69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the prohibition of short-barrel firearms.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Sections 46.05(a) and (d), Penal Code, are
1114 amended to read as follows:
1215 (a) A person commits an offense if the person intentionally
1316 or knowingly possesses, manufactures, transports, repairs, or
1417 sells:
1518 (1) any of the following items, unless the item is
1619 registered in the National Firearms Registration and Transfer
1720 Record maintained by the Bureau of Alcohol, Tobacco, Firearms and
1821 Explosives or otherwise not subject to that registration
1922 requirement or unless the item is classified as a curio or relic by
2023 the United States Department of Justice:
2124 (A) an explosive weapon; or
2225 (B) a machine gun; [or
2326 [(C) a short-barrel firearm;]
2427 (2) armor-piercing ammunition;
2528 (3) a chemical dispensing device;
2629 (4) a zip gun;
2730 (5) a tire deflation device; or
2831 (6) an improvised explosive device.
2932 (d) It is an affirmative defense to prosecution under this
3033 section that the actor's conduct:
3134 (1) was incidental to dealing with a [short-barrel
3235 firearm or] tire deflation device solely as an antique or curio;
3336 (2) was incidental to dealing with armor-piercing
3437 ammunition solely for the purpose of making the ammunition
3538 available to an organization, agency, or institution listed in
3639 Subsection (b); or
3740 (3) was incidental to dealing with a tire deflation
3841 device solely for the purpose of making the device available to an
3942 organization, agency, or institution listed in Subsection (b).
4043 SECTION 2. Section 46.01(10), Penal Code, is repealed.
4144 SECTION 3. The change in law made by this Act applies only
4245 to an offense committed on or after the effective date of this Act.
4346 An offense committed before the effective date of this Act is
4447 governed by the law in effect on the date the offense was committed,
4548 and the former law is continued in effect for that purpose. For
4649 purposes of this section, an offense was committed before the
4750 effective date of this Act if any element of the offense occurred
4851 before that date.
4952 SECTION 4. This Act takes effect September 1, 2025.
