77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to funding for full-day prekindergarten programs under the
1010 Foundation School Program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 48.005(a) and (i), Education Code, are
1313 amended to read as follows:
1414 (a) In this chapter, average daily attendance is:
1515 (1) the quotient of the sum of attendance for each day
1616 of the minimum number of days of instruction as described under
1717 Section 25.081(a) divided by the minimum number of days of
1818 instruction;
1919 (2) for a district that operates under a flexible year
2020 program under Section 29.0821, the quotient of the sum of
2121 attendance for each actual day of instruction as permitted by
2222 Section 29.0821(b)(1) divided by the number of actual days of
2323 instruction as permitted by Section 29.0821(b)(1);
2424 (3) for a district that operates under a flexible
2525 school day program under Section 29.0822, the average daily
2626 attendance as calculated by the commissioner in accordance with
2727 Sections 29.0822(d) and (d-1); or
2828 (4) for a district that operates a prekindergarten
2929 [half-day program or a full-day] program under Section 29.153(c):
3030 (A) for a half-day program, one-half of the
3131 average daily attendance calculated under Subdivision (1); or
3232 (B) for a full-day program, the average daily
3333 attendance calculated under Subdivision (1).
3434 (i) A district or a charter school operating under Chapter
3535 12 that operates a half-day prekindergarten program is eligible to
3636 receive one-half of average daily attendance under Subsection (a)
3737 if the district's or charter school's prekindergarten program
3838 provides at least 32,400 minutes of instructional time to students.
3939 SECTION 2. This Act takes effect September 1, 2025.
