139 relating to the establishment of an Electric Vehicle Supply
1410 Equipment Advisory Board.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. The heading to Subchapter B, Chapter 2311,
1713 Occupations Code, as added by Chapter 1153 (S.B. 1001), Acts of the
1814 88th Legislature, Regular Session, 2023, is amended to read as
1915 follows:

2117 SECTION 2. Chapter 2311, Occupations Code, as added by
2218 Chapter 1153 (S.B. 1001), Acts of the 88th Legislature, Regular
2319 Session, 2023, is amended by adding Subchapter B-1 to read as
2420 follows:
2521 SUBCHAPTER B-1. ELECTRIC VEHICLE SUPPLY EQUIPMENT ADVISORY BOARD
2622 Sec. 2311.0251. DEFINITIONS. In this subchapter:
2723 (1) "Advisory board" means the Electric Vehicle Supply
2824 Equipment Advisory Board.
2925 (2) "Executive director" means the executive director
3026 of the department.
3127 Sec. 2311.0252. ADVISORY BOARD MEMBERSHIP. (a) The
3228 advisory board consists of nine voting members appointed by the
3329 presiding officer of the commission, with the commission's
3430 approval, as follows:
3531 (1) three members who represent electric vehicle
3632 supply equipment companies;
3733 (2) two members who install or service electric
3834 vehicle supply equipment;
3935 (3) two members who represent the motor fuel retail
4036 industry;
4137 (4) one member who represents a public utility
4238 company; and
4339 (5) one member of the public.
4440 (b) The presiding officer of the commission, with the
4541 approval of the commission, shall appoint two ex officio nonvoting
4642 members of the board. An ex officio member is not counted as a
4743 member for purposes of establishing a quorum. Members appointed
4844 under this subsection must include:
4945 (1) one member who represents the Texas Department of
5046 Transportation; and
5147 (2) one member who represents the Texas Commission on
5248 Fire Protection.
5349 (c) Appointments to the advisory board shall be made without
5450 regard to the race, color, disability, sex, religion, age, or
5551 national origin of the appointees.
5652 Sec. 2311.0253. TERMS; VACANCIES. (a) Advisory board
5753 members serve six-year terms.
5854 (b) If a vacancy occurs during a member's term, the
5955 presiding officer of the commission, with the commission's
6056 approval, shall appoint a replacement to fill the unexpired term.
6157 Sec. 2311.0254. PRESIDING OFFICER. The presiding officer
6258 of the commission, with the commission's approval, shall appoint
6359 one advisory board member to serve as presiding officer of the board
6460 for a term of two years.
6561 Sec. 2311.0255. ADVISORY BOARD DUTIES. The advisory board
6662 may advise the commission and department on:
6763 (1) the adoption of appropriate standards for the
6864 installation, maintenance, calibration, alteration, operation,
6965 testing, or inspection, as applicable, of electric vehicle supply
7066 equipment; and
7167 (2) other issues affecting electric vehicle charging
7268 stations.
7369 Sec. 2311.0256. MEETINGS; QUORUM. (a) The advisory board
7470 shall meet at the call of the executive director or the presiding
7571 officer of the commission.
7672 (b) A majority of the voting members of the advisory board
7773 constitutes a quorum.
7874 Sec. 2311.0257. EXPIRATION. The advisory board is
7975 abolished and this subchapter expires December 1, 2030.
8076 SECTION 3. Not later than December 1, 2025, the presiding
8177 officer of the Texas Commission of Licensing and Regulation shall
8278 appoint members to the Electric Vehicle Supply Equipment Advisory
8379 Board in accordance with Section 2311.0252, Occupations Code, as
8480 added by this Act.
8581 SECTION 4. This Act takes effect immediately if it receives
8682 a vote of two-thirds of all the members elected to each house, as
8783 provided by Section 39, Article III, Texas Constitution. If this
8884 Act does not receive the vote necessary for immediate effect, this
8985 Act takes effect September 1, 2025.
