11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 2311, Occupations Code, as added by |
---|
13 | 13 | | Chapter 211 (S.B. 1732), Acts of the 88th Legislature, Regular |
---|
14 | 14 | | Session, 2023, is redesignated as Chapter 2311A, Occupations Code, |
---|
15 | 15 | | and amended to read as follows: |
---|
16 | 16 | | CHAPTER 2311A [2311]. ELECTRIC VEHICLE CHARGING STATIONS |
---|
17 | 17 | | Sec. 2311A.001 [2311.001]. ELECTRIC VEHICLE CHARGING |
---|
18 | 18 | | STATION STANDARDS. (a) This section applies only to an electric |
---|
19 | 19 | | vehicle charging station that is: |
---|
20 | 20 | | (1) installed after December 1, 2024; |
---|
21 | 21 | | (2) made available to the public; |
---|
22 | 22 | | (3) not intended primarily for private use; and |
---|
23 | 23 | | (4) funded through public grants or state rebate |
---|
24 | 24 | | programs. |
---|
25 | 25 | | (b) The Texas Department of Licensing and Regulation, in |
---|
26 | 26 | | consultation with the Texas Department of Transportation, shall |
---|
27 | 27 | | adopt standards for electric vehicle charging stations that require |
---|
28 | 28 | | the charging stations to be: |
---|
29 | 29 | | (1) equipped with a standard electric vehicle charging |
---|
30 | 30 | | connector or plug type that is widely compatible with as many |
---|
31 | 31 | | electric vehicles as practicable; and |
---|
32 | 32 | | (2) powered only by renewable energy sources. |
---|
33 | 33 | | SECTION 2. Section 2311.0301, Occupations Code, is amended |
---|
34 | 34 | | to read as follows: |
---|
35 | 35 | | Sec. 2311.0301. DUTIES OF ELECTRIC VEHICLE SUPPLY PROVIDER. |
---|
36 | 36 | | Unless electric vehicle supply equipment is exempt from the |
---|
37 | 37 | | application of this chapter or has been removed from service, an |
---|
38 | 38 | | electric vehicle supply provider shall: |
---|
39 | 39 | | (1) have electric vehicle supply equipment inspected |
---|
40 | 40 | | as prescribed by commission rule; [and] |
---|
41 | 41 | | (2) maintain electric vehicle supply equipment in |
---|
42 | 42 | | compliance with maintenance specifications, this chapter, and |
---|
43 | 43 | | commission rule; and |
---|
44 | 44 | | (3) ensure that the electric vehicle supply equipment |
---|
45 | 45 | | is powered only by renewable energy sources. |
---|
46 | 46 | | SECTION 3. To the extent of any conflict, this Act prevails |
---|
47 | 47 | | over another Act of the 89th Legislature, Regular Session, 2025, |
---|
48 | 48 | | relating to nonsubstantive additions to and corrections in enacted |
---|
49 | 49 | | codes. |
---|
50 | 50 | | SECTION 4. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2025. |
