77 AN ACT
88 relating to a matching grant program for technological enhancements
99 at certain health care facilities that provide mental health care
1010 services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1313 amended by adding Section 531.09915 to read as follows:
1414 Sec. 531.09915. MATCHING GRANT PROGRAM FOR TECHNOLOGICAL
1515 ENHANCEMENTS AT CERTAIN HEALTH CARE FACILITIES PROVIDING MENTAL
1616 HEALTH CARE SERVICES. (a) In this section, "health care facility"
1717 means:
1818 (1) a hospital licensed under Chapter 241, Health and
1919 Safety Code, that is located in a rural county; or
2020 (2) a hospital licensed under Chapter 577, Health and
2121 Safety Code.
2222 (b) The commission shall establish a matching grant program
2323 for the purpose of enhancing the technological capabilities of
2424 health care facilities providing mental health care services in
2525 this state.
2626 (c) To be eligible for a grant under this section, a health
2727 care facility must:
2828 (1) demonstrate how the grant money and matching funds
2929 will be used to improve the quality of and access to mental health
3030 care services in this state;
3131 (2) align with the interoperability and technology
3232 standards in the 21st Century Cures Act (Pub. L. No. 114-255); and
3333 (3) meet any other additional eligibility criteria
3434 established by the commission.
3535 (d) The commission shall condition each grant provided to a
3636 health care facility under this section on the facility providing
3737 funds from non-state sources in an amount equal to 25 percent of the
3838 grant amount.
3939 (e) To raise the required non-state sourced funds, the
4040 health care facility may seek and receive gifts, grants, or
4141 donations from any person.
4242 (f) A health care facility awarded a grant under this
4343 section may only use the grant money and matching funds to:
4444 (1) purchase a recordkeeping platform that uses a
4545 certified electronic health record;
4646 (2) expand the interoperability of health information
4747 in the health care facility or as part of a network with other
4848 health care providers;
4949 (3) expand a patient's access to the patient's digital
5050 health records and mental health care services;
5151 (4) improve information technology infrastructure
5252 regarding the data privacy and security of patient information,
5353 including consent management; and
5454 (5) improve the efficiency of the provision of mental
5555 health care services through the use and interconnectivity of
5656 mobile devices.
5757 (g) The commission may solicit and accept gifts, grants, and
5858 donations from any source for the purposes of awarding grants under
5959 this section.
6060 (h) Not later than December 1 of each even-numbered year,
6161 the commission shall submit a report to the legislature regarding
6262 the results of the grant program administered under this section.
6363 (i) The commission may adopt any rules necessary to
6464 implement this section.
6565 SECTION 2. This Act takes effect September 1, 2025.
