33 | 33 | | Advisory Commission is a legislative agency that consists of five |
---|
34 | 34 | | members of the senate and one public member appointed by the |
---|
35 | 35 | | lieutenant governor and five members of the house of |
---|
36 | 36 | | representatives and one public member appointed by the speaker of |
---|
37 | 37 | | the house. The lieutenant governor and the speaker of the house may |
---|
38 | 38 | | serve as one of the legislative appointees. |
---|
39 | 39 | | SECTION 6. Chapter 325, Government Code, is amended by |
---|
40 | 40 | | adding Section 325.0035 to read as follows: |
---|
41 | 41 | | Sec. 325.0035. REFERENCES IN LAW. (a) A reference in law |
---|
42 | 42 | | to the Sunset Advisory Commission is a reference to the Sunset |
---|
43 | 43 | | Legislative Initiative for Cost Efficiency Advisory Commission. |
---|
44 | 44 | | (b) A reference in law to the Texas Sunset Act is a reference |

45 | 45 | | to the Texas Sunset Legislative Initiative for Cost Efficiency |

47 | 47 | | SECTION 7. Section 325.011, Government Code, is amended to |
---|
48 | 48 | | read as follows: |

49 | 49 | | Sec. 325.011. CRITERIA FOR REVIEW. The commission and its |
---|
50 | 50 | | staff shall consider the following criteria in determining whether |
---|
51 | 51 | | a public need exists for the continuation of a state agency or its |
---|
52 | 52 | | advisory committees or for the performance of the functions of the |
---|
53 | 53 | | agency or its advisory committees: |
---|
54 | 54 | | (1) the efficiency and effectiveness with which the |
---|
55 | 55 | | agency or the advisory committee operates, including: |
---|
56 | 56 | | (A) an assessment of efficiency in delivering |
---|
57 | 57 | | programs and services to entities and other persons; and |
---|
58 | 58 | | (B) an assessment of appropriated funds and |
---|
59 | 59 | | spending to determine potential spending efficiencies and identify |
---|
60 | 60 | | waste in the delivery of programs and services; |
---|
61 | 61 | | (2)(A) an identification of the mission, goals, and |
---|
62 | 62 | | objectives intended for the agency or advisory committee and of the |
---|
63 | 63 | | problem or need that the agency or advisory committee was intended |
---|
64 | 64 | | to address; and |
---|
65 | 65 | | (B) the extent to which the mission, goals, and |
---|
66 | 66 | | objectives have been achieved and the problem or need has been |
---|
67 | 67 | | addressed; |
---|
68 | 68 | | (3)(A) an identification of any activities of the |
---|
69 | 69 | | agency in addition to those granted by statute and of the authority |
---|
70 | 70 | | for those activities; and |
---|
71 | 71 | | (B) the extent to which those activities are |
---|
72 | 72 | | needed; |
---|
73 | 73 | | (4) an assessment of authority of the agency relating |
---|
74 | 74 | | to fees, inspections, enforcement, and penalties; |
---|
75 | 75 | | (5) whether less restrictive or alternative methods of |
---|
76 | 76 | | performing any function that the agency performs could adequately |
---|
77 | 77 | | protect or provide service to the public; |
---|
78 | 78 | | (6) the extent to which the jurisdiction of the agency |
---|
79 | 79 | | and the programs administered by the agency overlap or duplicate |
---|
80 | 80 | | those of other agencies, the extent to which the agency coordinates |
---|
81 | 81 | | with those agencies, and the extent to which the programs |
---|
82 | 82 | | administered by the agency can be consolidated with the programs of |
---|
83 | 83 | | other state agencies; |
---|
84 | 84 | | (7) the promptness and effectiveness with which the |
---|
85 | 85 | | agency addresses complaints concerning entities or other persons |
---|
86 | 86 | | affected by the agency, including an assessment of the agency's |
---|
87 | 87 | | administrative hearings process; |
---|
88 | 88 | | (8) an assessment of the agency's rulemaking process |
---|
89 | 89 | | and the extent to which the agency has encouraged participation by |
---|
90 | 90 | | the public in making its rules and decisions and the extent to which |
---|
91 | 91 | | the public participation has resulted in rules that benefit the |
---|
92 | 92 | | public; |
---|
93 | 93 | | (9) the extent to which the agency has complied with: |
---|
94 | 94 | | (A) federal and state laws and applicable rules |
---|
95 | 95 | | regarding equality of employment opportunity and the rights and |
---|
96 | 96 | | privacy of individuals; and |
---|
97 | 97 | | (B) state law and applicable rules of any state |
---|
98 | 98 | | agency regarding purchasing guidelines and programs for |
---|
99 | 99 | | historically underutilized businesses; |
---|
100 | 100 | | (10) the extent to which the agency issues and |
---|
101 | 101 | | enforces rules relating to potential conflicts of interest of its |
---|
102 | 102 | | employees; |
---|
103 | 103 | | (11) the extent to which the agency complies with |
---|
104 | 104 | | Chapters 551 and 552 and follows records management practices that |
---|
105 | 105 | | enable the agency to respond efficiently to requests for public |
---|
106 | 106 | | information; |
---|
107 | 107 | | (12) the effect of federal intervention or loss of |
---|
108 | 108 | | federal funds if the agency is abolished; |
---|
109 | 109 | | (13) the extent to which the purpose and effectiveness |
---|
110 | 110 | | of reporting requirements imposed on the agency justifies the |
---|
111 | 111 | | continuation of the requirement; and |
---|
112 | 112 | | (14) an assessment of the agency's cybersecurity |
---|
113 | 113 | | practices using confidential information available from the |
---|
114 | 114 | | Department of Information Resources or any other appropriate state |
---|
115 | 115 | | agency. |
---|
116 | 116 | | SECTION 8. (a) Effective January 1, 2026: |
---|
117 | 117 | | (1) the name of the Sunset Advisory Commission is |
---|
118 | 118 | | changed to the Sunset Legislative Initiative for Cost Efficiency |
---|
119 | 119 | | Advisory Commission, and all powers, duties, rights, and |
---|
120 | 120 | | obligations of the Sunset Advisory Commission are the powers, |
---|
121 | 121 | | duties, rights, and obligations of the Sunset Legislative |
---|
122 | 122 | | Initiative for Cost Efficiency Advisory Commission; |
---|
123 | 123 | | (2) a member of the Sunset Advisory Commission is a |
---|
124 | 124 | | member of the Sunset Legislative Initiative for Cost Efficiency |
---|
125 | 125 | | Advisory Commission; and |
---|
126 | 126 | | (3) any appropriation to the Sunset Advisory |
---|
127 | 127 | | Commission is an appropriation to the Sunset Legislative Initiative |
---|
128 | 128 | | for Cost Efficiency Advisory Commission. |
---|
129 | 129 | | (b) Effective January 1, 2026, a reference in law to the |

130 | 130 | | Sunset Advisory Commission is a reference to the Sunset Legislative |

132 | 132 | | (c) The Sunset Legislative Initiative for Cost Efficiency |

134 | 134 | | Commission in all respects. All personnel, equipment, data, |

135 | 135 | | documents, facilities, contracts, items, other property, rules, |

136 | 136 | | decisions, and proceedings of or involving the Sunset Advisory |

137 | 137 | | Commission are unaffected by the change in the name of the |
---|
138 | 138 | | commission. |

139 | 139 | | (d) The Sunset Advisory Commission shall adopt a timetable |

140 | 140 | | for phasing in the change of the commission's name so as to minimize |
---|
141 | 141 | | the fiscal impact of the name change. Until January 1, 2026, to |
---|
142 | 142 | | allow for phasing in the change of the commission's name and in |
---|
143 | 143 | | accordance with the timetable established as required by this |
---|
144 | 144 | | section, the commission may perform any act authorized by law for |
---|
145 | 145 | | the Sunset Advisory Commission as the Sunset Advisory Commission or |
---|
146 | 146 | | as the Sunset Legislative Initiative for Cost Efficiency Advisory |
---|
147 | 147 | | Commission. Any act of the Sunset Advisory Commission acting as the |
---|
148 | 148 | | Sunset Legislative Initiative for Cost Efficiency Advisory |
---|
149 | 149 | | Commission on or after the effective date of this Act and before |
---|
150 | 150 | | January 1, 2026, is an act of the Sunset Advisory Commission. |

151 | 151 | | SECTION 9. This Act takes effect September 1, 2025. |
