77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an allotment for public school students who require
1010 significant resources under the Foundation School Program and the
1111 composition of a school district's threat assessment and safe and
1212 supportive school team.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 37.115(d), Education Code, is amended to
1515 read as follows:
1616 (d) The superintendent of the district shall ensure, to the
1717 greatest extent practicable, that the members appointed to each
1818 team have expertise in counseling, behavior management, mental
1919 health and substance use, classroom instruction, special
2020 education, school administration, school safety and security,
2121 emergency management, and law enforcement. Each team must include
2222 at least one mental health professional or behavior specialist. A
2323 team may serve more than one campus of a school district, provided
2424 that each district campus is assigned a team.
2525 SECTION 2. Subchapter G, Chapter 48, Education Code, is
2626 amended by adding Section 48.317 to read as follows:
2727 Sec. 48.317. ALLOTMENT FOR STUDENTS REQUIRING SIGNIFICANT
2828 RESOURCES. (a) A school district is entitled to an allotment for a
2929 student enrolled in the district who requires significant resources
3030 if the district provides to the commissioner evidence of the
3131 district's attempts to serve the student through an increasingly
3232 intense intervention strategy approved by the agency, including:
3333 (1) documented attempts to develop a behavior
3434 improvement plan or behavioral intervention plan for the student;
3535 and
3636 (2) documented efforts at parental engagement.
3737 (b) The amount of an allotment for each student described by
3838 Subsection (a) is an amount equal to 75 percent of the total costs
3939 associated with serving that student.
4040 (c) Not later than June 1 of each year, the commissioner
4141 shall post on the agency's Internet website de-identified
4242 information regarding allotments received by school districts
4343 under this section during the preceding school year, including:
4444 (1) the number of students for whom districts received
4545 allotments;
4646 (2) the types of interventions attempted by districts
4747 to serve students for whom allotments were received; and
4848 (3) the education service center regions in which
4949 students for whom districts received allotments reside.
5050 SECTION 3. Section 37.115(d), Education Code, as amended by
5151 this Act, applies beginning with the 2025-2026 school year.
5252 SECTION 4. (a) Except as provided by Subsection (b) of this
5353 section, this Act takes effect immediately if it receives a vote of
5454 two-thirds of all the members elected to each house, as provided by
5555 Section 39, Article III, Texas Constitution. If this Act does not
5656 receive the vote necessary for immediate effect, this Act takes
5757 effect September 1, 2025.
5858 (b) Section 48.317, Education Code, as added by this Act,
5959 takes effect September 1, 2025.
