88 AN ACT
99 relating to a ketamine treatment grant program for ketamine clinics
1010 serving active duty military personnel, first responders, and
1111 veterans.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 547, Government Code, as effective April
1414 1, 2025, is amended by adding Subchapter K to read as follows:
1515 SUBCHAPTER K. KETAMINE TREATMENT GRANT PROGRAM
1616 Sec. 547.0501. DEFINITIONS. In this subchapter:
1717 (1) "First responder" has the meaning assigned by
1818 Section 421.095.
1919 (2) "Physician" means a person licensed to practice
2020 medicine in this state.
2121 (3) "Program" means the ketamine treatment grant
2222 program established under this subchapter.
2323 (4) "Veteran" means an individual who has served in:
2424 (A) an active or reserve component of the army,
2525 navy, air force, coast guard, or marine corps of the United States;
2626 or
2727 (B) the Texas National Guard, as defined by
2828 Section 431.001.
2929 Sec. 547.0502. KETAMINE TREATMENT GRANT PROGRAM. The
3030 commission shall establish a ketamine treatment grant program to
3131 award grants to ketamine clinics providing mental health treatment
3232 to:
3333 (1) active duty military personnel;
3434 (2) first responders; and
3535 (3) veterans.
3636 Sec. 547.0503. USE OF GRANT. A ketamine clinic may use
3737 grant money awarded under this subchapter to:
3838 (1) cover the cost of uncompensated mental health
3939 treatment provided to active duty military personnel, first
4040 responders, and veterans; and
4141 (2) pay for other activities, services, resources,
4242 supplies, or equipment the commission determines necessary for the
4343 clinic to provide the treatment described by Subdivision (1).
4444 Sec. 547.0504. SELECTION AND ACCOUNTABILITY OF GRANT
4545 RECIPIENTS. (a) The commission, with any necessary assistance of
4646 physicians or other mental health care providers, may select
4747 eligible ketamine clinics for a grant award under this subchapter.
4848 (b) The commission shall:
4949 (1) develop eligibility and selection criteria for
5050 grant applicants; and
5151 (2) establish accountability controls for grant
5252 recipients to ensure the public purpose of providing mental health
5353 treatment is accomplished and this state receives a return benefit.
5454 Sec. 547.0505. GIFTS, GRANTS, AND DONATIONS. The
5555 commission may solicit and accept gifts, grants, and donations from
5656 any source for the purposes of this subchapter.
5757 Sec. 547.0506. WORK GROUP. (a) The commission may
5858 establish a work group to:
5959 (1) assist the commission in developing,
6060 implementing, or evaluating the program; and
6161 (2) prepare a report on the results and outcomes of
6262 grants awarded under this subchapter.
6363 (b) A member of a work group established under this section:
6464 (1) is not entitled to compensation for serving on the
6565 work group; and
6666 (2) may not be reimbursed for travel or other expenses
6767 incurred while conducting the business of the work group.
6868 (c) The work group established under this section is not
6969 subject to Chapter 2110.
7070 Sec. 547.0507. BIENNIAL REPORT. Not later than December 1
7171 of each even-numbered year, the commission shall submit a report to
7272 the governor and the legislature regarding the activities of the
7373 program and grant recipients, including the results and outcomes of
7474 grants awarded under this subchapter.
7575 Sec. 547.0508. RULES. The executive commissioner may adopt
7676 rules necessary to implement this subchapter.
7777 SECTION 2. Not later than December 1, 2025, the Health and
7878 Human Services Commission shall establish and implement the
7979 ketamine treatment grant program authorized by Subchapter K,
8080 Chapter 547, Government Code, as added by this Act.
8181 SECTION 3. Not later than December 1, 2026, the Health and
8282 Human Services Commission shall provide the initial report to the
8383 governor and the legislature as required by Section 547.0507,
8484 Government Code, as added by this Act.
8585 SECTION 4. This Act takes effect September 1, 2025.
