611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to instructional facilities funding for certain
914 open-enrollment charter schools.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 12.106, Education Code, is amended by
12- amending Subsections (d) and (f) and adding Subsections (e-1) and
13- (f-1) to read as follows:
17+ amending Subsections (d) and (f) and adding Subsection (e-1) to
18+ read as follows:
1419 (d) Subject to Subsections [Subsection] (e) and (e-1), in
1520 addition to other amounts provided by this section, a charter
1621 holder is entitled to receive, for the open-enrollment charter
1722 school, an annual allotment [funding] per student in average daily
1823 attendance [in an amount] equal to [the guaranteed level of state
1924 and local funds per student per cent of tax effort under Section
2025 46.032(a) multiplied by] the lesser of:
2126 (1) the state average interest and sinking fund tax
2227 rate imposed by school districts for the current year multiplied by
2328 the guaranteed level of state and local funds per student per cent
2429 of tax effort under Section 46.032(a); or
2530 (2) the maximum amount of the basic allotment provided
2631 under Section 48.051 for the applicable school year multiplied by
2732 0.06 [a rate that would result in a total amount to which charter
2833 schools are entitled under this subsection for the current year
2934 equal to $60 million].
3035 (e-1) A charter holder is entitled to receive funding under
3136 Subsection (d) for an open-enrollment charter school only if the
3237 governing body of the school annually certifies in writing to the
33- agency that none of the following derives any financial benefit
34- from a real estate transaction with the school:
35- (1) an administrator, officer, or employee of the
36- school;
37- (2) a member of the governing body of the school or its
38- charter holder; or
39- (3) a person related within the third degree by
40- consanguinity or second degree by affinity, as determined under
41- Chapter 573, Government Code, to a person described by Subdivision
42- (1) or (2).
38+ agency that no administrator, officer, or employee of the school
39+ and no member of the governing body of the school or its charter
40+ holder derives any personal financial benefit from a real estate
41+ transaction with the school.
4342 (f) Funds received by a charter holder under Subsection (d)
4443 may only be used:
4544 (1) to lease an instructional facility;
4645 (2) to pay property taxes imposed on an instructional
4746 facility;
4847 (3) to pay debt service on bonds issued to finance an
4948 instructional facility; [or]
5049 (4) for any other purpose related to the purchase,
5150 lease, sale, acquisition, or maintenance of an instructional
5251 facility;
5352 (5) to purchase or pay debt service on bonds issued to
5453 finance the purchase of school buses;
5554 (6) to purchase or pay debt service on bonds issued to
5655 finance the acquisition or update of technology equipment used to
5756 support instruction;
5857 (7) to pay debt service on bonds issued to improve
5958 school safety and security in accordance with the requirements of
6059 Section 37.351; or
6160 (8) to pay debt service on bonds issued to finance the
6261 construction, acquisition, or equipment of performing arts
6362 facilities or athletic facilities, other than a stadium with
6463 seating capacity for more than 1,000 spectators.
65- (f-1) The governing body of an open-enrollment charter
66- school must comply with Chapter 551, Government Code, when
67- considering the issuance of bonds.
6864 SECTION 2. This Act takes effect September 1, 2025.
