| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 29.153, Education Code, is amended by | |
| 14 | 14 | adding Subsection (h) to read as follows: | |
| 15 | 15 | (h) Notwithstanding any other law, a facility or location at | |
| 16 | 16 | which prekindergarten classes are provided by a school district or | |
| 17 | 17 | open-enrollment charter school in partnership with a private entity | |
| 18 | 18 | under this section may not be required to comply with: | |
| 19 | 19 | (1) any municipal ordinance applicable to the | |
| 20 | 20 | operation of a private prekindergarten program other than a | |
| 21 | 21 | municipal ordinance providing a local occupancy restriction; or | |
| 22 | 22 | (2) any municipal ordinance applicable to the | |
| 23 | 23 | operation of a prekindergarten program by a school district or | |
| 24 | 24 | open-enrollment charter school. | |
| 25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2025. |
