6	6	A BILL TO BE ENTITLED
7	7	AN ACT
8	8	relating to the peace officer status of designated investigators of
9	9	a municipal office of inspector general.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter A, Chapter 2A, Code of Criminal
12	12	Procedure, is amended by adding Art. 2A.001. (34) to read as
13	13	follows:
14	14	Art. 2A.001. PEACE OFFICERS GENERALLY. The following are
15	15	peace officers:
16	16	(1) a sheriff, a sheriff's deputy, or a reserve deputy
17	17	sheriff who holds a permanent peace officer license issued under
18	18	Chapter 1701, Occupations Code;
19	19	(2) a constable, a deputy constable, or a reserve deputy
20	20	constable who holds a permanent peace officer license issued under
21	21	Chapter 1701, Occupations Code;
22	22	(3) a marshal or police officer of a municipality or a
23	23	reserve municipal police officer who holds a permanent peace
24	24	officer license issued under Chapter 1701, Occupations Code;
25	25	(4) a ranger, officer, or member of the reserve officer corps
26	26	commissioned by the Public Safety Commission and the director of
27	27	the Department of Public Safety;
28	28	(5) an investigator of a district attorney's, criminal
29	29	district attorney's, or county attorney's office;
30	30	(6) a law enforcement agent of the Texas Alcoholic Beverage
31	31	Commission;
32	32	(7) a member of an arson investigating unit commissioned by a
33	33	municipality, a county, or the state;
34	34	(8) an officer commissioned under Section 37.081, Education
35	35	Code, or Subchapter E, Chapter 51, Education Code;
36	36	(9) an officer commissioned by the Texas Facilities
37	37	Commission;
38	38	(10) a law enforcement officer commissioned by the Parks and
39	39	Wildlife Commission;
40	40	(11) an officer commissioned under Chapter 23,
41	41	Transportation Code;
42	42	(12) a municipal park and recreational patrol officer or
43	43	security officer;
44	44	(13) a security officer or investigator commissioned as a
45	45	peace officer by the comptroller;
46	46	(14) an officer commissioned by a water control and
47	47	improvement district under Section 49.216, Water Code;
48	48	(15) an officer commissioned by a board of trustees under
49	49	Chapter 54, Transportation Code;
50	50	(16) an investigator commissioned by the Texas Medical
51	51	Board;
52	52	(17) an officer commissioned by:
53	53	(A) the board of managers of the Dallas County Hospital
54	54	District, the Tarrant County Hospital District, the Bexar County
55	55	Hospital District, or the El Paso County Hospital District under
56	56	Section 281.057, Health and Safety Code;
57	57	(B) the board of directors of the Ector County Hospital
58	58	District under Section 1024.117, Special District Local Laws Code;
59	59	(C) the board of directors of the Midland County
60	60	Hospital District of Midland County, Texas, under
61	61	Section 1061.121, Special District Local Laws Code; or
62	62	(D) the board of hospital managers of the Lubbock
63	63	County Hospital District of Lubbock County, Texas, under
64	64	Section 1053.113, Special District Local Laws Code;
65	65	(18) a county park ranger commissioned under Subchapter E,
66	66	Chapter 351, Local Government Code;
67	67	(19) an investigator employed by the Texas Racing
68	68	Commission;
69	69	(20) an officer commissioned under Chapter 554, Occupations
70	70	Code;
71	71	(21) an officer commissioned by the governing body of a
72	72	metropolitan rapid transit authority under Section 451.108,
73	73	Transportation Code, or a regional transportation authority under
74	74	Section 452.110, Transportation Code;
75	75	(22) an investigator commissioned by the attorney general
76	76	under Section 402.009, Government Code;
77	77	(23) a security officer or investigator commissioned as a
78	78	peace officer under Chapter 466, Government Code;
79	79	(24) an officer appointed by an appellate court under
80	80	Subchapter F, Chapter 53, Government Code;
81	81	(25) an officer commissioned by the state fire marshal under
82	82	Chapter 417, Government Code;
83	83	(26) an investigator commissioned by the commissioner of
84	84	insurance under Section 701.104, Insurance Code;
85	85	(27) an apprehension specialist or inspector general
86	86	commissioned by the Texas Juvenile Justice Department as an officer
87	87	under Section 242.102 or 243.052, Human Resources Code;
88	88	(28) an officer appointed by the inspector general of the
89	89	Texas Department of Criminal Justice under Section 493.019,
90	90	Government Code;
91	91	(29) an investigator commissioned by the Texas Commission on
92	92	Law Enforcement under Section 1701.160, Occupations Code;
93	93	(30) a fire marshal or any related officer, inspector, or
94	94	investigator commissioned by a county under Subchapter B, Chapter
95	95	352, Local Government Code;
96	96	(31) a fire marshal or any officer, inspector, or
97	97	investigator commissioned by an emergency services district under
98	98	Chapter 775, Health and Safety Code;
99	99	(32) an officer commissioned by the State Board of Dental
100	100	Examiners under Section 254.013, Occupations Code, subject to the
101	101	limitations imposed by that section; and
102	102	(33) an investigator commissioned by the Texas Juvenile
103	103	Justice Department as an officer under Section 221.011, Human
104	104	Resources Code; and
105	105	(34) an investigator commissioned by the Texas Commission on
106	106	Law Enforcement designated by the inspector general for the City of
107	107	Dallas.
108	108	SECTION 2. Subchapter A, Chapter 18B, Code of Criminal
109	109	Procedure, is amended by adding Art. 18B.001. (L) to read as
110	110	follows:
111	111	Art. 18B.001. DEFINITIONS. In this chapter:
112	112	(1) "Authorized peace officer" means:
113	113	(A) a sheriff or deputy sheriff;
114	114	(B) a constable or deputy constable;
115	115	(C) a marshal or police officer of a municipality;
116	116	(D) a ranger or officer commissioned by the Public
117	117	Safety Commission or the director of the department;
118	118	(E) an investigator of a prosecutor's office;
119	119	(F) a law enforcement agent of the Texas Alcoholic
120	120	Beverage Commission;
121	121	(G) a law enforcement officer commissioned by the Parks
122	122	and Wildlife Commission;
123	123	(H) an enforcement officer appointed by the inspector
124	124	general of the Texas Department of Criminal Justice under
125	125	Section 493.019, Government Code;
126	126	(I) a law enforcement officer appointed by the
127	127	inspector general of the Texas Juvenile Justice Department under
128	128	Section 242.102, Human Resources Code;
129	129	(J) an investigator commissioned by the attorney
130	130	general under Section 402.009, Government Code;
131	131	(K) a member of an arson investigating unit
132	132	commissioned by a municipality, a county, or the state; or
133	133	(K) a peace officer commissioned under Section 37.081
134	134	or 51.203, Education Code; or
135	135	(L) an investigator appointed by the inspector general
136	136	for the City of Dallas.
137	137	SECTION 3. This Act takes effect immediately if it receives
138	138	a vote of two-thirds of all the members elected to each house, as
139	139	provided by Section 39, Article III, Texas Constitution. If this
140	140	Act does not receive the vote necessary for immediate effect, this
141	141	Act takes effect September 1, 2025.
