69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the availability of certain personal information of a
912 member of the governing board of an institution of higher
1013 education, the chief executive officer of the institution, or the
1114 chief executive officer of a university system.
1215 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1316 SECTION 1. Section 552.117(a), Government Code, is amended
1417 to read as follows:
1518 (a) Information is excepted from the requirements of
1619 Section 552.021 if it is information that relates to the home
1720 address, home telephone number, emergency contact information, or
1821 social security number of the following person or that reveals
1922 whether the person has family members:
2023 (1) a current or former official or employee of a
2124 governmental body, except as otherwise provided by Section 552.024;
2225 (2) a current or honorably retired peace officer as
2326 defined by Article 2A.001, Code of Criminal Procedure, or a current
2427 or honorably retired security officer commissioned under Section
2528 51.212, Education Code, regardless of whether the officer complies
2629 with Section 552.024 or 552.1175, as applicable;
2730 (3) a current or former employee of the Texas
2831 Department of Criminal Justice or of the predecessor in function of
2932 the department or any division of the department, regardless of
3033 whether the current or former employee complies with Section
3134 552.1175;
3235 (4) a peace officer as defined by Article 2A.001, Code
3336 of Criminal Procedure, or other law, a reserve law enforcement
3437 officer, a commissioned deputy game warden, or a corrections
3538 officer in a municipal, county, or state penal institution in this
3639 state who was killed in the line of duty, regardless of whether the
3740 deceased complied with Section 552.024 or 552.1175;
3841 (5) a commissioned security officer as defined by
3942 Section 1702.002, Occupations Code, regardless of whether the
4043 officer complies with Section 552.024 or 552.1175, as applicable;
4144 (6) an officer or employee of a community supervision
4245 and corrections department established under Chapter 76 who
4346 performs a duty described by Section 76.004(b), regardless of
4447 whether the officer or employee complies with Section 552.024 or
4548 552.1175;
4649 (7) a current or former employee of the office of the
4750 attorney general who is or was assigned to a division of that office
4851 the duties of which involve law enforcement or are performed under
4952 Chapter 231, Family Code, regardless of whether the current or
5053 former employee complies with Section 552.024 or 552.1175;
5154 (8) a current or former employee of the Texas Juvenile
5255 Justice Department or of the predecessors in function of the
5356 department, regardless of whether the current or former employee
5457 complies with Section 552.024 or 552.1175;
5558 (9) a current or former juvenile probation or
5659 supervision officer certified by the Texas Juvenile Justice
5760 Department, or the predecessors in function of the department,
5861 under Title 12, Human Resources Code, regardless of whether the
5962 current or former officer complies with Section 552.024 or
6063 552.1175;
6164 (10) a current or former employee of a juvenile
6265 justice program or facility, as those terms are defined by Section
6366 261.405, Family Code, regardless of whether the current or former
6467 employee complies with Section 552.024 or 552.1175;
6568 (11) a current or former member of the United States
6669 Army, Navy, Air Force, Coast Guard, or Marine Corps, an auxiliary
6770 service of one of those branches of the armed forces, or the Texas
6871 military forces, as that term is defined by Section 437.001;
6972 (12) a current or former district attorney, criminal
7073 district attorney, or county or municipal attorney whose
7174 jurisdiction includes any criminal law or child protective services
7275 matters, regardless of whether the current or former attorney
7376 complies with Section 552.024 or 552.1175;
7477 (13) a current or former employee of a district
7578 attorney, criminal district attorney, or county or municipal
7679 attorney whose jurisdiction includes any criminal law or child
7780 protective services matters, regardless of whether the current or
7881 former employee complies with Section 552.024 or 552.1175;
7982 (14) a current or former employee of the Texas Civil
8083 Commitment Office or of the predecessor in function of the office or
8184 a division of the office, regardless of whether the current or
8285 former employee complies with Section 552.024 or 552.1175;
8386 (15) a current or former federal judge or state judge,
8487 as those terms are defined by Section 1.005, Election Code, a
8588 federal bankruptcy judge, a marshal of the United States Marshals
8689 Service, a United States attorney, or a family member of a current
8790 or former federal judge, including a federal bankruptcy judge, a
8891 marshal of the United States Marshals Service, a United States
8992 attorney, or a state judge;
9093 (16) a current or former child protective services
9194 caseworker, adult protective services caseworker, or investigator
9295 for the Department of Family and Protective Services, regardless of
9396 whether the caseworker or investigator complies with Section
9497 552.024 or 552.1175, or a current or former employee of a department
9598 contractor performing child protective services caseworker, adult
9699 protective services caseworker, or investigator functions for the
97100 contractor on behalf of the department;
98101 (17) an elected public officer, regardless of whether
99102 the officer complies with Section 552.024 or 552.1175;
100103 (18) a current or former United States attorney,
101104 assistant United States attorney, federal public defender, deputy
102105 federal public defender, or assistant federal public defender and
103106 the spouse or child of the current or former attorney or public
104107 defender, regardless of whether the person complies with Section
105108 552.024 or 552.1175; [or]
106109 (19) a firefighter or volunteer firefighter or
107110 emergency medical services personnel as defined by Section 773.003,
108111 Health and Safety Code, regardless of whether the firefighter or
109112 volunteer firefighter or emergency medical services personnel
110113 comply with Section 552.024 or 552.1175, as applicable;
111114 (20) a member of the governing board of an institution
112115 of higher education or a private or independent institution of
113116 higher education, as those terms are defined by Section 61.003,
114117 Education Code;
115118 (21) the chancellor or other chief executive officer
116119 of a university system, as defined by Section 61.003, Education
117120 Code; or
118121 (22) the president or other chief executive officer of
119122 an institution of higher education or a private or independent
120123 institution of higher education, as those terms are defined by
121124 Section 61.003, Education Code.
122125 SECTION 2. Section 552.1175(a), Government Code, is amended
123126 to read as follows:
124127 (a) This section applies only to:
125128 (1) current or honorably retired peace officers as
126129 defined by Article 2A.001, Code of Criminal Procedure, or special
127130 investigators as described by Article 2A.002, Code of Criminal
128131 Procedure;
129132 (2) current or honorably retired county jailers as
130133 defined by Section 1701.001, Occupations Code;
131134 (3) current or former employees of the Texas
132135 Department of Criminal Justice or of the predecessor in function of
133136 the department or any division of the department;
134137 (4) commissioned security officers as defined by
135138 Section 1702.002, Occupations Code;
136139 (5) a current or former district attorney, criminal
137140 district attorney, or county or municipal attorney whose
138141 jurisdiction includes any criminal law or child protective services
139142 matters;
140143 (5-a) a current or former employee of a district
141144 attorney, criminal district attorney, or county or municipal
142145 attorney whose jurisdiction includes any criminal law or child
143146 protective services matters;
144147 (6) officers and employees of a community supervision
145148 and corrections department established under Chapter 76 who perform
146149 a duty described by Section 76.004(b);
147150 (7) criminal investigators of the United States as
148151 described by Article 2A.002(a), Code of Criminal Procedure;
149152 (8) current or honorably retired police officers and
150153 inspectors of the United States Federal Protective Service;
151154 (9) current and former employees of the office of the
152155 attorney general who are or were assigned to a division of that
153156 office the duties of which involve law enforcement or are performed
154157 under Chapter 231, Family Code;
155158 (10) current or former juvenile probation and
156159 detention officers certified by the Texas Juvenile Justice
157160 Department, or the predecessors in function of the department,
158161 under Title 12, Human Resources Code;
159162 (11) current or former employees of a juvenile justice
160163 program or facility, as those terms are defined by Section 261.405,
161164 Family Code;
162165 (12) current or former employees of the Texas Juvenile
163166 Justice Department or the predecessors in function of the
164167 department;
165168 (13) federal judges and state judges as defined by
166169 Section 1.005, Election Code;
167170 (14) current or former employees of the Texas Civil
168171 Commitment Office or of the predecessor in function of the office or
169172 a division of the office;
170173 (15) a current or former member of the United States
171174 Army, Navy, Air Force, Coast Guard, or Marine Corps, an auxiliary
172175 service of one of those branches of the armed forces, or the Texas
173176 military forces, as that term is defined by Section 437.001;
174177 (16) a current or former child protective services
175178 caseworker, adult protective services caseworker, or investigator
176179 for the Department of Family and Protective Services or a current or
177180 former employee of a department contractor performing child
178181 protective services caseworker, adult protective services
179182 caseworker, or investigator functions for the contractor on behalf
180183 of the department;
181184 (17) an elected public officer;
182185 (18) a firefighter or volunteer firefighter or
183186 emergency medical services personnel as defined by Section 773.003,
184187 Health and Safety Code; [and]
185188 (19) a current or former United States attorney,
186189 assistant United States attorney, federal public defender, deputy
187190 federal public defender, or assistant federal public defender;
188191 (20) a member of the governing board of an institution
189192 of higher education or a private or independent institution of
190193 higher education, as those terms are defined by Section 61.003,
191194 Education Code;
192195 (21) the chancellor or other chief executive officer
193196 of a university system, as defined by Section 61.003, Education
194197 Code; and
195198 (22) the president or other chief executive officer of
196199 an institution of higher education or a private or independent
197200 institution of higher education, as those terms are defined by
198201 Section 61.003, Education Code.
199202 SECTION 3. Section 25.025(a), Tax Code, as amended by
200203 Chapters 76 (S.B. 617), 152 (S.B. 870), 430 (H.B. 1911), 765 (H.B.
201204 4504), and 937 (S.B. 1525), Acts of the 88th Legislature, Regular
202205 Session, 2023, is reenacted and amended to read as follows:
203206 (a) This section applies only to:
204207 (1) a current or former peace officer as defined by
205208 Article 2A.001, Code of Criminal Procedure, and the spouse or
206209 surviving spouse of the peace officer;
207210 (2) the adult child of a current peace officer as
208211 defined by Article 2A.001, Code of Criminal Procedure;
209212 (3) a current or honorably retired county jailer as
210213 defined by Section 1701.001, Occupations Code;
211214 (4) an employee of the Texas Department of Criminal
212215 Justice;
213216 (5) a commissioned security officer as defined by
214217 Section 1702.002, Occupations Code;
215218 (6) an individual who shows that the individual, the
216219 individual's child, or another person in the individual's household
217220 is a victim of family violence as defined by Section 71.004, Family
218221 Code, by providing:
219222 (A) a copy of a protective order issued under
220223 Chapter 85, Family Code, or a magistrate's order for emergency
221224 protection issued under Article 17.292, Code of Criminal Procedure;
222225 or
223226 (B) other independent documentary evidence
224227 necessary to show that the individual, the individual's child, or
225228 another person in the individual's household is a victim of family
226229 violence;
227230 (7) an individual who shows that the individual, the
228231 individual's child, or another person in the individual's household
229232 is a victim of sexual assault or abuse, stalking, or trafficking of
230233 persons by providing:
231234 (A) a copy of a protective order issued under
232235 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
233236 magistrate's order for emergency protection issued under Article
234237 17.292, Code of Criminal Procedure; or
235238 (B) other independent documentary evidence
236239 necessary to show that the individual, the individual's child, or
237240 another person in the individual's household is a victim of sexual
238241 assault or abuse, stalking, or trafficking of persons;
239242 (8) a participant in the address confidentiality
240243 program administered by the attorney general under Subchapter B,
241244 Chapter 58, Code of Criminal Procedure, who provides proof of
242245 certification under Article 58.059, Code of Criminal Procedure;
243246 (9) a federal judge, a federal bankruptcy judge, a
244247 marshal of the United States Marshals Service, a state judge, or a
245248 family member of a federal judge, a federal bankruptcy judge, a
246249 marshal of the United States Marshals Service, or a state judge;
247250 (10) a current or former district attorney, criminal
248251 district attorney, or county or municipal attorney whose
249252 jurisdiction includes any criminal law or child protective services
250253 matters;
251254 (11) a current or former employee of a district
252255 attorney, criminal district attorney, or county or municipal
253256 attorney whose jurisdiction includes any criminal law or child
254257 protective services matters;
255258 (12) an officer or employee of a community supervision
256259 and corrections department established under Chapter 76,
257260 Government Code, who performs a duty described by Section 76.004(b)
258261 of that code;
259262 (13) a criminal investigator of the United States as
260263 described by Article 2A.002(a), Code of Criminal Procedure;
261264 (14) a current or honorably retired police officer or
262265 inspector of the United States Federal Protective Service;
263266 (15) a current or former United States attorney,
264267 assistant United States attorney, federal public defender, deputy
265268 federal public defender, or assistant federal public defender and
266269 the spouse and child of the attorney or public defender;
267270 (16) a current or former employee of the office of the
268271 attorney general who is or was assigned to a division of that office
269272 the duties of which involve law enforcement or are performed under
270273 Chapter 231, Family Code;
271274 (17) a medical examiner or person who performs
272275 forensic analysis or testing who is employed by this state or one or
273276 more political subdivisions of this state;
274277 (18) a current or former member of the United States
275278 armed forces who has served in an area that the president of the
276279 United States by executive order designates for purposes of 26
277280 U.S.C. Section 112 as an area in which armed forces of the United
278281 States are or have engaged in combat;
279282 (19) a current or former employee of the Texas
280283 Juvenile Justice Department or of the predecessors in function of
281284 the department;
282285 (20) a current or former juvenile probation or
283286 supervision officer certified by the Texas Juvenile Justice
284287 Department, or the predecessors in function of the department,
285288 under Title 12, Human Resources Code;
286289 (21) a current or former employee of a juvenile
287290 justice program or facility, as those terms are defined by Section
288291 261.405, Family Code;
289292 (22) a current or former employee of the Texas Civil
290293 Commitment Office or the predecessor in function of the office or a
291294 division of the office;
292295 (23) a current or former employee of a federal judge or
293296 state judge;
294297 (24) a current or former child protective services
295298 caseworker, adult protective services caseworker, or investigator
296299 for the Department of Family and Protective Services or a current or
297300 former employee of a department contractor performing child
298301 protective services caseworker, adult protective services
299302 caseworker, or investigator functions for the contractor on behalf
300303 of the department;
301304 (25) an elected public officer;
302305 (26) a firefighter or volunteer firefighter or
303306 emergency medical services personnel as defined by Section 773.003,
304307 Health and Safety Code;
305308 (27) a customs and border protection officer or border
306309 patrol agent of United States Customs and Border Protection or the
307310 spouse, surviving spouse, or adult child of a customs and border
308311 protection officer or border patrol agent;
309312 (28) [(27) a current or former attorney for the
310313 Department of Family and Protective Services
311314 [(27)] a current or former employee or contract staff
312315 member of a university health care provider at a corrections
313316 facility operated by the Texas Department of Criminal Justice or
314317 the Texas Juvenile Justice Department; [and]
315318 (29) [(28)] a current or former attorney for the
316319 Department of Family and Protective Services;
317320 (30) a member of the governing board of an institution
318321 of higher education or a private or independent institution of
319322 higher education, as those terms are defined by Section 61.003,
320323 Education Code;
321324 (31) the chancellor or other chief executive officer
322325 of a university system, as defined by Section 61.003, Education
323326 Code; and
324327 (32) the president or other chief executive officer of
325328 an institution of higher education or a private or independent
326329 institution of higher education, as those terms are defined by
327330 Section 61.003, Education Code.
328331 SECTION 4. To the extent of any conflict, this Act prevails
329332 over another Act of the 89th Legislature, Regular Session, 2025,
330333 relating to nonsubstantive additions to and corrections in enacted
331334 codes.
332335 SECTION 5. The changes in law made by this Act apply only to
333336 a request for information that is received by a governmental body or
334337 an officer on or after the effective date of this Act.
335338 SECTION 6. This Act takes effect September 1, 2025.
