9 | 9 | | at certain health care facilities that provide mental health care |
---|
10 | 10 | | services. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
13 | 13 | | amended by adding Section 531.09915 to read as follows: |
---|
14 | 14 | | Sec. 531.09915. MATCHING GRANT PROGRAM FOR TECHNOLOGICAL |
---|
15 | 15 | | ENHANCEMENTS AT CERTAIN HEALTH CARE FACILITIES PROVIDING MENTAL |
---|
16 | 16 | | HEALTH CARE SERVICES. (a) In this section, "health care facility" |
---|
17 | 17 | | means: |
---|
18 | 18 | | (1) a hospital licensed under Chapter 241, Health and |
---|
19 | 19 | | Safety Code, that is located in a rural county; or |
---|
20 | 20 | | (2) a hospital licensed under Chapter 577, Health and |
---|
21 | 21 | | Safety Code. |
---|
22 | 22 | | (b) The commission shall establish a matching grant program |
---|
23 | 23 | | for the purpose of enhancing the technological capabilities of |
---|
24 | 24 | | health care facilities providing mental health care services in |
---|
25 | 25 | | this state. |
---|
26 | 26 | | (c) To be eligible for a grant under this section, a health |
---|
27 | 27 | | care facility must: |
---|
28 | 28 | | (1) demonstrate how the grant money and matching funds |
---|
29 | 29 | | will be used to improve the quality of and access to mental health |
---|
30 | 30 | | care services in this state; |
---|
31 | 31 | | (2) align with the interoperability and technology |
---|
32 | 32 | | standards in the 21st Century Cures Act (Pub. L. No. 114-255); and |
---|
33 | 33 | | (3) meet any other additional eligibility criteria |
---|
34 | 34 | | established by the commission. |
---|
35 | 35 | | (d) The commission shall condition each grant provided to a |
---|
36 | 36 | | health care facility under this section on the facility providing |
---|
37 | 37 | | funds from non-state sources in an amount equal to 25 percent of the |
---|
38 | 38 | | grant amount. |
---|
39 | 39 | | (e) To raise the required non-state sourced funds, the |
---|
40 | 40 | | health care facility may seek and receive gifts, grants, or |
---|
41 | 41 | | donations from any person. |
---|
42 | 42 | | (f) A health care facility awarded a grant under this |
---|
43 | 43 | | section may only use the grant money and matching funds to: |
---|
44 | 44 | | (1) purchase a recordkeeping platform that uses a |
---|
45 | 45 | | certified electronic health record; |
---|
46 | 46 | | (2) expand the interoperability of health information |
---|
47 | 47 | | in the health care facility or as part of a network with other |
---|
48 | 48 | | health care providers; |
---|
49 | 49 | | (3) expand a patient's access to the patient's digital |
---|
50 | 50 | | health records and mental health care services; |
---|
51 | 51 | | (4) improve information technology infrastructure |
---|
52 | 52 | | regarding the data privacy and security of patient information, |
---|
53 | 53 | | including consent management; and |
---|
54 | 54 | | (5) improve the efficiency of the provision of mental |
---|
55 | 55 | | health care services through the use and interconnectivity of |
---|
56 | 56 | | mobile devices. |
---|
57 | 57 | | (g) The commission may solicit and accept gifts, grants, and |
---|
58 | 58 | | donations from any source for the purposes of awarding grants under |
---|
59 | 59 | | this section. |
---|
60 | 60 | | (h) Not later than December 1 of each even-numbered year, |
---|
61 | 61 | | the commission shall submit a report to the legislature regarding |
---|
62 | 62 | | the results of the grant program administered under this section. |
---|
63 | 63 | | (i) The commission may adopt any rules necessary to |
---|
64 | 64 | | implement this section. |
---|
65 | 65 | | SECTION 2. This Act takes effect September 1, 2025. |
