10 | 17 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 18 | SECTION 1. Article 18.0215(a), Code of Criminal Procedure, | |
12 | 19 | is amended to read as follows: | |
13 | 20 | (a) A peace officer may not search a person's cellular | |
14 | 21 | telephone or other wireless communications device, pursuant to a | |
15 | 22 | lawful arrest of the person without obtaining a warrant under this | |
16 | 23 | article. A wireless communications device does not include a | |
17 | 24 | skimmer as defined by Section 607.001, Business & Commerce Code, or | |
18 | 25 | a device manufactured for the purpose of illicitly obtaining | |
19 | 26 | payment card information or identifying information. | |
20 | 27 | SECTION 2. This Act takes effect September 1, 2025. | |
