69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to public information regarding the rates of a
912 transmission and distribution utility.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Subchapter C, Chapter 39, Utilities Code, is
1215 amended by adding Section 39.113 to read as follows:
1316 Sec. 39.113. RATE TRANSPARENCY. (a) A transmission and
1417 distribution utility shall provide with each statement of intent to
1518 change rates filed under Chapter 36, and any other filing made with
1619 a regulatory authority under this subtitle regarding a change in
1720 the utility's rates, a stand-alone document that shows:
1821 (1) the change in rate that the filing would apply to
1922 each rate class;
2023 (2) the time period during which the proposed change
2124 will be in effect;
2225 (3) for a base rate increase, the anticipated total
2326 amount of revenue the utility will receive from the increase during
2427 the four-year period following the proposed implementation date of
2528 the change;
2629 (4) for a change other than a base rate change, the
2730 anticipated total amount of revenue the utility will receive from
2831 the change during the period in which the change is in effect;
2932 (5) the delivery charges being imposed by the utility
3033 at the time of the filing for an average residential customer;
3134 (6) the anticipated delivery charges that would be
3235 imposed by the utility for an average residential customer after
3336 the change; and
3437 (7) the difference between the amounts shown under
3538 Subdivisions (5) and (6).
3639 (b) The commission shall require the document required by
3740 Subsection (a) to be filed in a format easily understood by the
3841 public.
3942 (c) If the regulatory authority proposes to enter an order
4043 approving a change in rates described by Subsection (a) that
4144 differs from the change initially proposed by the transmission and
4245 distribution utility, the regulatory authority shall require the
4346 utility to provide to the regulatory authority a new stand-alone
4447 document that includes the information required by Subsection (a)
4548 for the proposed change.
4649 (d) The commission shall provide, and update at least
4750 monthly, on the commission's Internet website or the commission's
4851 Power to Choose Internet website information on the rates of
4952 transmission and distribution utilities in a format easily
5053 understood by the public.
5154 SECTION 2. The changes in law made by this Act apply only to
5255 a proceeding before the Public Utility Commission of Texas or other
5356 regulatory authority described by Section 11.003, Utilities Code,
5457 that commences on or after the effective date of this Act. A
5558 proceeding before the Public Utility Commission of Texas or other
5659 regulatory authority described by Section 11.003, Utilities Code,
5760 that commenced before the effective date of this Act is governed by
5861 the law in effect on the date the proceeding commenced, and that law
5962 is continued in effect for that purpose.
6063 SECTION 3. This Act takes effect September 1, 2025.
