86 AN ACT
97 relating to the establishment of a rapid DNA analysis pilot program
108 in certain counties.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter G, Chapter 411, Government Code, is
1311 amended by adding Section 411.1465 to read as follows:
1412 Sec. 411.1465. RAPID DNA ANALYSIS PILOT PROGRAM. (a) In
1513 this section, "rapid DNA analysis" means the fully automated
1614 processing of a reference buccal swab sample to provide a DNA record
1715 that is eligible for comparison in the CODIS database in not more
1816 than 2 hours without submitting the sample to a crime laboratory.
1917 (b) The department shall establish a pilot program to
2018 optimize the process of reporting DNA records and decrease the
2119 number of arrests for which a DNA sample is not collected and
2220 analyzed by assisting law enforcement agencies in implementing
2321 rapid DNA analysis of DNA samples collected under Section
2422 411.1471(b).
2523 (c) Not later than September 1, 2025, the department shall
2624 begin updating information technology systems as necessary to
2725 support the pilot program.
2826 (d) Not later than September 1, 2026, the department shall
2927 begin implementing the pilot program in two counties as determined
3028 by the department. The department may expand the pilot program to
3129 additional counties.
3230 (e) The department and each law enforcement agency
3331 participating in the pilot program may consult with the Federal
3432 Bureau of Investigation regarding rapid DNA analysis
3533 implementation and best practices.
3634 (f) Not later than January 1, 2028, the department shall
3735 review the pilot program established under this section and submit
3836 a written report to the legislature on the pilot program and any
3937 recommendations regarding the continuation or expansion of the
4038 program.
4139 (g) The department may solicit and accept gifts, grants, and
4240 donations from any public or private source to fund the pilot
4341 program.
4442 (h) The department may adopt rules as necessary to implement
4543 this section.
4644 (i) This section expires September 1, 2028.
4745 SECTION 2. This Act takes effect immediately if it receives
4846 a vote of two-thirds of all the members elected to each house, as
4947 provided by Section 39, Article III, Texas Constitution. If this
5048 Act does not receive the vote necessary for immediate effect, this
5149 Act takes effect September 1, 2025.
