88 AN ACT
99 relating to the adoption of a mental health leave policy for certain
1010 qualified employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 614.015, Government Code, is amended to
1313 read as follows:
1414 Sec. 614.015. MENTAL HEALTH LEAVE FOR QUALIFIED EMPLOYEES
1515 OF CERTAIN AGENCIES [PEACE OFFICERS AND TELECOMMUNICATORS]. (a)
1616 In this section:
1717 (1) "Peace officer" means an individual described by
1818 Article 2A.001, Code of Criminal Procedure.
1919 (2) "Qualified agency" ["Law enforcement agency"]
2020 means an agency of the state or of a political subdivision of the
2121 state authorized [by law] to employ a peace officer [officers].
2222 (3) "Qualified employee" means:
2323 (A) a peace officer;
2424 (B) a telecommunicator;
2525 (C) a criminal intelligence analyst; or
2626 (D) a crime analyst.
2727 (4) [(2)] "Telecommunicator" means a person
2828 authorized to act as a telecommunicator under Section 1701.405,
2929 Occupations Code.
3030 (b) Each qualified agency [law enforcement agency, and each
3131 agency of the state or of a political subdivision of the state] that
3232 employs a qualified employee [a full-time telecommunicator,] shall
3333 develop and adopt a policy allowing the use of mental health leave
3434 by the qualified employee [peace officers and full-time
3535 telecommunicators, as applicable, employed by the agency] who
3636 experiences [experience] a traumatic event in the scope of that
3737 employment.
3838 (c) A mental health leave policy adopted under this section
3939 must:
4040 (1) provide clear and objective guidelines
4141 establishing the circumstances under which a qualified employee
4242 [peace officer or telecommunicator] is granted and may use mental
4343 health leave;
4444 (2) entitle a qualified employee [peace officer or
4545 telecommunicator] to mental health leave without a deduction in
4646 salary or other compensation;
4747 (3) enumerate the number of mental health leave days
4848 available to a qualified employee [peace officer or
4949 telecommunicator]; and
5050 (4) detail the level of anonymity for a qualified
5151 employee [peace officer or telecommunicator] who takes mental
5252 health leave.
5353 (d) A mental health leave policy adopted under this section
5454 may provide a list of mental health services available to a
5555 qualified employee [peace officers and telecommunicators in the
5656 area of the law enforcement or employing agency].
5757 SECTION 2. As soon as practicable after the effective date
5858 of this Act, each agency required to adopt a mental health leave
5959 policy under Section 614.015, Government Code, as amended by this
6060 Act, shall adopt a mental health leave policy as prescribed by that
6161 section.
6262 SECTION 3. This Act takes effect September 1, 2025.
