77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to training requirements for and prohibited
1010 discrimination by child-care facilities and registered family
1111 homes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 42.042(e), Human Resources Code, is
1414 amended to read as follows:
1515 (e) The executive commissioner shall promulgate minimum
1616 standards that apply to licensed child-care facilities and to
1717 registered family homes covered by this chapter and that will:
1818 (1) promote the health, safety, and welfare of
1919 children attending a facility or registered family home;
2020 (2) promote safe, comfortable, and healthy physical
2121 facilities and registered family homes for children;
2222 (3) ensure adequate supervision of children by
2323 capable, qualified, and healthy personnel;
2424 (4) ensure adequate and healthy food service where
2525 food service is offered;
2626 (5) prohibit [racial] discrimination based on race or
2727 disability by child-care facilities and registered family homes;
2828 (6) require procedures for parental and guardian
2929 consultation in the formulation of children's educational and
3030 therapeutic programs;
3131 (7) prevent the breakdown of foster care and adoptive
3232 placement;
3333 (8) ensure that a child-care facility or registered
3434 family home:
3535 (A) follows the directions of a child's physician
3636 or other health care provider in providing specialized medical
3737 assistance required by the child; and
3838 (B) maintains for a reasonable time a copy of any
3939 directions from the physician or provider that the parent provides
4040 to the facility or home; and
4141 (9) ensure that a child's health, safety, and welfare
4242 are adequately protected on the grounds of a child-care facility or
4343 registered family home.
4444 SECTION 2. Section 42.0421, Human Resources Code, is
4545 amended by adding Subsections (a-1) and (a-2) to read as follows:
4646 (a-1) The initial training described by Subsection (a)(1)
4747 must include training on:
4848 (1) trauma-informed care; and
4949 (2) behavioral health that includes:
5050 (A) methods for:
5151 (i) understanding and managing behaviors;
5252 (ii) requesting a behavioral health
5353 consultation; and
5454 (iii) providing behavioral health support
5555 to all children who are provided care; and
5656 (B) a description of the impact autism and other
5757 intellectual and developmental disabilities have on behavior and
5858 communication.
5959 (a-2) The annual training described by Subsection (a)(2)
6060 must include training on care provided to children with special
6161 needs and methods for:
6262 (1) identifying possible developmental delays;
6363 (2) locating community resources for the children;
6464 (3) providing effective communication to the
6565 children's parents; and
6666 (4) accommodating the special needs of children in the
6767 day-care center or group day-care home.
6868 SECTION 3. As soon as practicable after the effective date
6969 of this Act, the executive commissioner of the Health and Human
7070 Services Commission shall adopt the rules necessary to implement
7171 the changes in law made by this Act.
7272 SECTION 4. This Act takes effect September 1, 2025.
