10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter A, Chapter 2A, Code of Criminal |
---|
12 | 12 | | Procedure, is amended by adding Art. 2A.001. (34) to read as |
---|
13 | 13 | | follows: |
---|
14 | 14 | | Art. 2A.001. PEACE OFFICERS GENERALLY. The following are |
---|
15 | 15 | | peace officers: |
---|
16 | 16 | | (1) a sheriff, a sheriff's deputy, or a reserve deputy |
---|
17 | 17 | | sheriff who holds a permanent peace officer license issued under |
---|
18 | 18 | | Chapter 1701, Occupations Code; |

19 | 19 | | (2) a constable, a deputy constable, or a reserve deputy |
---|
20 | 20 | | constable who holds a permanent peace officer license issued under |
---|
21 | 21 | | Chapter 1701, Occupations Code; |
---|
22 | 22 | | (3) a marshal or police officer of a municipality or a |
---|
23 | 23 | | reserve municipal police officer who holds a permanent peace |
---|
24 | 24 | | officer license issued under Chapter 1701, Occupations Code; |
---|
25 | 25 | | (4) a ranger, officer, or member of the reserve officer corps |
---|
26 | 26 | | commissioned by the Public Safety Commission and the director of |
---|
27 | 27 | | the Department of Public Safety; |
---|
28 | 28 | | (5) an investigator of a district attorney's, criminal |
---|
29 | 29 | | district attorney's, or county attorney's office; |
---|
30 | 30 | | (6) a law enforcement agent of the Texas Alcoholic Beverage |
---|
31 | 31 | | Commission; |
---|
32 | 32 | | (7) a member of an arson investigating unit commissioned by a |

33 | 33 | | municipality, a county, or the state; |

137 | 137 | | SECTION 3. This Act takes effect immediately if it receives |
---|
138 | 138 | | a vote of two-thirds of all the members elected to each house, as |
---|
139 | 139 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
140 | 140 | | Act does not receive the vote necessary for immediate effect, this |
---|
141 | 141 | | Act takes effect September 1, 2025. |
