77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to exceptions to and the repeal of certain laws
1010 prohibiting abortion.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 170A.002, Health and Safety Code, is
1313 amended by adding Subsection (b-1) to read as follows:
1414 (b-1) It is an exception to the application of Subsection
1515 (a) that:
1616 (1) in the exercise of reasonable medical judgment, a
1717 physician determines the abortion is necessary to prevent future
1818 infertility of the pregnant individual or because the pregnancy is
1919 not viable; or
2020 (2) the pregnancy resulted from sexual assault in
2121 violation of Section 22.011, Penal Code, aggravated sexual assault
2222 in violation of Section 22.021, Penal Code, or conduct constituting
2323 an offense under Section 25.02, Penal Code.
2424 SECTION 2. The heading to Section 171.205, Health and
2525 Safety Code, is amended to read as follows:
2626 Sec. 171.205. EXCEPTIONS [EXCEPTION FOR MEDICAL
2727 EMERGENCY]; RECORDS.
2828 SECTION 3. Section 171.205, Health and Safety Code, is
2929 amended by adding Subsection (a-1) to read as follows:
3030 (a-1) Sections 171.203 and 171.204 do not apply to an
3131 abortion performed or induced by a person in accordance with an
3232 exception provided by Section 170A.002.
3333 SECTION 4. Section 171.206(b), Health and Safety Code, is
3434 amended to read as follows:
3535 (b) This subchapter may not be construed to:
3636 (1) authorize the initiation of a cause of action
3737 against or the prosecution of a woman on whom an abortion is
3838 performed or induced or attempted to be performed or induced in
3939 violation of this subchapter;
4040 (2) wholly or partly repeal, either expressly or by
4141 implication, any other statute that regulates or prohibits
4242 abortion[, including Chapter 6-1/2, Title 71, Revised Statutes]; or
4343 (3) restrict a political subdivision from regulating
4444 or prohibiting abortion in a manner that is at least as stringent as
4545 the laws of this state.
4646 SECTION 5. Section 171.207(b), Health and Safety Code, is
4747 amended to read as follows:
4848 (b) Subsection (a) may not be construed to:
4949 (1) legalize the conduct prohibited by this subchapter
5050 [or by Chapter 6-1/2, Title 71, Revised Statutes];
5151 (2) limit in any way or affect the availability of a
5252 remedy established by Section 171.208; or
5353 (3) limit the enforceability of any other laws that
5454 regulate or prohibit abortion.
5555 SECTION 6. Chapter 6-1/2, Title 71, Revised Statutes, is
5656 repealed.
5757 SECTION 7. This Act takes effect September 1, 2025.
