77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enforceability of certain nondisclosure or
1010 confidentiality provisions with respect to an act of sexual abuse
1111 committed against a child.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Title 6, Civil Practice and Remedies Code, is
1414 amended by adding Chapter 129C to read as follows:
1515 CHAPTER 129C. AGREEMENTS PROHIBITING DISCLOSURES REGARDING CHILD
1616 SEXUAL ABUSE
1717 Sec. 129C.001. DEFINITIONS. In this chapter:
1818 (1) "Act of sexual abuse" means conduct described by
1919 one or more of the following penal laws:
2020 (A) indecency with a child under Section 21.11,
2121 Penal Code;
2222 (B) sexual assault under Section 22.011, Penal
2323 Code;
2424 (C) aggravated sexual assault under Section
2525 22.021, Penal Code;
2626 (D) sexual performance by a child under Section
2727 43.25, Penal Code;
2828 (E) trafficking of persons under Section
2929 20A.02(a)(3), (4), (7), or (8), Penal Code; and
3030 (F) compelling prostitution under Section 43.05,
3131 Penal Code.
3232 (2) "Child" means a person younger than 17 years of
3333 age.
3434 Sec. 129C.002. CERTAIN PROVISIONS UNENFORCEABLE. Any
3535 provision of a nondisclosure or confidentiality agreement,
3636 employment agreement, settlement agreement, or any other agreement
3737 is void and unenforceable as against the public policy of this state
3838 to the extent the provision:
3939 (1) prohibits a party from notifying, or limits the
4040 party's ability to notify, a local or state law enforcement agency
4141 or any state or federal regulatory agency of an act of sexual abuse
4242 committed against a child; or
4343 (2) prohibits a party from disclosing to any person,
4444 including during any related investigation, prosecution, legal
4545 proceeding, or dispute resolution, facts surrounding any act of
4646 sexual abuse committed against a child, including the identity of
4747 the alleged offender.
4848 SECTION 2. The change in law made by this Act applies to an
4949 agreement entered into before, on, or after the effective date of
5050 this Act.
5151 SECTION 3. This Act takes effect September 1, 2025.
