613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the payment of restitution.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Section 493.035, Government Code, is amended by
1118 adding Subsections (c-1), (c-2), and (c-3) to read as follows:
1219 (c-1) The department shall transfer to the clerk of the
1320 court that entered an order of restitution for which the department
1421 received notice as described by Subsection (c)(1) a restitution
1522 payment derived from unclaimed property for which a claim was filed
1623 by the department as described by Subsection (a). The department
1724 shall include with the restitution payment the last known address
1825 of the victim available to the department, if any.
1926 (c-2) The department shall post on the department's
2027 Internet website the contact information for a department employee
2128 who is able to respond to inquiries from county officials regarding
2229 a transferred restitution payment.
2330 (c-3) Information provided to the clerk of a court under
2431 Subsection (c-1) is confidential and not subject to disclosure
2532 under Chapter 552.
2633 SECTION 2. Section 508.322, Government Code, is amended by
2734 amending Subsections (c) and (e) and adding Subsection (c-3) to
2835 read as follows:
2936 (c) When a parole panel orders the payment of restitution
3037 from a releasee as provided by Article 42.037(h), Code of Criminal
3138 Procedure, the department shall:
3239 (1) collect the payment for disbursement to the
3340 victim;
3441 (2) deposit the payment in the releasee restitution
3542 fund; [and]
3643 (3) transmit the payment to the clerk of the court that
3744 entered the order of restitution as soon as practicable for the
3845 clerk to remit the payment to the victim; and
3946 (4) provide at the time the payment is transmitted
4047 under Subdivision (3) to the clerk of the court that entered the
4148 order of restitution the last known address of the victim available
4249 to the department, if any.
4350 (c-3) Information provided to the clerk of a court under
4451 Subsection (c)(4) is confidential and not subject to disclosure
4552 under Chapter 552.
4653 (e) If a victim who is entitled to restitution does not make
4754 a claim for payment before the third [fifth] anniversary of the date
4855 the clerk of the court receives the initial restitution payment or
4956 if, after the victim makes a claim for payment, the clerk is unable
5057 to locate the victim for a period of three [five] years after the
5158 date the clerk last made a payment to the victim, any unclaimed
5259 restitution payments being held by the clerk for payment to the
5360 victim are presumed abandoned. The clerk of the court shall report
5461 and deliver to the comptroller all unclaimed restitution payments
5562 presumed abandoned under this section in the manner provided by
5663 Chapter 77, Property Code.
5764 SECTION 3. This Act takes effect September 1, 2025.
