10 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 14 | | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is |
---|
12 | 15 | | amended by adding Section 39.113 to read as follows: |
---|
13 | 16 | | Sec. 39.113. RATE TRANSPARENCY. (a) A transmission and |
---|
14 | 17 | | distribution utility shall provide with each statement of intent to |
---|
15 | 18 | | change rates filed under Chapter 36, and any other filing made with |
---|
16 | 19 | | a regulatory authority under this subtitle regarding a change in |
---|
17 | 20 | | the utility's rates, a stand-alone document that shows: |
---|
18 | 21 | | (1) the change in rate that the filing would apply to |
---|
19 | 22 | | each rate class; |
---|
20 | 23 | | (2) the time period during which the proposed change |
---|
21 | 24 | | will be in effect; |
---|
22 | 25 | | (3) for a base rate increase, the anticipated total |
---|
23 | 26 | | amount of revenue the utility will receive from the increase during |
---|
24 | 27 | | the four-year period following the proposed implementation date of |
---|
25 | 28 | | the change; |
---|
26 | 29 | | (4) for a change other than a base rate change, the |
---|
27 | 30 | | anticipated total amount of revenue the utility will receive from |
---|
28 | 31 | | the change during the period in which the change is in effect; |
---|
29 | 32 | | (5) the delivery charges being imposed by the utility |
---|
30 | 33 | | at the time of the filing for an average residential customer; |
---|
31 | 34 | | (6) the anticipated delivery charges that would be |
---|
32 | 35 | | imposed by the utility for an average residential customer after |
---|
33 | 36 | | the change; and |
---|
34 | 37 | | (7) the difference between the amounts shown under |
---|
35 | 38 | | Subdivisions (5) and (6). |
---|
36 | 39 | | (b) The commission shall require the document required by |
---|
37 | 40 | | Subsection (a) to be filed in a format easily understood by the |
---|
38 | 41 | | public. |
---|
39 | 42 | | (c) If the regulatory authority proposes to enter an order |
---|
40 | 43 | | approving a change in rates described by Subsection (a) that |
---|
41 | 44 | | differs from the change initially proposed by the transmission and |
---|
42 | 45 | | distribution utility, the regulatory authority shall require the |
---|
43 | 46 | | utility to provide to the regulatory authority a new stand-alone |
---|
44 | 47 | | document that includes the information required by Subsection (a) |
---|
45 | 48 | | for the proposed change. |
---|
46 | 49 | | (d) The commission shall provide, and update at least |
---|
47 | 50 | | monthly, on the commission's Internet website or the commission's |
---|
48 | 51 | | Power to Choose Internet website information on the rates of |
---|
49 | 52 | | transmission and distribution utilities in a format easily |
---|
50 | 53 | | understood by the public. |
---|
51 | 54 | | SECTION 2. The changes in law made by this Act apply only to |
---|
52 | 55 | | a proceeding before the Public Utility Commission of Texas or other |
---|
53 | 56 | | regulatory authority described by Section 11.003, Utilities Code, |
---|
54 | 57 | | that commences on or after the effective date of this Act. A |
---|
55 | 58 | | proceeding before the Public Utility Commission of Texas or other |
---|
56 | 59 | | regulatory authority described by Section 11.003, Utilities Code, |
---|
57 | 60 | | that commenced before the effective date of this Act is governed by |
---|
58 | 61 | | the law in effect on the date the proceeding commenced, and that law |
---|
59 | 62 | | is continued in effect for that purpose. |
---|
60 | 63 | | SECTION 3. This Act takes effect September 1, 2025. |
