIALS]
5555 SECTION 6. Subchapter B, Chapter 725, Transportation Code,
5656 is amended by adding Section 725.0201 to read as follows:
5757 Sec. 725.0201. CONTAINING LOAD GENERALLY. A vehicle
5858 subject to this chapter shall be operated to prevent a load from
5959 becoming loose, detached, or in any manner a hazard to other users
6060 of a public street or highway.
6161 SECTION 7. Sections 725.021(b) and (c), Transportation
6262 Code, are amended to read as follows:
6363 (b) A vehicle bed carrying a load of loose material:
6464 (1) may not have a hole, crack, or other opening
6565 through which loose material can escape; and
6666 (2) shall be enclosed:
6767 (A) on both sides by side panels;
6868 (B) on the front by a panel or the vehicle cab;
6969 and
7070 (C) on the rear by a tailgate or panel.
7171 (c) Except as provided by Subsection (e), the load of loose
7272 material shall be covered and the covering firmly secured at the
7373 front and back, unless the load:
7474 (1) is completely enclosed by the load-carrying
7575 compartment; or
7676 (2) does not blow from or spill over the top of the
7777 load-carrying compartment.
7878 SECTION 8. This Act takes effect July 1, 2025, if it
7979 receives a vote of two-thirds of all the members elected to each
8080 house, as provided by Section 39, Article III, Texas Constitution.
8181 If this Act does not receive the vote necessary to take effect on
8282 that date, this Act takes effect September 1, 2025.
