77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the source of power for stations and other equipment
1010 used to dispense energy to electric vehicles.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 2311, Occupations Code, as added by
1313 Chapter 211 (S.B. 1732), Acts of the 88th Legislature, Regular
1414 Session, 2023, is redesignated as Chapter 2311A, Occupations Code,
1515 and amended to read as follows:
1616 CHAPTER 2311A [2311]. ELECTRIC VEHICLE CHARGING STATIONS
1717 Sec. 2311A.001 [2311.001]. ELECTRIC VEHICLE CHARGING
1818 STATION STANDARDS. (a) This section applies only to an electric
1919 vehicle charging station that is:
2020 (1) installed after December 1, 2024;
2121 (2) made available to the public;
2222 (3) not intended primarily for private use; and
2323 (4) funded through public grants or state rebate
2424 programs.
2525 (b) The Texas Department of Licensing and Regulation, in
2626 consultation with the Texas Department of Transportation, shall
2727 adopt standards for electric vehicle charging stations that require
2828 the charging stations to be:
2929 (1) equipped with a standard electric vehicle charging
3030 connector or plug type that is widely compatible with as many
3131 electric vehicles as practicable; and
3232 (2) powered only by renewable energy sources.
3333 SECTION 2. Section 2311.0301, Occupations Code, is amended
3434 to read as follows:
3535 Sec. 2311.0301. DUTIES OF ELECTRIC VEHICLE SUPPLY PROVIDER.
3636 Unless electric vehicle supply equipment is exempt from the
3737 application of this chapter or has been removed from service, an
3838 electric vehicle supply provider shall:
3939 (1) have electric vehicle supply equipment inspected
4040 as prescribed by commission rule; [and]
4141 (2) maintain electric vehicle supply equipment in
4242 compliance with maintenance specifications, this chapter, and
4343 commission rule; and
4444 (3) ensure that the electric vehicle supply equipment
4545 is powered only by renewable energy sources.
4646 SECTION 3. To the extent of any conflict, this Act prevails
4747 over another Act of the 89th Legislature, Regular Session, 2025,
4848 relating to nonsubstantive additions to and corrections in enacted
4949 codes.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
