88 AN ACT
99 relating to a limitation on wind and solar installed generation
1010 capacity in the ERCOT power region.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.1592(a), Utilities Code, is amended
1313 to read as follows:
1414 (a) This section applies only to an electric generation
1515 facility in the ERCOT power region for which a standard generator
1616 interconnection agreement is signed on or after September 1, 2025
1717 [January 1, 2027, that has been in operation for at least one year],
1818 and that is not a self-generator.
1919 SECTION 2. Subchapter D, Chapter 39, Utilities Code, is
2020 amended by adding Section 39.1596 to read as follows:
2121 Sec. 39.1596. LIMITATION ON WIND AND SOLAR GENERATION
2222 CAPACITY. (a) This section applies only to an electric generation
2323 facility that:
2424 (1) exclusively relies on an energy source derived
2525 from wind or the sun; and
2626 (2) is subject to a standard generator interconnection
2727 agreement.
2828 (b) Not later than January 1, 2029, the commission shall
2929 determine whether the installed generation capacity from the
3030 electric generation facilities described by Subsection (a) is
3131 contributing more than 35 percent of the available generation
3232 capacity for the ERCOT power region at any time.
3333 (c) If the commission determines the installed generation
3434 capacity described by Subsection (b) contributes more than 35
3535 percent of the available generation capacity for the ERCOT power
3636 region at any time, the commission shall by rule establish a program
3737 to require disconnection from the power grid of electric generation
3838 facilities as provided by this subsection. The program must:
3939 (1) require the disconnection from the power grid of
4040 only facilities for which a standard generator interconnection
4141 agreement was signed before September 1, 2025; and
4242 (2) establish a goal of reducing the installed
4343 generation capacity from facilities for which a standard generator
4444 interconnection agreement was signed before September 1, 2025, so
4545 that the installed capacity from all electric generation facilities
4646 exclusively relying on an energy source derived from wind or the sun
4747 contributes 35 percent or less of the available generation capacity
4848 for the ERCOT power region at any time.
4949 (d) After completion of the program required under
5050 Subsection (c), the commission may allow the installation of new
5151 generation capacity from an electric generation facility described
5252 by Subsection (a), regardless of the goal described by Subsection
5353 (c)(2), if the facility complies with Section 39.1592.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2025.
