88 AN ACT
99 relating to the Texas Industry-Recognized Apprenticeship Programs
1010 Grant Program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 302.252(1), Labor Code, is amended to
1313 read as follows:
1414 (1) "Industry-recognized apprenticeship program"
1515 means a training program that:
1616 (A) provides on-the-job training, preparatory
1717 instruction, supplementary instruction, or related instruction in
1818 an occupation that has been recognized as an apprenticeable
1919 occupation by the commission as provided by commission rule [Office
2020 of Apprenticeship of the United States Department of Labor]; or
2121 (B) is certified by the commission as an
2222 industry-recognized apprenticeship program as provided by
2323 commission rule [by a third-party certifier that has received from
2424 the United States Department of Labor a favorable determination of
2525 qualification to award that certification].
2626 SECTION 2. Section 302.256, Labor Code, is amended by
2727 adding Subsection (e) to read as follows:
2828 (e) The commission by rule may distribute payments
2929 constituting a partial reimbursement to an eligible person as
3030 milestones for on-the-job training and employment are met by
3131 program participants, in accordance with the grant terms.
3232 SECTION 3. Section 302.257, Labor Code, is amended by
3333 amending Subsection (a) and adding Subsection (a-1) to read as
3434 follows:
3535 (a) The commission shall adopt rules to administer and
3636 enforce this subchapter, including rules establishing:
3737 (1) which occupations are recognized by the commission
3838 as an apprenticeable occupation for purposes of this subchapter and
3939 the criteria for that determination, which must include that the
4040 occupation:
4141 (A) be customarily learned in a practical way
4242 through a structured, systematic program of on-the-job supervised
4343 training;
4444 (B) be clearly identified and commonly
4545 recognized throughout an industry;
4646 (C) involve manual, mechanical, or technical
4747 skills or knowledge which requires significant on-the-job work
4848 experience; and
4949 (D) require related instruction to supplement
5050 the on-the-job training; and
5151 (2) a process for and the criteria by which the
5252 commission may certify a training program as an industry-recognized
5353 apprenticeship program for purposes of this subchapter.
5454 (a-1) The criteria adopted by the commission under
5555 Subsection (a)(2) must be generally consistent with the standards
5656 of apprenticeship prescribed by 29 C.F.R. Section 29.
5757 SECTION 4. As soon as practicable after the effective date
5858 of this Act, the Texas Workforce Commission shall adopt the rules
5959 required by Section 302.257, Labor Code, as amended by this Act.
6060 SECTION 5. The change in law made by this Act applies only
6161 to a grant awarded under Subchapter I, Chapter 302, Labor Code, on
6262 or after the effective date of this Act. A grant awarded before
6363 that date is governed by the law in effect on the date the grant was
6464 awarded, and the former law is continued in effect for that purpose.
6565 SECTION 6. This Act takes effect September 1, 2025.
