88 AN ACT
99 relating to renaming the Sunset Advisory Commission as the Sunset
1010 Legislative Initiative for Cost Efficiency Advisory Commission and
1111 the duties of that commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Chapter 325, Government Code, is
1414 amended to read as follows:
1515 CHAPTER 325. SUNSET LEGISLATIVE INITIATIVE FOR COST EFFICIENCY
1616 (SLICE) LAW
1717 SECTION 2. Section 325.001, Government Code, is amended to
1818 read as follows:
1919 Sec. 325.001. SHORT TITLE. This chapter may be cited as the
2020 Texas Sunset Legislative Initiative for Cost Efficiency (SLICE)
2121 Act.
2222 SECTION 3. Section 325.002(3), Government Code, is amended
2323 to read as follows:
2424 (3) "Commission" means the Sunset Legislative
2525 Initiative for Cost Efficiency Advisory Commission.
2626 SECTION 4. The heading to Section 325.003, Government Code,
2727 is amended to read as follows:
2828 Sec. 325.003. SUNSET LEGISLATIVE INITIATIVE FOR COST
2929 EFFICIENCY ADVISORY COMMISSION.
3030 SECTION 5. Section 325.003(a), Government Code, is amended
3131 to read as follows:
3232 (a) The Sunset Legislative Initiative for Cost Efficiency
3333 Advisory Commission is a legislative agency that consists of five
3434 members of the senate and one public member appointed by the
3535 lieutenant governor and five members of the house of
3636 representatives and one public member appointed by the speaker of
3737 the house. The lieutenant governor and the speaker of the house may
3838 serve as one of the legislative appointees.
3939 SECTION 6. Chapter 325, Government Code, is amended by
4040 adding Section 325.0035 to read as follows:
4141 Sec. 325.0035. REFERENCES IN LAW. (a) A reference in law
4242 to the Sunset Advisory Commission is a reference to the Sunset
4343 Legislative Initiative for Cost Efficiency Advisory Commission.
4444 (b) A reference in law to the Texas Sunset Act is a reference
4545 to the Texas Sunset Legislative Initiative for Cost Efficiency
4646 (SLICE) Act.
4747 SECTION 7. Section 325.011, Government Code, is amended to
4848 read as follows:
4949 Sec. 325.011. CRITERIA FOR REVIEW. The commission and its
5050 staff shall consider the following criteria in determining whether
5151 a public need exists for the continuation of a state agency or its
5252 advisory committees or for the performance of the functions of the
5353 agency or its advisory committees:
5454 (1) the efficiency and effectiveness with which the
5555 agency or the advisory committee operates, including:
5656 (A) an assessment of efficiency in delivering
5757 programs and services to entities and other persons; and
5858 (B) an assessment of appropriated funds and
5959 spending to determine potential spending efficiencies and identify
6060 waste in the delivery of programs and services;
6161 (2)(A) an identification of the mission, goals, and
6262 objectives intended for the agency or advisory committee and of the
6363 problem or need that the agency or advisory committee was intended
6464 to address; and
6565 (B) the extent to which the mission, goals, and
6666 objectives have been achieved and the problem or need has been
6767 addressed;
6868 (3)(A) an identification of any activities of the
6969 agency in addition to those granted by statute and of the authority
7070 for those activities; and
7171 (B) the extent to which those activities are
7272 needed;
7373 (4) an assessment of authority of the agency relating
7474 to fees, inspections, enforcement, and penalties;
7575 (5) whether less restrictive or alternative methods of
7676 performing any function that the agency performs could adequately
7777 protect or provide service to the public;
7878 (6) the extent to which the jurisdiction of the agency
7979 and the programs administered by the agency overlap or duplicate
8080 those of other agencies, the extent to which the agency coordinates
8181 with those agencies, and the extent to which the programs
8282 administered by the agency can be consolidated with the programs of
8383 other state agencies;
8484 (7) the promptness and effectiveness with which the
8585 agency addresses complaints concerning entities or other persons
8686 affected by the agency, including an assessment of the agency's
8787 administrative hearings process;
8888 (8) an assessment of the agency's rulemaking process
8989 and the extent to which the agency has encouraged participation by
9090 the public in making its rules and decisions and the extent to which
9191 the public participation has resulted in rules that benefit the
9292 public;
9393 (9) the extent to which the agency has complied with:
9494 (A) federal and state laws and applicable rules
9595 regarding equality of employment opportunity and the rights and
9696 privacy of individuals; and
9797 (B) state law and applicable rules of any state
9898 agency regarding purchasing guidelines and programs for
9999 historically underutilized businesses;
100100 (10) the extent to which the agency issues and
101101 enforces rules relating to potential conflicts of interest of its
102102 employees;
103103 (11) the extent to which the agency complies with
104104 Chapters 551 and 552 and follows records management practices that
105105 enable the agency to respond efficiently to requests for public
106106 information;
107107 (12) the effect of federal intervention or loss of
108108 federal funds if the agency is abolished;
109109 (13) the extent to which the purpose and effectiveness
110110 of reporting requirements imposed on the agency justifies the
111111 continuation of the requirement; and
112112 (14) an assessment of the agency's cybersecurity
113113 practices using confidential information available from the
114114 Department of Information Resources or any other appropriate state
115115 agency.
116116 SECTION 8. (a) Effective January 1, 2026:
117117 (1) the name of the Sunset Advisory Commission is
118118 changed to the Sunset Legislative Initiative for Cost Efficiency
119119 Advisory Commission, and all powers, duties, rights, and
120120 obligations of the Sunset Advisory Commission are the powers,
121121 duties, rights, and obligations of the Sunset Legislative
122122 Initiative for Cost Efficiency Advisory Commission;
123123 (2) a member of the Sunset Advisory Commission is a
124124 member of the Sunset Legislative Initiative for Cost Efficiency
125125 Advisory Commission; and
126126 (3) any appropriation to the Sunset Advisory
127127 Commission is an appropriation to the Sunset Legislative Initiative
128128 for Cost Efficiency Advisory Commission.
129129 (b) Effective January 1, 2026, a reference in law to the
130130 Sunset Advisory Commission is a reference to the Sunset Legislative
131131 Initiative for Cost Efficiency Advisory Commission.
132132 (c) The Sunset Legislative Initiative for Cost Efficiency
133133 Advisory Commission is the successor to the Sunset Advisory
134134 Commission in all respects. All personnel, equipment, data,
135135 documents, facilities, contracts, items, other property, rules,
136136 decisions, and proceedings of or involving the Sunset Advisory
137137 Commission are unaffected by the change in the name of the
138138 commission.
139139 (d) The Sunset Advisory Commission shall adopt a timetable
140140 for phasing in the change of the commission's name so as to minimize
141141 the fiscal impact of the name change. Until January 1, 2026, to
142142 allow for phasing in the change of the commission's name and in
143143 accordance with the timetable established as required by this
144144 section, the commission may perform any act authorized by law for
145145 the Sunset Advisory Commission as the Sunset Advisory Commission or
146146 as the Sunset Legislative Initiative for Cost Efficiency Advisory
147147 Commission. Any act of the Sunset Advisory Commission acting as the
148148 Sunset Legislative Initiative for Cost Efficiency Advisory
149149 Commission on or after the effective date of this Act and before
150150 January 1, 2026, is an act of the Sunset Advisory Commission.
151151 SECTION 9. This Act takes effect September 1, 2025.
