11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 12.104(b), Education Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (b) An open-enrollment charter school is subject to: |

15 | 15 | | (1) a provision of this title establishing a criminal |

16 | 16 | | offense; |
---|

81 | 81 | | SECTION 2. Chapter 26, Education Code, is amended by adding |
---|
82 | 82 | | Section 26.017 to read as follows: |
---|
83 | 83 | | Sec. 26.017. NOTICE REGARDING SCHOOL LIBRARY MATERIALS. |
---|
84 | 84 | | (a) Except as provided by Subsection (b), a school district shall |
---|
85 | 85 | | notify a parent of each child enrolled in the district by e-mail |
---|
86 | 86 | | each time the parent's child obtains a school library material from |
---|
87 | 87 | | a school library in the district. The notice must include the title |
---|
88 | 88 | | and author of the school library material. |
---|
89 | 89 | | (b) Before each school year, a school district shall provide |
---|
90 | 90 | | written notice to a parent of each child enrolled in the district |
---|
91 | 91 | | regarding the option to submit a written or electronic request to |
---|
92 | 92 | | opt out of the notifications required under Subsection (a). |
---|
93 | 93 | | (c) A school district shall: |
---|
94 | 94 | | (1) maintain a current list of parents to be notified |
---|
95 | 95 | | under Subsection (a); and |
---|
96 | 96 | | (2) promptly process opt-out requests under |
---|
97 | 97 | | Subsection (b). |
---|
98 | 98 | | SECTION 3. This Act applies beginning with the 2025-2026 |
---|
99 | 99 | | school year. |
---|
100 | 100 | | SECTION 4. This Act takes effect immediately if it receives |
---|
101 | 101 | | a vote of two-thirds of all the members elected to each house, as |
---|
102 | 102 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
103 | 103 | | Act does not receive the vote necessary for immediate effect, this |
---|
104 | 104 | | Act takes effect September 1, 2025. |
