75 A BILL TO BE ENTITLED
86 AN ACT
97 relating to the prescribing and ordering of Schedule II controlled
108 substances in a narcotic drug treatment program by certain advanced
119 practice registered nurses and physician assistants.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 157.0511(b-1), Occupations Code, is
1412 amended to read as follows:
1513 (b-1) A physician may delegate the prescribing or ordering
1614 of a controlled substance listed in Schedule II as established by
1715 the commissioner of the Department of State Health Services under
1816 Chapter 481, Health and Safety Code, only:
1917 (1) in a hospital facility-based practice under
2018 Section 157.054, in accordance with policies approved by the
2119 hospital's medical staff or a committee of the hospital's medical
2220 staff as provided by the hospital bylaws to ensure patient safety,
2321 and as part of the care provided to a patient who:
2422 (A) has been admitted to the hospital for an
2523 intended length of stay of 24 hours or greater; or
2624 (B) is receiving services in the emergency
2725 department of the hospital; [or]
2826 (2) as part of the plan of care for the treatment of a
2927 person who has executed a written certification of a terminal
3028 illness, has elected to receive hospice care, and is receiving
3129 hospice treatment from a qualified hospice provider; or
3230 (3) as part of a narcotic drug treatment program that
3331 has been issued a permit under Chapter 466, Health and Safety Code.
3432 SECTION 2. This Act takes effect immediately if it receives
3533 a vote of two-thirds of all the members elected to each house, as
3634 provided by Section 39, Article III, Texas Constitution. If this
3735 Act does not receive the vote necessary for immediate effect, this
3836 Act takes effect September 1, 2025.
