712 AN ACT
8- relating to measures to prevent foreign influence, foreign
9- interference, and intellectual property theft at public
10- institutions of higher education.
13+ relating to measures to prevent espionage and intellectual property
14+ theft at public institutions of higher education.
1115 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1216 SECTION 1. Chapter 51, Education Code, is amended by adding
1317 Subchapter J to read as follows:
14- SUBCHAPTER J. FOREIGN INFLUENCE, FOREIGN INTERFERENCE, AND
15- INTELLECTUAL PROPERTY THEFT PREVENTION
18+ SUBCHAPTER J. ESPIONAGE AND INTELLECTUAL PROPERTY THEFT PREVENTION
1619 Sec. 51.501. DEFINITIONS. In this subchapter:
1720 (1) "Coordinating board" means the Texas Higher
1821 Education Coordinating Board.
19- (2) "Foreign adversary" means any country designated
20- as a foreign adversary by the United States secretary of commerce
21- under 15 C.F.R. Section 791.4.
22- (3) "Foreign government" means the government or an
23- agent of a country, nation, or group of nations, or a province or
24- other political subdivision of a country or nation, other than the
25- United States government.
26- (4) "Gift" means a gift, grant, endowment, award, or
27- donation of money or property of any kind, including a conditional
28- or unconditional pledge of the gift, grant, endowment, award, or
29- donation.
30- (5) "Institution of higher education" has the meaning

32- Sec. 51.502. DISCLOSURE OF FOREIGN GIFTS AND CONTRACTS.
33- Each institution of higher education that submits reporting on
34- foreign gift and contract disclosures to the United States
35- Department of Education required under Section 117, Higher
36- Education Act of 1965 (20 U.S.C. Section 1001 et seq.), shall submit
37- that reporting to the coordinating board at an interval determined
38- by coordinating board rule.
24+ Sec. 51.502. DISCLOSURE OF FOREIGN FUNDING. Not later than
25+ September 1 of each year, each institution of higher education
26+ shall submit to the coordinating board a report on the funding
27+ received by the institution from a foreign entity during the
28+ preceding academic year.
3929 Sec. 51.503. PROHIBITION ON ACCEPTING GIFTS, GRANTS, OR
40- DONATIONS FROM CERTAIN FOREIGN GOVERNMENTS. An institution of
41- higher education may not accept a gift, grant, or donation from a
42- foreign government of a foreign adversary.
43- Sec. 51.504. TRAINING ON FOREIGN INFLUENCE, FOREIGN
44- INTERFERENCE, AND INTELLECTUAL PROPERTY THEFT PREVENTION. (a)
45- Each institution of higher education shall require each researcher,
46- faculty member, staff member, or student employee at the
47- institution who has access to sensitive, proprietary, or
48- export-controlled research or information to complete training on
49- the prevention of foreign influence, foreign interference, and
50- intellectual property theft.
30+ DONATIONS FROM CERTAIN FOREIGN ENTITIES. An institution of higher
31+ education may not accept a gift, grant, or donation from the
32+ government of China or a company or other entity directly or
33+ indirectly controlled by the government of China.
34+ Sec. 51.504. TRAINING ON ESPIONAGE AND INTELLECTUAL
35+ PROPERTY THEFT PREVENTION. (a) Each institution of higher
36+ education shall require each researcher at the institution to
37+ complete training on the prevention of espionage and intellectual
38+ property theft.
5139 (b) The training must include instruction on:
5240 (1) an understanding of the current national security
53- risks related to foreign influence, foreign interference, and
54- intellectual property theft;
55- (2) the methods used in foreign influence, foreign
56- interference, and intellectual property theft;
57- (3) the signs of foreign influence, foreign
58- interference, and intellectual property theft;
41+ risks related to espionage and intellectual property theft;
42+ (2) the methods used in espionage and intellectual
43+ property theft;
44+ (3) the signs of espionage and intellectual property
45+ theft;
5946 (4) measures to protect sensitive information and
6047 intellectual property; and
6148 (5) procedures for reporting suspected incidents of
62- foreign influence, foreign interference, or intellectual property
63- theft.
64- (c) To the extent practicable, the training must be provided
65- in conjunction with any other training required for employees at
66- the institution of higher education and be consistent with any
67- other training on information security, export controls, or
68- compliance matters required by the institution.
69- (d) Each institution of higher education shall maintain a
70- record of each person who completes training required under this
71- section.
72- (e) An institution of higher education shall prohibit a
73- person who has not completed training required under this section
74- to have unsupervised access to sensitive, proprietary, or
75- export-controlled research or information until the person
76- completes the training.

7754 Sec. 51.505. REPORTING SYSTEM. Each institution of higher

8258 Sec. 51.506. RULES. The coordinating board shall adopt

8460 SECTION 2. Not later than September 1, 2026, each public
8561 institution of higher education shall:

87- Education Code, as added by this Act; and
88- (2) ensure that each applicable person at the
89- institution has completed the training required by Section 51.504,
90- Education Code, as added by this Act.
62+ (1) submit the initial report required under Section
63+ 51.502, Education Code, as added by this Act; and
64+ (2) ensure that each researcher at the institution has
65+ completed the training required by Section 51.504, Education Code,
66+ as added by this Act.
9167 SECTION 3. This Act takes effect September 1, 2025.
