7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to training requirements for and prohibited
10	10	discrimination by child-care facilities and registered family
11	11	homes.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 42.042(e), Human Resources Code, is
14	14	amended to read as follows:
15	15	(e) The executive commissioner shall promulgate minimum
16	16	standards that apply to licensed child-care facilities and to
17	17	registered family homes covered by this chapter and that will:
18	18	(1) promote the health, safety, and welfare of
19	19	children attending a facility or registered family home;
20	20	(2) promote safe, comfortable, and healthy physical
21	21	facilities and registered family homes for children;
22	22	(3) ensure adequate supervision of children by
23	23	capable, qualified, and healthy personnel;
24	24	(4) ensure adequate and healthy food service where
25	25	food service is offered;
26	26	(5) prohibit [racial] discrimination based on race or
27	27	disability by child-care facilities and registered family homes;
28	28	(6) require procedures for parental and guardian
29	29	consultation in the formulation of children's educational and
30	30	therapeutic programs;
31	31	(7) prevent the breakdown of foster care and adoptive
32	32	placement;
33	33	(8) ensure that a child-care facility or registered
34	34	family home:
35	35	(A) follows the directions of a child's physician
36	36	or other health care provider in providing specialized medical
37	37	assistance required by the child; and
38	38	(B) maintains for a reasonable time a copy of any
39	39	directions from the physician or provider that the parent provides
40	40	to the facility or home; and
41	41	(9) ensure that a child's health, safety, and welfare
42	42	are adequately protected on the grounds of a child-care facility or
43	43	registered family home.
44	44	SECTION 2. Section 42.0421, Human Resources Code, is
45	45	amended by adding Subsections (a-1) and (a-2) to read as follows:
46	46	(a-1) The initial training described by Subsection (a)(1)
47	47	must include training on:
48	48	(1) trauma-informed care; and
49	49	(2) behavioral health that includes:
50	50	(A) methods for:
51	51	(i) understanding and managing behaviors;
52	52	(ii) requesting a behavioral health
53	53	consultation; and
54	54	(iii) providing behavioral health support
55	55	to all children who are provided care; and
56	56	(B) a description of the impact autism and other
57	57	intellectual and developmental disabilities have on behavior and
58	58	communication.
59	59	(a-2) The annual training described by Subsection (a)(2)
60	60	must include training on care provided to children with special
61	61	needs and methods for:
62	62	(1) identifying possible developmental delays;
63	63	(2) locating community resources for the children;
64	64	(3) providing effective communication to the
65	65	children's parents; and
66	66	(4) accommodating the special needs of children in the
67	67	day-care center or group day-care home.
68	68	SECTION 3. As soon as practicable after the effective date
69	69	of this Act, the executive commissioner of the Health and Human
70	70	Services Commission shall adopt the rules necessary to implement
71	71	the changes in law made by this Act.
72	72	SECTION 4. This Act takes effect September 1, 2025.
