10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 16 | | SECTION 1. Sections 508.141(g) and (g-1), Government Code, |
---|
12 | 17 | | are amended to read as follows: |
---|
13 | 18 | | (g) The board shall adopt a policy establishing the date on |
---|
14 | 19 | | which the board may reconsider for release an inmate who has |
---|
15 | 20 | | previously been denied release. The policy must require the board |
---|
16 | 21 | | to reconsider the inmate for release[: |
---|
17 | 22 | | [(1) an inmate serving a sentence for an offense |
---|
18 | 23 | | listed in Section 508.149(a) or for an offense punishable as a |
---|
19 | 24 | | felony of the second or third degree under Section 22.04, Penal |
---|
20 | 25 | | Code,] during a month designated under Subsection (g-1) by the |
---|
21 | 26 | | parole panel that denied release[; and |
---|
22 | 27 | | [(2) an inmate other than an inmate described by |
---|
23 | 28 | | Subdivision (1) as soon as practicable after the first anniversary |
---|
24 | 29 | | of the date of the denial]. |
---|
25 | 30 | | (g-1) The month designated for reconsideration [under |
---|
26 | 31 | | Subsection (g)(1) by the parole panel that denied release] must: |
---|
27 | 32 | | (1) except as provided by Subdivision (2), begin after |
---|
28 | 33 | | the first anniversary of the date of the denial and end before the |
---|
29 | 34 | | fifth anniversary of the date of the denial; or |
---|
30 | 35 | | (2) if[, unless] the inmate is serving a sentence for |
---|
31 | 36 | | an offense under Section 22.021, Penal Code, or a life sentence for |
---|
32 | 37 | | a capital felony, [in which event the designated month must] begin |
---|
33 | 38 | | after the first anniversary of the date of the denial and end before |
---|
34 | 39 | | the 10th anniversary of the date of the denial. |
---|
35 | 40 | | SECTION 2. (a) Section 508.141, Government Code, as |
---|
36 | 41 | | amended by this Act, applies to any inmate who is confined in a |
---|
37 | 42 | | facility operated by or under contract with the Texas Department of |
---|
38 | 43 | | Criminal Justice on or after the effective date of this Act, |
---|
39 | 44 | | regardless of whether the offense for which the inmate is confined |
---|
40 | 45 | | occurred before, on, or after the effective date of this Act. |
---|
41 | 46 | | (b) The Board of Pardons and Paroles shall adopt a policy |
---|
42 | 47 | | consistent with Section 508.141, Government Code, as amended by |
---|
43 | 48 | | this Act, as soon as practicable after the effective date of this |
---|
44 | 49 | | Act. |
---|
45 | 50 | | SECTION 3. This Act takes effect September 1, 2025. |
