9 | 9 | | relating to an allotment for public school students who require |
---|
10 | 10 | | significant resources under the Foundation School Program and the |
---|
11 | 11 | | composition of a school district's threat assessment and safe and |
---|
12 | 12 | | supportive school team. |
---|
13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
14 | 14 | | SECTION 1. Section 37.115(d), Education Code, is amended to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (d) The superintendent of the district shall ensure, to the |
---|
17 | 17 | | greatest extent practicable, that the members appointed to each |
---|
18 | 18 | | team have expertise in counseling, behavior management, mental |
---|
19 | 19 | | health and substance use, classroom instruction, special |
---|
20 | 20 | | education, school administration, school safety and security, |
---|
21 | 21 | | emergency management, and law enforcement. Each team must include |
---|
22 | 22 | | at least one mental health professional or behavior specialist. A |
---|
23 | 23 | | team may serve more than one campus of a school district, provided |
---|
24 | 24 | | that each district campus is assigned a team. |
---|
25 | 25 | | SECTION 2. Subchapter G, Chapter 48, Education Code, is |
---|
26 | 26 | | amended by adding Section 48.317 to read as follows: |
---|
27 | 27 | | Sec. 48.317. ALLOTMENT FOR STUDENTS REQUIRING SIGNIFICANT |
---|
28 | 28 | | RESOURCES. (a) A school district is entitled to an allotment for a |
---|
29 | 29 | | student enrolled in the district who requires significant resources |
---|
30 | 30 | | if the district provides to the commissioner evidence of the |
---|
31 | 31 | | district's attempts to serve the student through an increasingly |
---|
32 | 32 | | intense intervention strategy approved by the agency, including: |
---|
33 | 33 | | (1) documented attempts to develop a behavior |
---|
34 | 34 | | improvement plan or behavioral intervention plan for the student; |
---|
35 | 35 | | and |
---|
36 | 36 | | (2) documented efforts at parental engagement. |
---|
37 | 37 | | (b) The amount of an allotment for each student described by |
---|
38 | 38 | | Subsection (a) is an amount equal to 75 percent of the total costs |
---|
39 | 39 | | associated with serving that student. |
---|
40 | 40 | | (c) Not later than June 1 of each year, the commissioner |
---|
41 | 41 | | shall post on the agency's Internet website de-identified |
---|
42 | 42 | | information regarding allotments received by school districts |
---|
43 | 43 | | under this section during the preceding school year, including: |
---|
44 | 44 | | (1) the number of students for whom districts received |
---|
45 | 45 | | allotments; |
---|
46 | 46 | | (2) the types of interventions attempted by districts |
---|
47 | 47 | | to serve students for whom allotments were received; and |
---|
48 | 48 | | (3) the education service center regions in which |
---|
49 | 49 | | students for whom districts received allotments reside. |
---|
50 | 50 | | SECTION 3. Section 37.115(d), Education Code, as amended by |
---|
51 | 51 | | this Act, applies beginning with the 2025-2026 school year. |
---|
52 | 52 | | SECTION 4. (a) Except as provided by Subsection (b) of this |
---|
53 | 53 | | section, this Act takes effect immediately if it receives a vote of |
---|
54 | 54 | | two-thirds of all the members elected to each house, as provided by |
---|
55 | 55 | | Section 39, Article III, Texas Constitution. If this Act does not |
---|
56 | 56 | | receive the vote necessary for immediate effect, this Act takes |
---|
57 | 57 | | effect September 1, 2025. |
---|
58 | 58 | | (b) Section 48.317, Education Code, as added by this Act, |
---|
59 | 59 | | takes effect September 1, 2025. |
