611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the frequency with which the Board of Pardons and
914 Paroles reconsiders inmates for release on parole.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Sections 508.141(g) and (g-1), Government Code,
1217 are amended to read as follows:
1318 (g) The board shall adopt a policy establishing the date on
1419 which the board may reconsider for release an inmate who has
1520 previously been denied release. The policy must require the board
1621 to reconsider the inmate for release[:
1722 [(1) an inmate serving a sentence for an offense
1823 listed in Section 508.149(a) or for an offense punishable as a
1924 felony of the second or third degree under Section 22.04, Penal
2025 Code,] during a month designated under Subsection (g-1) by the
2126 parole panel that denied release[; and
2227 [(2) an inmate other than an inmate described by
2328 Subdivision (1) as soon as practicable after the first anniversary
2429 of the date of the denial].
2530 (g-1) The month designated for reconsideration [under
2631 Subsection (g)(1) by the parole panel that denied release] must:
2732 (1) except as provided by Subdivision (2), begin after
2833 the first anniversary of the date of the denial and end before the
2934 fifth anniversary of the date of the denial; or
3035 (2) if[, unless] the inmate is serving a sentence for
3136 an offense under Section 22.021, Penal Code, or a life sentence for
3237 a capital felony, [in which event the designated month must] begin
3338 after the first anniversary of the date of the denial and end before
3439 the 10th anniversary of the date of the denial.
3540 SECTION 2. (a) Section 508.141, Government Code, as
3641 amended by this Act, applies to any inmate who is confined in a
3742 facility operated by or under contract with the Texas Department of
3843 Criminal Justice on or after the effective date of this Act,
3944 regardless of whether the offense for which the inmate is confined
4045 occurred before, on, or after the effective date of this Act.
4146 (b) The Board of Pardons and Paroles shall adopt a policy
4247 consistent with Section 508.141, Government Code, as amended by
4348 this Act, as soon as practicable after the effective date of this
4449 Act.
4550 SECTION 3. This Act takes effect September 1, 2025.
