| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 48.005(a) and (i), Education Code, are |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) In this chapter, average daily attendance is: |
|---|
| 15 | 15 | | (1) the quotient of the sum of attendance for each day |
|---|
| 16 | 16 | | of the minimum number of days of instruction as described under |
|---|
| 17 | 17 | | Section 25.081(a) divided by the minimum number of days of |
|---|
| 18 | 18 | | instruction; |
|---|
| 19 | 19 | | (2) for a district that operates under a flexible year |
|---|
| 20 | 20 | | program under Section 29.0821, the quotient of the sum of |
|---|
| 21 | 21 | | attendance for each actual day of instruction as permitted by |
|---|
| 22 | 22 | | Section 29.0821(b)(1) divided by the number of actual days of |
|---|
| 23 | 23 | | instruction as permitted by Section 29.0821(b)(1); |
|---|
| 24 | 24 | | (3) for a district that operates under a flexible |
|---|
| 25 | 25 | | school day program under Section 29.0822, the average daily |
|---|
| 26 | 26 | | attendance as calculated by the commissioner in accordance with |
|---|
| 27 | 27 | | Sections 29.0822(d) and (d-1); or |
|---|
| 28 | 28 | | (4) for a district that operates a prekindergarten |
|---|
| 29 | 29 | | [half-day program or a full-day] program under Section 29.153(c): |
|---|
| 30 | 30 | | (A) for a half-day program, one-half of the |
|---|
| 31 | 31 | | average daily attendance calculated under Subdivision (1); or |
|---|
| 32 | 32 | | (B) for a full-day program, the average daily |
|---|
| 33 | 33 | | attendance calculated under Subdivision (1). |
|---|
| 34 | 34 | | (i) A district or a charter school operating under Chapter |
|---|
| 35 | 35 | | 12 that operates a half-day prekindergarten program is eligible to |
|---|
| 36 | 36 | | receive one-half of average daily attendance under Subsection (a) |
|---|
| 37 | 37 | | if the district's or charter school's prekindergarten program |
|---|
| 38 | 38 | | provides at least 32,400 minutes of instructional time to students. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2025. |
