9 | 9 | | relating to providing free prekindergarten for certain children. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 28.02124(a), Education Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (a) Subject to Subsection (c), a parent or guardian may |
---|
14 | 14 | | elect for a student to: |
---|
15 | 15 | | (1) repeat prekindergarten; |
---|
16 | 16 | | (2) enroll in prekindergarten, if the student would |
---|
17 | 17 | | have been eligible to enroll in prekindergarten during the previous |
---|
18 | 18 | | school year under Section 29.153 [29.153(b)] and the student has |
---|
19 | 19 | | not yet enrolled in kindergarten; |
---|
20 | 20 | | (3) repeat kindergarten; |
---|
21 | 21 | | (4) enroll in kindergarten, if the student would have |
---|
22 | 22 | | been eligible to enroll in kindergarten in the previous school year |
---|
23 | 23 | | and has not yet enrolled in first grade; or |
---|
24 | 24 | | (5) for grades one through eight, repeat the grade in |
---|
25 | 25 | | which the student was enrolled during the previous school year. |
---|
26 | 26 | | SECTION 2. Section 29.153(a-1), Education Code, is amended |
---|
27 | 27 | | to read as follows: |
---|
28 | 28 | | (a-1) A district shall offer prekindergarten classes to any |
---|
29 | 29 | | child [if the district identifies 15 or more children] who is [are |
---|
30 | 30 | | eligible under Subsection (b) and are] at least four years of age. |
---|
31 | 31 | | A school district may offer prekindergarten classes to any child |
---|
32 | 32 | | [if the district identifies 15 or more eligible children] who is |
---|
33 | 33 | | [are] at least three years of age. A district may not charge tuition |
---|
34 | 34 | | for a prekindergarten class offered under this section. |
---|
35 | 35 | | SECTION 3. Section 29.1543, Education Code, is amended to |
---|
36 | 36 | | read as follows: |
---|
37 | 37 | | Sec. 29.1543. EARLY EDUCATION REPORTS. The agency shall |
---|
38 | 38 | | produce and make available to the public on the agency's Internet |
---|
39 | 39 | | website annual district and campus-level reports containing |
---|
40 | 40 | | information from the previous school year on early education in |
---|
41 | 41 | | school districts and open-enrollment charter schools. A report |
---|
42 | 42 | | under this section must contain: |
---|
43 | 43 | | (1) the information required by Section 29.1532(c) to |
---|
44 | 44 | | be reported through the Public Education Information Management |
---|
45 | 45 | | System (PEIMS); |
---|
46 | 46 | | (2) a description of the diagnostic reading |
---|
47 | 47 | | instruments administered in accordance with Section 28.006(c) or |
---|
48 | 48 | | (c-2); |
---|
49 | 49 | | (3) the number of students who were administered a |
---|
50 | 50 | | diagnostic reading instrument administered in accordance with |
---|
51 | 51 | | Section 28.006(c) or (c-2); |
---|
52 | 52 | | (4) the number of students whose scores from a |
---|
53 | 53 | | diagnostic reading instrument administered in accordance with |
---|
54 | 54 | | Section 28.006(c) or (c-2) indicate reading proficiency; |
---|
55 | 55 | | (5) the number of kindergarten students who were |
---|
56 | 56 | | enrolled in a prekindergarten program in the previous school year |
---|
57 | 57 | | in the same district or school as the district or school in which |
---|
58 | 58 | | the student attends kindergarten; |
---|
59 | 59 | | (6) the number and percentage of students who perform |
---|
60 | 60 | | satisfactorily on the third grade reading or mathematics assessment |
---|
61 | 61 | | instrument administered under Section 39.023[, disaggregated by |
---|
62 | 62 | | whether the student was eligible for free prekindergarten under |
---|
63 | 63 | | Section 29.153]; |
---|
64 | 64 | | (7) the number of students described by Subdivision |
---|
65 | 65 | | (6) who attended kindergarten in the district, disaggregated by: |
---|
66 | 66 | | (A) whether the student met the kindergarten |
---|
67 | 67 | | readiness standard on the reading instrument adopted under Section |
---|
68 | 68 | | 28.006; |
---|
69 | 69 | | (B) whether the student attended prekindergarten |
---|
70 | 70 | | in the district; and |
---|
71 | 71 | | (C) the type of prekindergarten the student |
---|
72 | 72 | | attended, if applicable; and |
---|
73 | 73 | | (8) the information described by Subdivisions (6) and |
---|
74 | 74 | | (7) disaggregated by whether the student is educationally |
---|
75 | 75 | | disadvantaged. |
---|
76 | 76 | | SECTION 4. Sections 48.005(a) and (i), Education Code, are |
---|
77 | 77 | | amended to read as follows: |
---|
78 | 78 | | (a) In this chapter, average daily attendance is: |
---|
79 | 79 | | (1) the quotient of the sum of attendance for each day |
---|
80 | 80 | | of the minimum number of days of instruction as described under |
---|
81 | 81 | | Section 25.081(a) divided by the minimum number of days of |
---|
82 | 82 | | instruction; |
---|
83 | 83 | | (2) for a district that operates under a flexible year |
---|
84 | 84 | | program under Section 29.0821, the quotient of the sum of |
---|
85 | 85 | | attendance for each actual day of instruction as permitted by |
---|
86 | 86 | | Section 29.0821(b)(1) divided by the number of actual days of |
---|
87 | 87 | | instruction as permitted by Section 29.0821(b)(1); |
---|
88 | 88 | | (3) for a district that operates under a flexible |
---|
89 | 89 | | school day program under Section 29.0822, the average daily |
---|
90 | 90 | | attendance as calculated by the commissioner in accordance with |
---|
91 | 91 | | Sections 29.0822(d) and (d-1); or |
---|
92 | 92 | | (4) for a district that operates a prekindergarten |
---|
93 | 93 | | [half-day program or a full-day] program under Section 29.153(c): |
---|
94 | 94 | | (A) for a half-day program, one-half of the |
---|
95 | 95 | | average daily attendance calculated under Subdivision (1); or |
---|
96 | 96 | | (B) for a full-day program, the average daily |
---|
97 | 97 | | attendance calculated under Subdivision (1). |
---|
98 | 98 | | (i) A district or a charter school operating under Chapter |
---|
99 | 99 | | 12 that operates a half-day prekindergarten program is eligible to |
---|
100 | 100 | | receive one-half of average daily attendance under Subsection (a) |
---|
101 | 101 | | if the district's or charter school's prekindergarten program |
---|
102 | 102 | | provides at least 32,400 minutes of instructional time to students. |
---|
103 | 103 | | SECTION 5. Sections 29.153(b), (e-1), and (f), Education |
---|
104 | 104 | | Code, are repealed. |
---|
105 | 105 | | SECTION 6. This Act applies beginning with the 2025-2026 |
---|
106 | 106 | | school year. |
---|
107 | 107 | | SECTION 7. This Act takes effect immediately if it receives |
---|
108 | 108 | | a vote of two-thirds of all the members elected to each house, as |
---|
109 | 109 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
110 | 110 | | Act does not receive the vote necessary for immediate effect, this |
---|
111 | 111 | | Act takes effect September 1, 2025. |
