11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 39.1592(a), Utilities Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (a) This section applies only to an electric generation |
---|
15 | 15 | | facility in the ERCOT power region for which a standard generator |
---|
16 | 16 | | interconnection agreement is signed on or after September 1, 2025 |
---|
17 | 17 | | [January 1, 2027, that has been in operation for at least one year], |
---|
18 | 18 | | and that is not a self-generator. |
---|
19 | 19 | | SECTION 2. Subchapter D, Chapter 39, Utilities Code, is |
---|
20 | 20 | | amended by adding Section 39.1596 to read as follows: |
---|
21 | 21 | | Sec. 39.1596. LIMITATION ON WIND AND SOLAR GENERATION |
---|
22 | 22 | | CAPACITY. (a) This section applies only to an electric generation |
---|
23 | 23 | | facility that: |
---|
24 | 24 | | (1) exclusively relies on an energy source derived |
---|
25 | 25 | | from wind or the sun; and |
---|
26 | 26 | | (2) is subject to a standard generator interconnection |
---|
27 | 27 | | agreement. |
---|
28 | 28 | | (b) Not later than January 1, 2029, the commission shall |
---|
29 | 29 | | determine whether the installed generation capacity from the |
---|
30 | 30 | | electric generation facilities described by Subsection (a) is |
---|
31 | 31 | | contributing more than 35 percent of the available generation |
---|
32 | 32 | | capacity for the ERCOT power region at any time. |
---|
33 | 33 | | (c) If the commission determines the installed generation |
---|
34 | 34 | | capacity described by Subsection (b) contributes more than 35 |
---|
35 | 35 | | percent of the available generation capacity for the ERCOT power |
---|
36 | 36 | | region at any time, the commission shall by rule establish a program |
---|
37 | 37 | | to require disconnection from the power grid of electric generation |
---|
38 | 38 | | facilities as provided by this subsection. The program must: |
---|
39 | 39 | | (1) require the disconnection from the power grid of |
---|
40 | 40 | | only facilities for which a standard generator interconnection |
---|
41 | 41 | | agreement was signed before September 1, 2025; and |
---|
42 | 42 | | (2) establish a goal of reducing the installed |
---|
43 | 43 | | generation capacity from facilities for which a standard generator |
---|
44 | 44 | | interconnection agreement was signed before September 1, 2025, so |
---|
45 | 45 | | that the installed capacity from all electric generation facilities |
---|
46 | 46 | | exclusively relying on an energy source derived from wind or the sun |
---|
47 | 47 | | contributes 35 percent or less of the available generation capacity |
---|
48 | 48 | | for the ERCOT power region at any time. |
---|
49 | 49 | | (d) After completion of the program required under |
---|
50 | 50 | | Subsection (c), the commission may allow the installation of new |
---|
51 | 51 | | generation capacity from an electric generation facility described |
---|
52 | 52 | | by Subsection (a), regardless of the goal described by Subsection |
---|
53 | 53 | | (c)(2), if the facility complies with Section 39.1592. |
---|
54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2025. |
