11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 15.7031(c), Water Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (c) The dedication of any surface water rights placed in | |
15 | 15 | trust must be reviewed and approved by the commission, in | |
16 | 16 | consultation with the board and the Parks and Wildlife Department. | |
17 | 17 | In addition, the Department of Agriculture may provide input to the | |
18 | 18 | commission, as appropriate, during the review and approval process | |
19 | 19 | for dedication of surface water rights. The dedication of any | |
20 | 20 | groundwater rights placed in trust must be reviewed and approved by | |
21 | 21 | the board and reviewed and acknowledged by any district or | |
22 | 22 | authority created under Section 52, Article III, or Section 59, | |
23 | 23 | Article XVI, Texas Constitution, that has the authority to regulate | |
24 | 24 | the spacing of water wells, the production from water wells, or both | |
25 | 25 | in the aquifer, subdivision of an aquifer, or geologic stratum | |
26 | 26 | where the groundwater rights are located. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
