613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the search of certain wireless communications devices
916 by a peace officer.
1017 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1118 SECTION 1. Article 18.0215(a), Code of Criminal Procedure,
1219 is amended to read as follows:
1320 (a) A peace officer may not search a person's cellular
1421 telephone or other wireless communications device, pursuant to a
1522 lawful arrest of the person without obtaining a warrant under this
1623 article. A wireless communications device does not include a
1724 skimmer as defined by Section 607.001, Business & Commerce Code, or
1825 a device manufactured for the purpose of illicitly obtaining
1926 payment card information or identifying information.
2027 SECTION 2. This Act takes effect September 1, 2025.
