11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 302.252(1), Labor Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (1) "Industry-recognized apprenticeship program" |
---|
15 | 15 | | means a training program that: |
---|
16 | 16 | | (A) provides on-the-job training, preparatory |
---|
17 | 17 | | instruction, supplementary instruction, or related instruction in |
---|
18 | 18 | | an occupation that has been recognized as an apprenticeable |
---|
19 | 19 | | occupation by the commission as provided by commission rule [Office |
---|
20 | 20 | | of Apprenticeship of the United States Department of Labor]; or |
---|
21 | 21 | | (B) is certified by the commission as an |
---|
22 | 22 | | industry-recognized apprenticeship program as provided by |
---|
23 | 23 | | commission rule [by a third-party certifier that has received from |
---|
24 | 24 | | the United States Department of Labor a favorable determination of |
---|
25 | 25 | | qualification to award that certification]. |
---|
26 | 26 | | SECTION 2. Section 302.256, Labor Code, is amended by |
---|
27 | 27 | | adding Subsection (e) to read as follows: |
---|
28 | 28 | | (e) The commission by rule may distribute payments |
---|
29 | 29 | | constituting a partial reimbursement to an eligible person as |
---|
30 | 30 | | milestones for on-the-job training and employment are met by |
---|
31 | 31 | | program participants, in accordance with the grant terms. |
---|
32 | 32 | | SECTION 3. Section 302.257, Labor Code, is amended by |
---|
33 | 33 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
34 | 34 | | follows: |
---|
35 | 35 | | (a) The commission shall adopt rules to administer and |
---|
36 | 36 | | enforce this subchapter, including rules establishing: |
---|
37 | 37 | | (1) which occupations are recognized by the commission |
---|
38 | 38 | | as an apprenticeable occupation for purposes of this subchapter and |
---|
39 | 39 | | the criteria for that determination, which must include that the |
---|
40 | 40 | | occupation: |
---|
41 | 41 | | (A) be customarily learned in a practical way |
---|
42 | 42 | | through a structured, systematic program of on-the-job supervised |
---|
43 | 43 | | training; |
---|
44 | 44 | | (B) be clearly identified and commonly |
---|
45 | 45 | | recognized throughout an industry; |
---|
46 | 46 | | (C) involve manual, mechanical, or technical |
---|
47 | 47 | | skills or knowledge which requires significant on-the-job work |
---|
48 | 48 | | experience; and |
---|
49 | 49 | | (D) require related instruction to supplement |
---|
50 | 50 | | the on-the-job training; and |
---|
51 | 51 | | (2) a process for and the criteria by which the |
---|
52 | 52 | | commission may certify a training program as an industry-recognized |
---|
53 | 53 | | apprenticeship program for purposes of this subchapter. |
---|
54 | 54 | | (a-1) The criteria adopted by the commission under |
---|
55 | 55 | | Subsection (a)(2) must be generally consistent with the standards |
---|
56 | 56 | | of apprenticeship prescribed by 29 C.F.R. Section 29. |
---|
57 | 57 | | SECTION 4. As soon as practicable after the effective date |
---|
58 | 58 | | of this Act, the Texas Workforce Commission shall adopt the rules |
---|
59 | 59 | | required by Section 302.257, Labor Code, as amended by this Act. |
---|
60 | 60 | | SECTION 5. The change in law made by this Act applies only |
---|
61 | 61 | | to a grant awarded under Subchapter I, Chapter 302, Labor Code, on |
---|
62 | 62 | | or after the effective date of this Act. A grant awarded before |
---|
63 | 63 | | that date is governed by the law in effect on the date the grant was |
---|
64 | 64 | | awarded, and the former law is continued in effect for that purpose. |
---|
65 | 65 | | SECTION 6. This Act takes effect September 1, 2025. |
