88 relating to prohibiting 3D-printed firearms; creating an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.132, Penal Code, is amended by to read
1111 as follows:
1212 Sec. 46.132. PROHIBITION ON 3D-PRINTED FIREARMS. (a) In
1313 this section:
1414 (1) "3D-printed firearm" means a firearm, or any major
1515 component of a firearm, that is produced by a three-dimensional
1616 printing process, regardless of the material used.
1717 (2) "Digital firearm schematic" means any
1818 computer-aided design (CAD) file or other digital instruction
1919 designed for the production of a firearm or major firearm component
2020 using additive manufacturing or 3D-printing technology.
2121 (b) A person may not manufacture, sell, transfer, or possess
2222 a 3D-printed firearm in the State of Texas.
2323 (c) A person may not distribute, publish, or otherwise make
2424 available any digital firearm schematic to another person in Texas
2525 with the intent of facilitating the production of a firearm using a
2626 3D printer or similar technology.
2727 (d) This section does not apply to:
2828 (1) A state or federal law enforcement agency or an
2929 employee thereof acting within the scope of their official duties.
3030 (2) A licensed firearms manufacturer producing
3131 firearms using additive manufacturing techniques in compliance
3232 with federal and state laws.
3333 (3) Research institutions conducting studies on
3434 3D-printing technology under approval from the Texas Department of
3535 Public Safety.
3636 (e) A person who violates subsection (b) commits a felony of
3737 the third degree. A person who violates subsection (c) commits a
3838 Class A misdemeanor.
3939 SECTION 2. Section 46.132, Penal Code, as amended by this
4040 Act, applies only to an offense committed on or after the effective
4141 date of this Act. An offense committed before the effective date of
4242 this Act is governed by the law in effect on the date the offense was
4343 committed, and the former law is continued in effect for that
4444 purpose. For purposes of this section, an offense was committed
4545 before the effective date of this Act if any element of the offense
4646 occurred before that date.
