77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of certain co-navigation services to
1010 individuals who are deaf-blind.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 81.001, Human Resources Code, is amended
1313 by adding Subdivision (1) to read as follows:
1414 (1) "Commission" means the Health and Human Services
1515 Commission.
1616 SECTION 2. Chapter 81, Human Resources Code, is amended by
1717 adding Section 81.014 to read as follows:
1818 Sec. 81.014. CO-NAVIGATION SERVICES PROGRAM FOR
1919 INDIVIDUALS WHO ARE DEAF-BLIND. (a) In this section:
2020 (1) "Communication mode" includes communication
2121 through:
2222 (A) auditory amplification, such as through a
2323 personal hearing aid or assistive listening device;
2424 (B) American Sign Language or Signed English by
2525 both tactile and visual means; and
2626 (C) protactile language.
2727 (2) "Co-navigation services" means services provided
2828 to an individual who is deaf-blind that assist the individual to
2929 physically access the individual's environment and to make informed
3030 decisions. The term includes providing visual and environmental
3131 information or sighted guide services and assisting with
3232 communication accessibility by communicating in the preferred
3333 language and communication mode of the individual who is
3434 deaf-blind. The term does not include performing any of the
3535 following for the individual:
3636 (A) providing personal care services to the
3737 individual;
3838 (B) completing ordinary errands for the
3939 individual;
4040 (C) making decisions for the individual;
4141 (D) teaching or otherwise instructing the
4242 individual; or
4343 (E) interpreting for the individual in a formal
4444 setting, including a medical, legal, or business setting.
4545 (3) "Co-navigator" means a person who is specially
4646 trained to provide co-navigation services.
4747 (4) "Program" means the deaf-blind co-navigation
4848 services program.
4949 (5) "Protactile language" means a method of
5050 communication based on touch that is used by individuals who are
5151 deaf-blind.
5252 (b) The commission shall operate a statewide co-navigation
5353 services program through which:
5454 (1) co-navigation services are provided by
5555 co-navigators; and
5656 (2) the commission reimburses the co-navigators for
5757 the provision of the services.
5858 (c) The executive commissioner by rule shall establish
5959 reimbursement rates to be paid to a co-navigator under the program.
6060 The reimbursement rates must use a tiered wage scale that is based
6161 on the co-navigator's:
6262 (1) level of training in communication modes for
6363 individuals who are deaf-blind and in sighted guide-mobility
6464 techniques; and
6565 (2) fluency and skill in communication modes and
6666 sighted guide-mobility for individuals who are deaf-blind.
6767 (d) The commission shall ensure that quality co-navigation
6868 services are provided under the program by:
6969 (1) monitoring the compliance of co-navigators with
7070 program rules;
7171 (2) developing funding sources for the program that
7272 are in addition to state sources and will reduce reliance on the
7373 state sources for continuation of the program; and
7474 (3) providing funding and technical assistance for
7575 training programs for:
7676 (A) co-navigators under the program; and
7777 (B) individuals who are deaf-blind to enable
7878 those individuals to effectively use the services offered under the
7979 program.
8080 (e) The executive commissioner may establish an advisory
8181 committee to advise the commission in developing and operating the
8282 program, including operating the program in a manner that ensures
8383 the efficient use of state money. Subject to Section 2110.002,
8484 Government Code, the executive commissioner shall determine the
8585 number of members serving on the advisory committee, which must
8686 include individuals who are deaf-blind and other stakeholders.
8787 (f) The executive commissioner may adopt rules necessary
8888 to:
8989 (1) operate the program in a manner that is efficient
9090 and maximizes the number of individuals served; and
9191 (2) ensure that co-navigators receiving reimbursement
9292 under the program have adequate training to provide co-navigation
9393 services.
9494 SECTION 3. Not later than September 1, 2026:
9595 (1) the executive commissioner of the Health and Human
9696 Services Commission shall adopt rules necessary to implement
9797 Section 81.014, Human Resources Code, as added by this Act; and
9898 (2) the commission shall begin operating the program
9999 required by that section.
