88 AN ACT
99 relating to fees assessed by the Lost Pines Groundwater
1010 Conservation District.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 8849.151, Special District Local Laws
1313 Code, is amended to read as follows:
1414 Sec. 8849.151. [PUMPING] FEES. (a) The district may
1515 assess production [regulatory pumping] fees under Section
1616 36.205(c), Water Code, and export fees under Section 36.122, Water
1717 Code [for water produced in or exported from the district].
1818 (b) The production [regulatory pumping] fees the district
1919 assesses for water for crop or livestock production or other
2020 agricultural uses may not exceed 20 percent of the rate applied to
2121 water for municipal uses.
2222 (c) Production [Regulatory pumping] fees [based on the
2323 amount of water withdrawn from a well] may not exceed:
2424 (1) $1 for each acre-foot for water used to irrigate
2525 agricultural crops; or
2626 (2) 17 cents for each thousand gallons for water used
2727 for any other purpose.
2828 [(d) Combined regulatory pumping fees for production and
2929 export of water may not exceed 17 cents for each thousand gallons
3030 for water used.]
3131 SECTION 2. Mitigation payments and fees assessed before the
3232 effective date of this Act are ratified, confirmed, and validated
3333 in all respects.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
