---|
18 | 14 | | 88th Legislature, Regular Session, 2023, is amended to read as |

21 | 17 | | SECTION 2. Chapter 2311, Occupations Code, as added by |

23 | 19 | | Session, 2023, is amended by adding Subchapter B-1 to read as |

25 | 21 | | SUBCHAPTER B-1. ELECTRIC VEHICLE SUPPLY EQUIPMENT ADVISORY BOARD |
---|
26 | 22 | | Sec. 2311.0251. DEFINITIONS. In this subchapter: |
---|
27 | 23 | | (1) "Advisory board" means the Electric Vehicle Supply |
---|
28 | 24 | | Equipment Advisory Board. |
---|
29 | 25 | | (2) "Executive director" means the executive director |
---|
30 | 26 | | of the department. |
---|
31 | 27 | | Sec. 2311.0252. ADVISORY BOARD MEMBERSHIP. (a) The |
---|
32 | 28 | | advisory board consists of nine voting members appointed by the |
---|
33 | 29 | | presiding officer of the commission, with the commission's |
---|
34 | 30 | | approval, as follows: |
---|
35 | 31 | | (1) three members who represent electric vehicle |
---|
36 | 32 | | supply equipment companies; |
---|
37 | 33 | | (2) two members who install or service electric |
---|
38 | 34 | | vehicle supply equipment; |
---|
39 | 35 | | (3) two members who represent the motor fuel retail |
---|
40 | 36 | | industry; |
---|
41 | 37 | | (4) one member who represents a public utility |
---|
42 | 38 | | company; and |
---|
43 | 39 | | (5) one member of the public. |
---|
44 | 40 | | (b) The presiding officer of the commission, with the |
---|
45 | 41 | | approval of the commission, shall appoint two ex officio nonvoting |
---|
46 | 42 | | members of the board. An ex officio member is not counted as a |
---|
47 | 43 | | member for purposes of establishing a quorum. Members appointed |
---|
48 | 44 | | under this subsection must include: |
---|
49 | 45 | | (1) one member who represents the Texas Department of |
---|
50 | 46 | | Transportation; and |
---|
51 | 47 | | (2) one member who represents the Texas Commission on |
---|
52 | 48 | | Fire Protection. |
---|
53 | 49 | | (c) Appointments to the advisory board shall be made without |
---|
54 | 50 | | regard to the race, color, disability, sex, religion, age, or |
---|
55 | 51 | | national origin of the appointees. |
---|
56 | 52 | | Sec. 2311.0253. TERMS; VACANCIES. (a) Advisory board |
---|
57 | 53 | | members serve six-year terms. |
---|
58 | 54 | | (b) If a vacancy occurs during a member's term, the |
---|
59 | 55 | | presiding officer of the commission, with the commission's |
---|
60 | 56 | | approval, shall appoint a replacement to fill the unexpired term. |
---|
61 | 57 | | Sec. 2311.0254. PRESIDING OFFICER. The presiding officer |
---|
62 | 58 | | of the commission, with the commission's approval, shall appoint |
---|
63 | 59 | | one advisory board member to serve as presiding officer of the board |
---|
64 | 60 | | for a term of two years. |
---|
65 | 61 | | Sec. 2311.0255. ADVISORY BOARD DUTIES. The advisory board |
---|
66 | 62 | | may advise the commission and department on: |
---|
67 | 63 | | (1) the adoption of appropriate standards for the |
---|
68 | 64 | | installation, maintenance, calibration, alteration, operation, |
---|
69 | 65 | | testing, or inspection, as applicable, of electric vehicle supply |
---|
70 | 66 | | equipment; and |
---|
71 | 67 | | (2) other issues affecting electric vehicle charging |
---|
72 | 68 | | stations. |
---|
73 | 69 | | Sec. 2311.0256. MEETINGS; QUORUM. (a) The advisory board |
---|
74 | 70 | | shall meet at the call of the executive director or the presiding |
---|
75 | 71 | | officer of the commission. |
---|
76 | 72 | | (b) A majority of the voting members of the advisory board |
---|
77 | 73 | | constitutes a quorum. |
---|
78 | 74 | | Sec. 2311.0257. EXPIRATION. The advisory board is |
---|
79 | 75 | | abolished and this subchapter expires December 1, 2030. |
---|
80 | 76 | | SECTION 3. Not later than December 1, 2025, the presiding |
---|
81 | 77 | | officer of the Texas Commission of Licensing and Regulation shall |
---|
82 | 78 | | appoint members to the Electric Vehicle Supply Equipment Advisory |
---|
83 | 79 | | Board in accordance with Section 2311.0252, Occupations Code, as |
---|
84 | 80 | | added by this Act. |
---|
85 | 81 | | SECTION 4. This Act takes effect immediately if it receives |
---|
86 | 82 | | a vote of two-thirds of all the members elected to each house, as |
---|
87 | 83 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
88 | 84 | | Act does not receive the vote necessary for immediate effect, this |
---|
89 | 85 | | Act takes effect September 1, 2025. |
---|
