88 AN ACT
99 relating to unprofessional conduct by mental health providers who
1010 attempt to change the sexual orientation of a child.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 105, Occupations Code, is
1313 amended to read as follows:
1414 CHAPTER 105. UNPROFESSIONAL CONDUCT BY CERTAIN PROVIDERS [HEALTH
1515 CARE PROVIDER]
1616 SECTION 2. Chapter 105, Occupations Code, is amended by
1717 designating Sections 105.001 and 105.002 as Subchapter A and adding
1818 a subchapter heading to read as follows:
1919 SUBCHAPTER A. UNPROFESSIONAL CONDUCT BY HEALTH CARE PROVIDER
2020 SECTION 3. Section 105.001, Occupations Code, is amended to
2121 read as follows:
2222 Sec. 105.001. DEFINITION. In this subchapter [chapter],
2323 "health care provider" means a person who furnishes services under
2424 a license, certificate, registration, or other authority issued by
2525 this state or another state to diagnose, prevent, alleviate, or
2626 cure a human illness or injury.
2727 SECTION 4. Chapter 105, Occupations Code, is amended by
2828 adding Subchapter B to read as follows:
2929 SUBCHAPTER B. UNPROFESSIONAL CONDUCT BY MENTAL HEALTH PROVIDER
3030 Sec. 105.051. DEFINITIONS. In this subchapter:
3131 (1) "Child" means an individual younger than 18 years
3232 of age.
3333 (2) "Gender identity or expression" means an
3434 individual's having, or being perceived as having, a gender-related
3535 identity, appearance, expression, or behavior, whether or not that
3636 identity, appearance, expression, or behavior is different from
3737 that commonly associated with the individual's assigned sex at
3838 birth.
3939 (3) "Mental health provider" means:
4040 (A) a behavior analyst licensed under Chapter
4141 506;
4242 (B) a chemical dependency counselor licensed
4343 under Chapter 504;
4444 (C) a licensed professional counselor licensed
4545 under Chapter 503;
4646 (D) a marriage and family therapist licensed
4747 under Chapter 502;
4848 (E) a nurse licensed under Chapter 301;
4949 (F) a physician licensed under Subtitle B;
5050 (G) a psychologist licensed under Chapter 501;
5151 (H) a sex offender treatment provider licensed
5252 under Chapter 110;
5353 (I) a social worker licensed under Chapter 505;
5454 (J) a special officer for offenders with mental
5555 impairments certified under Section 1701.404; or
5656 (K) another individual licensed by this state to
5757 provide professional therapy or counseling services.
5858 (4) "Sexual orientation" means the actual or perceived
5959 status of an individual with respect to the individual's sexuality.
6060 Sec. 105.052. UNPROFESSIONAL CONDUCT. (a) A mental health
6161 provider engages in unprofessional conduct if, in the course of
6262 providing services to a child, the mental health provider attempts
6363 to:
6464 (1) change the child's sexual orientation, including
6565 by attempting to change the child's behavior or gender identity or
6666 expression; or
6767 (2) eliminate or reduce the child's sexual or romantic
6868 attractions or feelings toward individuals of the same sex.
6969 (b) Subsection (a) does not apply to counseling that:
7070 (1) provides acceptance, support, and understanding
7171 of a child or facilitates a child's coping, social support, and
7272 identity exploration and development, including sexual
7373 orientation-neutral interventions to prevent or address unlawful
7474 conduct or unsafe sexual practices, if that counseling does not
7575 seek to change sexual orientation or gender identity or expression;
7676 or
7777 (2) provides support to a child undergoing gender
7878 transition in accordance with established standards of care.
7979 (c) A mental health provider who commits unprofessional
8080 conduct under Subsection (a) is subject to disciplinary action by
8181 any state regulatory entity with the power to take disciplinary
8282 action against that mental health provider.
8383 SECTION 5. This Act takes effect September 1, 2025.
