77 AN ACT
88 relating to the peace officer status of designated investigators of
99 a municipal office of inspector general.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 2A, Code of Criminal
1212 Procedure, is amended by adding Art. 2A.001. (34) to read as
1313 follows:
1414 Art. 2A.001. PEACE OFFICERS GENERALLY. The following are
1515 peace officers:
1616 (1) a sheriff, a sheriff's deputy, or a reserve deputy
1717 sheriff who holds a permanent peace officer license issued under
1818 Chapter 1701, Occupations Code;
1919 (2) a constable, a deputy constable, or a reserve deputy
2020 constable who holds a permanent peace officer license issued under
2121 Chapter 1701, Occupations Code;
2222 (3) a marshal or police officer of a municipality or a
2323 reserve municipal police officer who holds a permanent peace
2424 officer license issued under Chapter 1701, Occupations Code;
2525 (4) a ranger, officer, or member of the reserve officer corps
2626 commissioned by the Public Safety Commission and the director of
2727 the Department of Public Safety;
2828 (5) an investigator of a district attorney's, criminal
2929 district attorney's, or county attorney's office;
3030 (6) a law enforcement agent of the Texas Alcoholic Beverage
3131 Commission;
3232 (7) a member of an arson investigating unit commissioned by a
3333 municipality, a county, or the state;
3434 (8) an officer commissioned under Section 37.081, Education
3535 Code, or Subchapter E, Chapter 51, Education Code;
3636 (9) an officer commissioned by the Texas Facilities
3737 Commission;
3838 (10) a law enforcement officer commissioned by the Parks and
3939 Wildlife Commission;
4040 (11) an officer commissioned under Chapter 23,
4141 Transportation Code;
4242 (12) a municipal park and recreational patrol officer or
4343 security officer;
4444 (13) a security officer or investigator commissioned as a
4545 peace officer by the comptroller;
4646 (14) an officer commissioned by a water control and
4747 improvement district under Section 49.216, Water Code;
4848 (15) an officer commissioned by a board of trustees under
4949 Chapter 54, Transportation Code;
5050 (16) an investigator commissioned by the Texas Medical
5151 Board;
5252 (17) an officer commissioned by:
5353 (A) the board of managers of the Dallas County Hospital
5454 District, the Tarrant County Hospital District, the Bexar County
5555 Hospital District, or the El Paso County Hospital District under
5656 Section 281.057, Health and Safety Code;
5757 (B) the board of directors of the Ector County Hospital
5858 District under Section 1024.117, Special District Local Laws Code;
5959 (C) the board of directors of the Midland County
6060 Hospital District of Midland County, Texas, under
6161 Section 1061.121, Special District Local Laws Code; or
6262 (D) the board of hospital managers of the Lubbock
6363 County Hospital District of Lubbock County, Texas, under
6464 Section 1053.113, Special District Local Laws Code;
6565 (18) a county park ranger commissioned under Subchapter E,
6666 Chapter 351, Local Government Code;
6767 (19) an investigator employed by the Texas Racing
6868 Commission;
6969 (20) an officer commissioned under Chapter 554, Occupations
7070 Code;
7171 (21) an officer commissioned by the governing body of a
7272 metropolitan rapid transit authority under Section 451.108,
7373 Transportation Code, or a regional transportation authority under
7474 Section 452.110, Transportation Code;
7575 (22) an investigator commissioned by the attorney general
7676 under Section 402.009, Government Code;
7777 (23) a security officer or investigator commissioned as a
7878 peace officer under Chapter 466, Government Code;
7979 (24) an officer appointed by an appellate court under
8080 Subchapter F, Chapter 53, Government Code;
8181 (25) an officer commissioned by the state fire marshal under
8282 Chapter 417, Government Code;
8383 (26) an investigator commissioned by the commissioner of
8484 insurance under Section 701.104, Insurance Code;
8585 (27) an apprehension specialist or inspector general
8686 commissioned by the Texas Juvenile Justice Department as an officer
8787 under Section 242.102 or 243.052, Human Resources Code;
8888 (28) an officer appointed by the inspector general of the
8989 Texas Department of Criminal Justice under Section 493.019,
9090 Government Code;
9191 (29) an investigator commissioned by the Texas Commission on
9292 Law Enforcement under Section 1701.160, Occupations Code;
9393 (30) a fire marshal or any related officer, inspector, or
9494 investigator commissioned by a county under Subchapter B, Chapter
9595 352, Local Government Code;
9696 (31) a fire marshal or any officer, inspector, or
9797 investigator commissioned by an emergency services district under
9898 Chapter 775, Health and Safety Code;
9999 (32) an officer commissioned by the State Board of Dental
100100 Examiners under Section 254.013, Occupations Code, subject to the
101101 limitations imposed by that section; and
102102 (33) an investigator commissioned by the Texas Juvenile
103103 Justice Department as an officer under Section 221.011, Human
104104 Resources Code; and
105105 (34) an investigator commissioned by the Texas Commission on
106106 Law Enforcement designated by the inspector general for the City of
107107 Dallas.
108108 SECTION 2. Subchapter A, Chapter 18B, Code of Criminal
109109 Procedure, is amended by adding Art. 18B.001. (L) to read as
110110 follows:
111111 Art. 18B.001. DEFINITIONS. In this chapter:
112112 (1) "Authorized peace officer" means:
113113 (A) a sheriff or deputy sheriff;
114114 (B) a constable or deputy constable;
115115 (C) a marshal or police officer of a municipality;
116116 (D) a ranger or officer commissioned by the Public
117117 Safety Commission or the director of the department;
118118 (E) an investigator of a prosecutor's office;
119119 (F) a law enforcement agent of the Texas Alcoholic
120120 Beverage Commission;
121121 (G) a law enforcement officer commissioned by the Parks
122122 and Wildlife Commission;
123123 (H) an enforcement officer appointed by the inspector
124124 general of the Texas Department of Criminal Justice under
125125 Section 493.019, Government Code;
126126 (I) a law enforcement officer appointed by the
127127 inspector general of the Texas Juvenile Justice Department under
128128 Section 242.102, Human Resources Code;
129129 (J) an investigator commissioned by the attorney
130130 general under Section 402.009, Government Code;
131131 (K) a member of an arson investigating unit
132132 commissioned by a municipality, a county, or the state; or
133133 (K) a peace officer commissioned under Section 37.081
134134 or 51.203, Education Code; or
135135 (L) an investigator appointed by the inspector general
136136 for the City of Dallas.
137137 SECTION 3. This Act takes effect immediately if it receives
138138 a vote of two-thirds of all the members elected to each house, as
139139 provided by Section 39, Article III, Texas Constitution. If this
140140 Act does not receive the vote necessary for immediate effect, this
141141 Act takes effect September 1, 2025.
