77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the artificial intelligence division within the
1010 Department of Information Resources.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 2054, Government Code, is amended by
1313 adding Subchapter S to read as follows:
1414 SUBCHAPTER S. ARTIFICIAL INTELLIGENCE DIVISION
1515 Sec. 2054.701. ESTABLISHMENT AND ADMINISTRATION OF
1616 DIVISION. (a) The department shall establish an artificial
1717 intelligence division within the department.
1818 (b) The executive director shall direct the administration
1919 and oversight of the artificial intelligence division, including
2020 the division's organization within the department.
2121 (c) The department may hire the personnel necessary to
2222 administer the duties of the division, including hiring personnel
2323 through institutions of higher education, as defined by Section
2424 61.003, Education Code.
2525 Sec. 2054.702. GENERATIVE ARTIFICIAL INTELLIGENCE
2626 TECHNOLOGY. (a) The division shall assist state agencies and other
2727 entities that use the department's services in the implementation
2828 of generative artificial intelligence technology for:
2929 (1) projects to modernize or replace legacy systems,
3030 as defined by Section 2054.571; and
3131 (2) other projects appropriate for the use of
3232 generative artificial intelligence technology as determined by the
3333 department.
3434 (b) In assisting agencies and entities with projects under
3535 Subsection (a), the division may:
3636 (1) use generative artificial intelligence technology
3737 developed or procured by the department to complete the project; or
3838 (2) contract with a vendor to use generative
3939 artificial intelligence technology to complete the project.
4040 (c) If the division contracts with a vendor under Subsection
4141 (b), the vendor's generative artificial intelligence technology
4242 must complete at least 90 percent of the work required to complete
4343 the contract.
4444 Sec. 2054.703. COST ANALYSIS REPORT. The division shall
4545 prepare a cost analysis report for each project completed under
4646 Section 2054.702 that includes:
4747 (1) a summary of the time, money, and resources saved
4848 by using a generative artificial intelligence technology compared
4949 to the time, money, and resources that would have been required
5050 using traditional systems to perform equivalent tasks; and
5151 (2) a concise overview focused on information
5252 demonstrating the cost efficiencies achieved by using generative
5353 artificial intelligence technology, such as the amount of time and
5454 money saved in the procurement process.
5555 Sec. 2054.704. RULES. The department may adopt the rules
5656 necessary to establish and administer the division.
5757 SECTION 2. As soon as practicable after the effective date
5858 of this Act, the Department of Information Resources shall adopt
5959 the rules necessary to implement Subchapter S, Chapter 2054,
6060 Government Code, as added by this Act.
6161 SECTION 3. This Act takes effect September 1, 2025.
